52.217-5 EVALUATION OF OPTIONS (JUL 1990)
Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. UAI 5152.211-9000 EVALUATION OF SUBDIVIDED ITEMS. (MAR 1995)
Item Nos. 0001, 0002, 0003, 0004, 0005, 0006, 0007, 0008, 0015, 0016, 0017, 0018, 0019, 0020, 0021, 0022 are subdivided into two or more estimated quantities and are to be separately priced. The Government will evaluate each of these items on the basis of total price of its subitems.
(End of clause)
UAI 5152.211-9001 VARIATIONS IN ESTIMATED QUANTITIES – SUBDIVIDED ITEMS (MAR 1995)
This variation in estimated quantities clause is applicable only to item Nos. 0001, 0002, 0003, 0004, 0005, 0006, 0007, 0008, 0015, 0016, 0017, 0018, 0019, 0020, 0021, 0022.
(a) Variation from the estimated quantity in the actual work performed under any second or subsequent sub-item or elimination of all work under such a second or subsequent sub-item will not be the basis for an adjustment in contract unit price.
(b) Where the actual quantity of work performed for item Nos. 0001, 0002, 0003, 0004, 0005, 0006, 0007, 0008, 0015, 0016, 0017, 0018, 0019, 0020, 0021, 0022 is less than 85% of the quantity of the first sub-item listed under such item, the contractor will be paid at the contract unit price for that sub-item for the actual quantity of work performed and, in addition, an equitable adjustment shall be made in accordance with the clause Federal Acquisition Regulation (FAR) 52.211-18, Variation in Estimated Quantities.

"Revised by Amendment 0001"
UAI 5152.236-9009 PARTNERING (FEB 2000)
In order to most effectively accomplish this contract, the Government proposes to form a partnership with the Contractor to develop a cohesive building team. It is anticipated that this partnership would involve the <NAME THE USING ORGANIZATIONS AND OTHER CRITICAL PARTIES HERE>, the Contractor, primary subcontractors and designers, and the Corps of Engineers. This partnership would strive to develop a cooperative management team drawing on the strengths of each team member in an effort to achieve a quality project within budget and on schedule. This partnership would be bilateral in membership and participation will be completely voluntary. Any cost associated with effectuating this partnership, excluding travel and lodging cost of Government personnel, will be borne by <<SELECT AN OPTION TO SPECIFY: the Contractor/each party/the Government. The partnering meetings shall be held in [Fill in with Date, Time, Place, etc.].
UAI 5152.249-9000 BASIS FOR SETTLEMENT OF PROPOSALS (MAR 2009)
Actual costs will be used to determine equipment costs for a settlement proposal submitted on the total cost basis under Federal Acquisition Regulation (FAR) 49.206-2(b). In evaluating a termination settlement proposal using the total cost basis, the following principles will be applied to determine allowable equipment costs:
(a) Actual costs for each piece of equipment, or groups of similar serial or series equipment, need not be available in the contractor's accounting records to determine total actual equipment costs.
(b) If equipment costs have been allocated to a contract using predetermined rates, those charges will be adjusted to actual costs.
(c) Recorded job costs adjusted for unallowable expenses will be used to determine equipment operating expenses.
(d) Ownership costs (depreciation) will be determined using the contractor's depreciation schedule (subject to the provisions of Federal Acquisition Regulation (FAR) 31.205-11).
(e) License, taxes, storage and insurance costs are normally recovered as an indirect expense and unless the contractor charges these costs directly to contracts, they will be recovered through the indirect expense rate.

NOTES
(a) THIS PROCUREMENT IS UNRESTRICTED.
(b) All technical inquiries and questions relating to this solicitation are to be submitted via Bidder Inquiry in ProjNet at http://www.projnet.org/projnet. See Section 00100 Entitled
“TECHNICAL INQUIRIES AND QUESTIONS”.
(c) Bidders shall furnish unit prices for all items listed on the schedule of bid items which require unit prices. If the bidder fails to insert a unit price in the appropriate blank for required items, but does furnish an extended total or an estimated amount for such items, the Government will deem his unit price to be the quotient obtained by dividing the extended estimated amount for that line item by the quantity. IF THE
BIDDER OMITS BOTH THE UNIT PRICE AND THE EXTENDED ESTIMATED
AMOUNT FOR ANY ITEM, HIS BID WILL BE DECLARED NONRESPONSIVE.
(d) All quantities shown on the BIDDING SCHEDULE are estimated quantities except when the unit of measure is shown as "lump sum", "job" or "each".
(e) If a bid or modification to a bid based on unit price is submitted which provides for a lump sum adjustment to the total estimated cost, the application of the lump sum adjustment to the unit price in the schedule must be stated. If it is not stated, the bidder agrees that the lump sum adjustment shall be applied on a pro rata basis to the unit price in the Bid Schedule.
(f) Item Nos. 0001, 0002, 0003, 0004, 0005, 0006, 0007, 0008, 0015, 0016, 0017, 0018, 0019, 0020, 0021,and 0022, are subdivided bid items. Each of these items has been subdivided into two sub-items. The Contractor shall bid on only one of these eight subdivided bid items for the base contract period and shall bid on only one of the eight subdivided bid items for each bid option. A bid for the work shall include a bid for each of the sub-items for either Item 0001, 0002, 0003, 0004, 0005, 0006, 0007, OR 0008, and 0015, 0016, 0017, 0018, 0019, 0020, 0021, OR 0022. Bidders should refer to Section 00 08 00.00 09 SPECIAL CONTRACT REQUIREMENTS, paragraph entitled "VARIATIONS IN ESTIMATED QUANTITIES--SUBDIVIDED ITEMS" before preparing their bid for these items.
http://www.projnet.org/projnet
(g) All extensions of the unit price shown will be subject to verification by the Government. In case of variation between the unit price and the extension, the unit price will be considered to be the bid.
(h) Award will be made as a whole to the lowest responsive, responsible bidder as may be in the best interest of the Government.
(i) Lack of registration in the SAM database will make an offeror ineligible for award. SEE CONTRACT CLAUSE 52.204-7
ENTITLED, "SYSTEM FOR AWARD MANAGEMENT".
(j)The SF1442, Bidding Schedule, Plant Characteristic Sheets, and Section 00600 (Representations and Certifications) must be accurately completed and returned with your bid or it may be rejected as nonresponsive.
(k) The contract will be 365 days from the date of award, unless it becomes necessary to terminate the contract earlier.
(l)DEMOBILIZATION: Only ONE demobilization will be paid.
(m) Line items 0015-0022 are optional line items that may be exercised if funding becomes available but will not extend the period of performance of this contract.
(n) Except for the subdivided bid items as noted in paragraph above, Bidders shall include a bid price for all items in the base period and all items in the option period. Failure to provide bid prices for all payment items will render the bid non-responsive.
(o) If a contractor submits a bid on this solicitation to use a dredge that is currently under another contract then the contractor may not be eligible for award unless they submit a detailed plan demonstrating how they plan to successfully complete multiple contracts using one dredge. Any plan submitted must be accepted and approved by USACE prior to award.

SPECIAL CONTRACT REQUIREMENTS
PART 1 GENERAL
1.1 DELIVERY, PROSECUTION, TERMINATION, AND SUBSTITUTION OF PLANT
1.1.1 Delivery
a. The Contractor shall deliver the dredge and attendant plant ready for operation to the first work location as described in Section 35 20 23.00 09 DREDGING, paragraph, FIRST WORK LOCATION, or to any alternate work site nearer to the point of origin as may be directed, within 30 calendar days after date of receipt by the Contractor of notice to proceed. The plant will undergo a government inspection within 7-10 days after the bid opening, and the contractor notified of acceptance or rejection.
b. A prework conference will be held prior to commencement of work.
The time and place of the conference will be determined by mutual agreement between the Contracting Officer or his designated representative and the Contractor.
1.1.2 Prosecution
The Contractor shall prosecute the work assigned him to meet the schedule of dredging operations as determined by the Contracting Officer. The work schedule will normally be 24 hours per day, 7 days per week .
1.1.3 Termination
Upon termination or completion of the contract, the dredge and attendant plant will be released to the Contractor at the site of the final work location.
1.1.4 Substitution of Plant
Substitution of dredge or dredges will be allowed in rare cases provided the Contractor furnishes written justification and the following conditions are met:
a. The substitute dredge meets all requirements of the contract specifications, and the Contractor submits clear evidence that the proposed substitute dredge can, and has performed at the rate set forth in Section 35 20 23.00 09 DREDGING, paragraph DREDGING EQUIPMENT.
b. The substitute dredge will be made available for inspection by Government personnel prior to beginning work and prior to the release of the working dredge.
c. The Government is reimbursed all costs in connection with inspection of the substitute dredge.
d. The substitute dredge is delivered to the worksite before the original dredge is shutdown and moved off the jobsite. This
DOCUMENT 00 80 00.00 09 Page 2 requirement does not apply to substitutions made during suspension and release periods as per Section 01 00 00.00 09 GENERAL CONTRACT REQUIREMENTS, paragraph DURATION OF CONTRACT, subparagraph "c".
e. The submitted rate for the substitute dredge has been determined by the Contracting Officer to be in the best interest of the Government.
f. Substitution of plant will not be allowed prior to award of contract.
g. If the substitute dredge does not meet the specifications for the bid item of the original dredge, the hourly rate of the substitute dredge shall be computed by the following formula:
Substitute Dredge Hourly Rate = ((Original Hourly Rate)X(Estimated Hours in Original Bid Item))/(Estimated Hours in Bid Item Applicable to Substitute Dredge)
1.2 WORK TO BE PERFORMED BY CONTRACTOR'S OWN ORGANIZATION
Within 10 days after award, the successful Bidder/Contractor must furnish the Contracting Officer a description of the items of work which will be performed with its own forces and the estimated cost of those items. (See paragraph PERFORMANCE OF WORK BY THE CONTRACTOR.)
1.3 PERFORMANCE OF WORK BY THE CONTRACTOR
The Contractor shall perform on the site, and with its own organization, work equivalent to at least fifty (50) percent of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performing the work, the Contractor requests a reduction and the Contracting Officer determines that the reduction would be to the advantage of the Government. (FAR 52.236-1)
1.4 PHYSICAL DATA (APR 1984)
Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.
(a) Weather Conditions. Data on weather conditions may be obtained from the National Weather Service.
(b) Transportation Facilities. Floating plant may reach the sites of work via the Mississippi, Red, and Ouachita/Black Rivers. Obtaining access through private lands to landings near the sites of work for land transportation is the responsibility of the Contractor.
c. Channel Traffic. Traffic on the rivers consists of commercial towboats and tows, passenger vessels, and small boats. Traffic in the river and harbors may interfere to some extent with dredging operations.
d. The material to be dredged will consist of sand, gravel, loose rock, silt, mud and clay; and in certain localities stumps, roots, logs, riprap, driftwood, sunken objects, and miscellaneous debris may be encountered. The dredge must be equipped with suitable pump impellers and cutters to efficiently handle these varying materials on pipeline lengths up to 6,500 feet.
DOCUMENT 00 80 00.00 09 Page 3
e. The work required consists of making or enlarging dredge cuts, construction of fills, and dredging in various channels and harbors.
The currents may vary from 0 to 7 feet per second. The bank to be cut may extend as much as 45 feet above the water surface.
f. The dredging operations contemplated are not all in or near cities. Camps or floating plant may be necessary for the housing or boarding of the labor employed by the Contractor.
g. Obstruction of Channel.
