1. Contracting Agency:

U.S. Army Corps of Engineers, Vicksburg District 4155 Clay Street Vicksburg, Mississippi, 39180

2. Description of Action:

The USACE Dredge JADWIN is requesting approval for the purchase of a replacement 600 horse power electric motor for the Jetting Pump.

The estimated cost of the procurement including overnight shipping to the vessel, is a Not-to-Exceed amount of $86,117.00.

The motor is available for immediate weekend delivery, to the current location of the Dredge Jadwin, near St. Francisville, La:

Redstick Armature Works, Inc.

4110 US-61, St Francisville, LA 70775

(225) 635-0443

CAGE: 7BF56

3. Description of Supplies / Services:

The contractor will supply and deliver to the Dredge Jadwin one (1) GE DC 600hp/1150rpm/500V, motor for the jetting pump on the vessel.

4. Authority Cited: Authority permitting other than full and open competition for the procurement of these services; FAR 13.106(b)(1)(i) - Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

5. Reason for Authority Cited:

On 21 Aug 2015, the Dredge JADWIN suffered a catastrophic failure of the main jetting pump motor.

The Dredge is currently operating in the main shipping channel, of the Lower Mississippi River, near Baton Rouge, Louisiana. As a result of the motor failure, the vessel cannot continue dredging operations, and is currently sitting idle, at an estimated cost to the District of $70,000.00 per day.

Maintaining a clear shipping channel on the lower Mississippi River is a critical part of the District’s and US Army Corp of Engineer’s overall mission, and of critical importance to the nation. Minimizing the impact of this motor failure, on the mission of the Dredge Jadwin, is an urgent and compelling reason to find a replacement motor to return the Dredge to operation as soon as possible.

Red River Armature works is located in close proximity to the current location of the Dredge JADWIN, and has found a suitable replacement motor, which can be delivered to the vessel, within a 24 hour period, expeditiously returning the Dredge to operation and providing a substantial cost savings to the Government by reducing vessel downtime.

6. Efforts to Obtain Competition:

In an effort to seek competition, several vendors were contacted; however none of those identified were capable of locating a suitable replacement motor, or either were not found to be registered in the System for Award Management (SAM) database, and, therefore, could not accept Government payment terms.

As an alternative option considered, was to send the damaged motor to an armature repair facility to be rewound. It was determined that this was not a viable option, due to the cost risk, and critical nature of dredge’s mission. The extent of the damage to the motor is not known, making it difficult to estimate the repair cost, or even to know if the motor can be repaired.

It has been determined that there is a greater risk of losing critical time, by sending the failed motor to a repair facility, only to learn that it could not be repaired, than to procure a replacement motor.

As a replacement motor is available from Red Stick Armature, which can be shipped immediately, it has been determined to be in the Government best interest to procure this replacement motor using simplified acquisition procedures, under the authority of FAR 13.106 – (b)(1)(i).

7. Actions to Increase Competition:

As stated in section No. 6, efforts were made to contact other vendors to no avail.

8. Market Research:

Market Research identified several potential sources to supply the subject motor, however, none were identified with immediate availability of the correct replacement, which were in close proximity to the vessel, and were also registered in the SAM database, and capable of accepting Government payment terms.

9. Interested Sources:

To date, no alternative sources have expressed formal interests, which are capable of satisfying this urgent and compelling requirement.

10. Other Facts:

Due to the critical nature of returning the dredge to operation, it is in the Government’s best interest to procure the subject replacement motor from Red Stick Armature Works. The cost of downtime exceeds the cost of the replacement motor for each day of downtime incurred and it is critical to the District’s mission to return the vessel to operation.

11. Technical Certification:

I certify that the supporting data under my cognizance, which are included in this justification are accurate and complete to the best of my knowledge and belief.

Paul McMaster Marine Engineer Dredge JADWIN

12. Fair and Reasonable Cost Determination: Pursuant to FAR 13.106-3(a)(2)Basis for award. Before making award, the contracting officer must determine that the proposed price is fair and reasonable. If only one response is received, include a statement of price reasonableness in the contract file.

The contracting officer may base the statement on -- (i) Market research; (ii) Comparison of the proposed price with prices found reasonable on previous purchases; (iii) Current price lists, catalogs, or advertisements. However, inclusion of a price in a price list, catalog, or advertisement does not, in and of itself, establish fairness and reasonableness of the price; (iv) A comparison with similar items in a related industry; (v) The contracting officer’s personal knowledge of the item being purchased; (vi) Comparison to an independent Government estimate; or (vii) Any other reasonable basis.

The pricing received including overnight emergency shipping by a hotshot freight company, has been determined to be fair and reasonable, based on Market Research, and a comparison with similar items in a related industry.

I hereby determine that the anticipated cost or price to the Government for this contract is fair and reasonable based on the above.

R. Ellis Screws Contracting Officer, CEMVK-CT-C

APPROVAL

Based on the foregoing justification, I hereby approve the procurement of this item: Supply and Deliver on an emergency basis, one (1) replacement motor for the jetting pump on the Dredge Jadwin.

Pursuant to FAR 13.106(b)(1)(i) I hereby determine that the circumstances of the contract action deem only one source reasonably available. Funds are available under PR&C W807PM-5233-5425
