4. AUTHORITY CITED: 10 United States Code 2304(c)(1) as implemented in Federal Acquisition Regulation 6.302-1(a)(2)(ii)(A), “Only one responsible source and no other supplies or services will satisfy agency requirements”.
5. REASON FOR AUTHORITY CITED: AN/USQ-125(V)9 (NSN 5895-01-613-1088) are unique supplies available from only one source.
The AN/USQ-125(V)9 is not a commercial item. The item is not sold on the commercial market. AN/USQ-125(V)9 is “highly specialized equipment” within the meaning of FAR 6.302-1(a)(2)(ii). The item is specifically designed to interface with military aircraft and tactical systems used by the US Air Force & Air National Guard. AN/USQ-125(V)9 is produced by a single manufacturer, DRS Technologies Inc.
The AN/USQ-125(V)9 is not an “off-the-shelf” piece of equipment. It is a specialized low-volume unit and is only manufactured upon order. As such, it requires substantial capital investment in productive plant and equipment. Manufacture by multiple vendors would require duplicative capital investment, testing, and certification that would have to be amortized across each unit produced and would result in substantial duplication of cost to the Government that is not expected to be recovered through competition.
6. EFFORTS TO OBTAIN COMPETITION: The PDT undertook market research to determine whether the item was available from other manufacturers or from resellers.
No other options were discovered.
7. ACTIONS TO INCREASE COMPETITION: The PDT will continue to perform periodic market research to determine whether competing products come on the market.

8. MARKET RESEARCH: Market research was conducted for this acquisition in March & April 2016 using internet sources, posting a sources sought notice to www.fbo.gov, and by interviewing the customer and the manufacturer. Market research revealed that AN/USQ-125(V)9 is an item unique to the military and is not a commercial item. The item is specifically designed to interface with military aircraft and tactical systems. Items are not “off-the-shelf”, but are manufactured upon receipt of a customer order with a lead time of 9 months. Market research revealed that the item is produced by a single manufacturer, DRS Technologies Inc. In email correspondence with DRS, the DRS sales representative stated that they do not sell this items through distributors and only sell the item directly to the Government. The Navy is known to have an IDIQ vehicle with the vendor, but it is not available for use or ordering by other agencies. A sources sought notice was posted as required by DFARS PGI 206.302-1(d). No response was received.
9. INTERESTED SOURCES: To date, no other sources have written to express an interest.” The notices required by FAR 5.201 shall be published upon approval of this document, and any bids or proposals received shall be considered.

APPROVAL
Based on the foregoing justification, I hereby approve the procurement of AN/USQ- 125(V)9 (NSN 5895-01-613-1088) on an other than full and open competition basis pursuant to the authority of 10 United States Code 2304(c)(1) as implemented in Federal Acquisition Regulation 6.302-1(a)(2)(ii)(A), “Only one responsible source and no other supplies or services will satisfy agency requirements”, subject to availability of funds, and provided that the services and property herein described have otherwise been authorized for acquisition.
