STATEMENT OF WORK (SOW)

ARCHITECTURAL & ENGINEERING (A&E) SERVICES

USACE, HUNTSVILLE, AL

IN SUPPORT OF

BALLISTIC MISSILE DEFENSE PROGRAM

19 December 2016

1. SCOPE

The Architect-Engineer (A-E) shall, commencing upon the dates of task orders awarded under this indefinite delivery contract (IDC), perform services to meet all applicable State, Federal, and local requirements. The objective of this contract is to provide technical support and design in support of Missile Defense Installations of the Ballistic Missile Defense (BMD) Program. This Multiple Indefinite Delivery Contract is expected to be used for the acquisition of AE design services by Huntsville Center and other USACE districts exclusively for the support of BMD projects and will require the contractors to have the capability to respond to multiple task order requests for services within diverse locations throughout the Contiguous United States, Alaska, Hawaii, US Territories and possessions and other Missile Defense Installations. BMD A-E services may also be required to support BMD in the following geographic areas: USACE Transatlantic Division (TAD), North Atlantic Division (NAD), and Pacific Ocean Division (POD) such as Europe, Asia, and Australia. Services within TAD, NAD or POD that are outside of the Contiguous United States, Alaska, Hawaii, US Territories and possessions (1) will not result in any final drawings under this contract which require licensing in the host country and

(2) will be performed at the Contractor's United States Place of Performance with the exception of site visits for fact-finding, consultation, and information gathering.

1.1 Programmatic Approach. Because the ballistic missile threat changes quickly, the Department of Defense needs maximum flexibility for the Ballistic Missile Defense System (BMDS). In order to successfully achieve the goal of deployment, facility designs required by this contract and weapons system designs (prepared by others) must run concurrently. Various elements of facilities designs are likely to be completed prior to the completion of system designs within these facilities. The strategy is to proceed under basic engineering parameters that will minimize the impact on the criteria and ultimately the facility design. Facility criteria may be technically complex or atypical due to the specialized needs of the Missile Defense weapons system. Criteria could include complex seismic dynamics, explosive safety and electronic and physical security considerations, and challenging environmental conditions. In addition, the spiral development concept being used to develop the Ballistic Missile Defense (BMD) system results in frequent technology and criteria evolution, requiring maximum flexibility in the support facilities design.

2. APPLICABLE DOCUMENTS

Documents, other than those listed below, identified as necessary to the performance of this contract will be invoked in specific task orders. Such documents may include, but not be limited to, standards, specifications, host nation agreements and other reference documents needed to identify and clarify the specific work tasks or deliverable products.

3. REQUIREMENTS

3.1 General Requirements. Architect-Engineer (A-E) design services in support of the Ballistic Missile Defense (BMD) Program for new or rehabilitation designs of tactical, tactical support, and non-tactical facilities including missile control buildings, industrial workshops, power plants, communications facilities, administration buildings, and various other facilities; new and rehab road work, utility work, and building systems work. The designs require contractor experience in radar, missile launch, and tactical support facilities and various other facilities that may be required.

3.1.1 Location of Work. The program involves A-E services to support the BMD Program at diverse locations throughout the Contiguous United States, Alaska, Hawaii, US Territories and possessions and other Missile Defense Installations. BMD A-E services may also be required to support BMD in the following geographic areas: USACE Transatlantic Division (TAD), North Atlantic Division (NAD), and Pacific Ocean Division (POD) such as Europe, Asia, and Australia. Services within TAD, NAD or POD that are outside of the Contiguous United States, Alaska, Hawaii, US Territories and possessions (1) will not result in any final drawings under this contract which require licensing in the host country and (2) will be performed at the Contractor's United States Place of Performance with the exception of site visits for fact-finding, consultation, and information gathering.

3.1.2 Performance. The A-E shall initiate the services within 10 calendar days after the task order is issued, unless otherwise indicated on the order, and shall complete all work and services under each task order within the period of performance specified in the task order. During the execution of the work the A-E shall promptly notify the Contracting Officer in writing of any discrepancies, ambiguities, or lack of clarity in the materials or instruction furnished. Such notification shall be made in writing within 10 days of the event.

3.1.2.1 The performance schedule and required delivery date for each product produced under this contract will be reflected in the appropriate task order. Optional services may be exercised in accordance with the schedule established for each project under each task order.

3.1.3 Certification of Work. All environmental related work and work requiring a seal for permitting, including design drawings and specifications submitted under the contract, shall contain the seal of a professional engineer registered in the state in which the AE work was performed unless otherwise specified in the individual task order.

3.2 Technical Objectives and Goals

3.2.1 Prosecution and Completion of the Work

The A-E shall execute the work under the direction of a company officer or responsible representative approved by the Contracting Officer in writing. The company officer or representative shall be designated as A-E project manager and shall be responsible for the complete coordination of all work under this contract. All work shall be accomplished with adequate internal controls and review procedures, which will eliminate conflicts, errors, and omissions, and ensure technical adequacy of all outputs.

3.2.1.1 Project Control and Reporting. This paragraph establishes policy and procedures for the management and control of all work activities. This paragraph delineates and defines the channels of information and authority and the appropriate control mechanisms and reports necessary to achieve the desired levels of performance. These project control and reporting requirements may be modified by the Contracting Officer or the Contracting Officer’s Representative (COR) in writing for any task order issued under this contract. If this is done, the specific reporting requirements of modifications will be listed in the task order.

3.2.2 The A-E shall provide reports as described below when so specified in the individual task order statement of work (SOW.)

3.2.2.1 Unscheduled Reporting. The A-E shall promptly notify the contracting officer in writing of any significant, unforeseen developments that affect the contract price or schedule.

3.2.2.2 Monthly Progress Reports. The A-E shall prepare monthly progress reports which are to be submitted to the Contracting Officer and CEHNC Project Manager(s) by the 15th day of the following month. The purpose of these reports is to provide the status of actual cost expenditures and technical progress as compared with projections and to review the schedule milestones. These reports are described below:

3.2.2.3 Technical Progress Report. The purpose of this report is to provide a concise narrative assessment by the A-E Project Manager of the current status of the contract rolled up by project and program. The report shall address the work accomplished during the reporting period, work to be accomplished during the next reporting period, and significant problem areas with recommended solutions. If any information in the technical progress report is classified, this section of the monthly progress report shall be sent under separate cover.

3.2.2.4 Financial Reports. For Cost Tracking, the A-E shall prepare a Monthly Individual Performance Report (IPR) for each active A-E contract task order that is also rolled up by project and program. The IPR system shall be automated with each approved Work Task Proposal providing the baseline. Actual expenditures shall be entered into the system, and an IPR shall be produced. Work and schedule planned, actual, and progress for the current period and cumulatively and variances as well as budget and estimate at completion shall be provided. The A-E shall list each deliverable and percent complete. For each task which is outside the variance thresholds, the A-E shall prepare a Cost/Schedule Variance Report detailing the Events leading up to the variance, proposed corrective measures, and a discussion of the impact of the variances on the program. A copy of the Variance Report shall be attached to the IPR.

3.2.2.5 The A-E shall track and report lost effort associated with approved Engineering Change proposals (ECPs), abandoned design effort, or other factors as appropriate.

3.2.2.6 Conferences, Working Groups, and Committees. Periodic meetings shall be scheduled whenever requested by the A-E or directed by the Contracting Officer or the COR for the resolution of questions or problems encountered in the performance of the work. The A-E and/or the appropriate representative(s) shall be required to attend and participate in all conferences, working groups, and committees pertinent to the work required under this contract as directed by the Contracting Officer or the COR.

3.2.2.7 Written Records. The A-E shall provide a written record of all significant conferences, meetings, discussions, verbal directions, telephone conversations, etc., with Government representative(s) relative to this contract per task order in which the A-E and/or a designated representative(s) participates. These records shall be dated and shall identify the contract number, the task order number, and the SOW paragraph references, if applicable, participating personnel, subject discussed, and conclusions reached. The A-E shall forward to the Contracting Officer or the COR, within seven calendar days, a reproducible copy of the records.

3.2.2.8 Correspondence Procedures. The A-E shall serially number all correspondence issued on the contract. All correspondence on the contract shall reference the contract number and task order number.

3.3 Specific Requirements

Specific requirements are expected to include, but will not be limited to the design of Ballistic Missile Defense Complexes including the preparation of design criteria, architectural and engineering designs, specifications, design-related analyses and studies, economic analyses and cost estimates for missile launch, radar, test, evaluation, administrative and training facilities.

Additional support may include environmental documentation, permits, special studies, and other environmental activities as required by federal, state and local laws and regulations; feasibility studies, other special studies, geotechnical investigations and topographical mapping services, programmatic support services, as-built, construction phase services, and engineering and design during construction.

3.3.1 Specific requirements will be fully set forth by individual task orders. In addition to the general requirements noted above and specific requirements which may be incorporated by the award of task orders, the following specific requirements of the program are included for compliance with respect to all future task orders.

3.3.1.1 Surveying and Geotechnical Investigations. The A-E shall provide topographic (topo) survey and mapping of desired areas. The final survey data shall be provided in a 3D design file format as specified per task order. The A-E shall also conduct geotechnical investigations as specifically directed for specific projects.

3.3.1.2 Sustainable Design Applications. The A-E shall provide facility designs that as a minimum achieve a silver rating for new facilities using the US Green Building Council (USGBC) Leadership in Energy and Environmental Design (LEED) rating system in accordance with ETL 1110-3-491, Engineering and Design - Sustainable Design for Military Facilities.

3.3.1.3 National Environmental Protection Agency (NEPA) Documentation Investigations. The A-E shall conduct an environmental assessment or prepare a supplement to comply with the requirements of the National Environmental Policy Act (NEPA) and Army Regulation (AR) 200- 2 as required by task order.

3.3.1.4 Construction Plans, Specifications and Cost Estimates. Design services for BMD System facilities shall result in design phase submittals to include preliminary design documents, plans, specifications, design analysis and cost estimates in accordance with CEHNC 1110-1-1 and AR 415-15.

3.3.1.5 Value Engineering (VE) Studies. The A-E shall participate in VE studies of facility designs developed by the A-E that have a construction working estimate of $2M or more.

3.3.1.6 Computer-Aided Design (CAD) Systems and Geographical Information Systems (GIS).

Engineering design may be required under this contract, firms must be capable of providing design drawings on a CAD system. Building Information Modeling (BIM) may be required for the design of vertical construction projects IAW Engineering and Construction Bulletin (ECB) 2013-18. The requirement to use BIM processes will be identified in each individual task order.

All in progress and fielded graphics data, design drawings, survey and GIS data, relational databases and related data generated shall be available on-line to the government through the use of the Internet connection.

3.3.2 Contractor Services

3.3.2.1 Contract Solicitation Documents.

Design-Bid-Build. In addition to plans and technical specifications, the A-E shall provide Division 1 specifications and Special Contract Clauses to be included in the construction contract resulting from an A-E design. The A-E shall assist in preparing solicitation amendments in accordance with AR 415-15 and instructions of the agency awarding the construction contract.

Design-Build. The A-E shall provide the statement of work and request for proposal package for solicitation of design-build projects.

3.3.2.2 Support to Construction Contract Solicitation.

Amendments and RFI’s: The contractor shall support the solicitation phase for the construction contract. Support consists of responding to requests for technical information and incorporation of revisions to the contract solicitation package as amendments, when necessary. The solicitation amendments shall be prepared in accordance with AR 415-15 and instructions of the agency awarding the construction contract. Amendment changes shall also be incorporated as a revision to the 100% current working estimate, with revisions delineated.

Conformed Plans and Specifications: The contractor shall incorporate all revisions to the plans and specifications resulting from amendments during the solicitation of the construction contract.

Proposal Evaluation: The contractor shall support the technical and cost evaluation of construction contract proposals.

3.3.2.3 Engineering Services during Construction. The A-E shall respond to inquiries during the construction phase of A-E designs. The A-E shall also review construction submittals; provide responses to construction contractor requests for information; revised specifications, drawings and cost estimates for construction contract modifications; and provide final as-built drawings in electronic format. Where project or construction complexity requires, on-site engineering support may be utilized.

3.3.2.4 Commissioning Services. The A-E may be required to prepare commissioning plans to include required forms and procedures (i.e., representative/sample pre-functional construction checklists and functional performance tests (FPT)) for the complete testing of all equipment, systems and controls. The A-E may be tasked with serving as a commissioning agent (CxA) and may be required to provide plans for Measurement and Verification at specified times after buildings are occupied. 3.4 Deliverables

Deliverables are required and shall be delivered in accordance with the contract and all task orders.

3.4.1 Safety. The contractor shall also be required to comply with the requirements of EM 385- 1-1, U.S. Army Corps of Engineers Safety and Health Manual, dated 30 November 2014.

3.4.1.1 The contractor shall submit their Corporate Safety and Health Program (SHP), as required in 29 CFR 1910.120(b) and/or 29 CFR 1926.65(b) to the COR and KO within 30 working days of contract award.

3.4.1.2 The contractor shall submit an Accident Prevention Plan (APP) to the COR and KO within 30 working days of task order issuance. The APP shall be submitted and approved for each task order involving field activities.

3.4.2 Quality Control. Quality of performance will be evaluated per individual task order in accordance with AFARS subpart 42.15.

3.4.2.1 The contractor(s) shall submit monthly quality status reports for each task order to the

COR by the 5th calendar day of the following month. The reporting requirements will be specified in each individual task order and IAW the WOP.

3.4.2.2 The contractor shall develop and submit a Quality Control Plan (QCP) for the overall contract within 30 days of contract award to the COR and KO for approval.

3.4.2.3 The contractor shall develop and submit a QCP for each individual task order within 30 days of task order issuance for approval and in accordance with the task order SOW.

3.5 Construction Plans, Specifications and Cost Estimates. The A-E shall make distribution of the deliverables described below respective of the individual task order to the reviewing agencies as indicated in each task order. The number of copies and nature of each deliverable for each agency will be specified at the task order level. Each specified entity will receive only those deliverables that pertain to their function.

3.5.1 Engineering Design. All CAD and GIS data for formal submittals shall be provided on a compact disk (CD). With prior approval, other digital media may be used for the submissions.

All final drawings shall be computer generated, plotted and provided in a format and medium that will permit their loading, storage, and use without modification or additional software on workstations running MicroStation or AutoCAD latest version as specifically directed in each individual task order. The A-E shall furnish drawings in compliance with the Tri-Service CADD Standards. Final drawings shall also be delivered in a compatible format on CD. Each CD shall contain an index of all drawings and shall be viewable in MicroStation or AutoCAD latest version as specifically directed in each individual task order. All reference files shall be included on the CD with appropriate pointers allowing the CD to be run on a standalone computer, with no requirement for other data files to be resident on the hard drive. CD’s shall not contain any irrelevant drawings or extraneous elements and shall have all necessary files in the correct directories as required by the index sheet. After making the first CD master, the A-E shall plot all drawings from the standalone computer to validate all files and references. After validation, the master shall then be furnished to CEHNC for additional validation prior to making the final deliverable CDs. The A-E shall deliver a complete set of instructions for use describing all required setups, font selections, and other relevant information required for viewing and plotting drawings. Additionally, the A-E shall furnish drawings in the size formats indicated in the individual task order. CDs shall be labeled on the front of the CD and on the spine of the jewel case.

3.5.2 Specifications. Current United Facilities Guide Specifications (UFGS) shall be the basis of project specifications provided under this project. All specifications shall be processed and delivered in SpecsIntact software configuration. The automation features of SpecsIntact shall be fully utilized for production of associated registers and reports.

3.5.3 Design Analysis and Project Information Sheet. The design analysis for each design submittal phase shall contain information as required by CEHNC 1110-1-1. The Government will furnish the Project Information Sheet form with each task order as required. The AE shall provide the completed Project Information Sheet with the final design submittal.

3.5.4 Cost Estimates. Cost estimates must be prepared using the Corps of Engineers Micro Computer Aided Cost Estimating System (MCACES).

3.5.5 Electronic Bid Sets. Plans and specifications shall be provided, as required in a task order, in the electronic formats that are compatible with the Government’s electronic solicitation protocol.

3.5.6 Review and Approval. For each study, investigation, or analysis, the A-E shall document its findings in a report that includes an executive summary, the approach, descriptions of each alternative considered, assumptions, rationale, costs, back-up data, and recommendations. Prior to commencing work on each study, the A-E shall submit to the Contracting Officer or the COR for approval, an outline of its proposed approach and the alternatives to be considered for that study. No study under this contract shall be initiated until specifically authorized in writing by the Contracting Officer. The A-E shall also submit the draft study reports to the Government and other agencies identified in the specific task orders for review. After completion of the Government's review, the A-E shall incorporate all agreed upon comments and issue a final report in accordance with the detailed submittal schedule in each task order. The A-E shall respond to comments within the agreed to number of days under each specific task order.

Agreed upon comments shall specify the section of the report, plan, or specification that was modified. Non-agreed upon comments shall clearly explain the specific reason or reasons for non-concurrence.

3.6 Format for Submittals. Formal narrative and tabular data shall be typed and printed on 8-1/2 x 11-inch sheets with fold outs for maps, sketches, schematics, charts, graphs, and other illustrative material, as necessary. Generally, all formal narrative text shall be typed in lines perpendicular to the longest axis of the sheet. Data, which cannot be clearly described in narrative form, shall be graphically shown. Legible reproducible drawings and sketches exceeding 8-1/2 x 11 inches shall be submitted to CEHNC in the number of copies stated in the individual task order. If required in the task order, reproducible sets transmitted with the final submittal shall be of the reverse-printed, polyester-film type. Typed and formal documents 11 x 17 inches or less in size shall be securely bound with hard paper or a flexible material in a durable and attractive manner. The title of the document shall appear on the cover of all submittal documents. All final documents shall be bound in a manner which will facilitate repeated disassembly and reassembly, and the title shall appear on the bound edge, in a secure manner, as well as on the cover. Narrative contents of the document(s) shall be arranged in a logical sequence and organized by sections, unless otherwise specified. A table of contents and index are required for each document. Tabs and/or dividers shall clearly and distinctly divide sections, subsections, appendices, etc. Pages, paragraphs, charts, and graphs shall be numbered.

References to information contained elsewhere within the contents of the document(s) will be properly noted. All data sources used in preparing the information presented in the document(s) shall be appropriately referenced.

3.6.1 Review Comments for Submittals. The submittals will be reviewed by appropriate Government agencies to evaluate content and determine adequacy. Written comments will be furnished to the A-E by the Contracting Officer or the COR. These comments will be discussed in detail during the presentation and review period. The A-E shall provide written notification of resolution actions for each comment. Intentions on noncompliance with any comment shall be substantiated in detail.

3.6.2 Summary of Submittals Required. The A-E shall implement, maintain, and control a system for identification, preparation, reproduction, distribution, and maintenance of all documentation, data, and information necessary for the A-E's internal management as well as Government management of this project. Review minutes and materials and action identification shall be included in the Summary of Submittals.

3.6.3 Data Sources. Data sources shall be identified. Assumptions shall be clearly stated, adequately justified and provided with each required submittal.

4. GOVERNMENT FURNISHED PROPERTY AND SERVICES

4.1 Data Items Furnished by the Government

Government furnished information such as criteria, study information, and other assistance by CEHNC and MDA will be determined prior to exercising options for individual tasks. Some as-built drawings exist on some facilities. These as-built drawings will be provided to the A-E. The A-E shall check the items furnished for adequacy and accuracy prior to utilization.

5. CONTRACTOR FURNISHED PROPERTY OF SERVICES

5.1 Requirements for Contractor Data. In accordance with DFARS 252.227-7022, the Government shall have unlimited rights, in all drawings, designs, specifications, notes and other works developed in the performance of this contract, including the right to use same on any other Government design or construction without additional compensation to the Contractor.

5.2 Information technology (IT). The contractor shall assure that all systems be compatible and integrate with the Government’s IT systems.

5.3 Security considerations. The contractor shall demonstrate the ability to obtain secret security clearances as well as store and process classified material in accordance with Executive Order #12958.

5.4 Public Disclosures. The A-E shall make no public announcement or disclosure relative to information contained or developed under this contract, except as authorized in writing by the Contracting Officer.

6. PERFORMANCE MEASURES

6.1 Work Oversight Plan (WOP). The WOP for each task order will be agreed upon before award depending on the nature of services and or work required. The Government will monitor contractor performance under this contract using the method of surveillance specified in the

WOP.

6.2 Performance Evaluation. The applicable performance measures, as later refined in task orders, may include, but are not limited to: customer service, reporting, accuracy, and schedule.

The performance evaluation of the contractor will be based on performance metrics and established in the work task proposals. Evaluations will be performed on a task order basis.

Performance for each evaluation criteria will be scored as exceptional, satisfactory, marginal, or unsatisfactory in accordance with the performance plan. Evaluation will be based on criteria of schedule maintenance, cost control, and quality of technical performance and measured against objectives established in approved work task proposals.

6.3 Incentives. Positive incentives shall be provided in the form of a positive performance evaluation and a report of good performance in the Contractor Performance Assessment Reporting System (CPARS). Negative incentives shall be provided in the form of a negative performance evaluation, report of poor performance in CPARS, and/or Government determination not to award optional performance periods. This paragraph is not applicable to cost incentives.
