In reference to SOL #W912DY-11-R-0017: It states under 3.a Specialized Experience and Technical Confidence:
"Firms shall provide a maximum of five example projects performed by either the prime firm or a key subcontractor demonstrating recent experience. The agency will review only the maximum allowable projects in their order of submission; any projects thereafter will be disregarded. Relevant experience is defined as similar in size, scope and complexity to the services identified herein. Recent experience is experience within the last three (3) years from the date of this announcement. The offeror must address criteria separately. Sub criteria are as follows:....." Sub criteria 3.a.(1), (2) then listed are both just a long string of types of work, not "criteria". Unclear what is to be responded to in the project write-ups. On: 01-Nov-11.
Government Response. . Correct, they are not criteria, but rather subcriteria: (1) Specialized Experience in master planning and (2) Specialized Experiene in Force Modernization/Force Integration Studies/Unit Set Fielding Studies. Respondents should respond to these subcriteria. On: 10-Nov-11

In reference to SOL #W912DY-11-R-0017: "(c) Past Performance: Past performance of the prime firm and any key subcontractors (NEED to review subs PPIRS) on recent (i.e. completed within the past three (3) years from the release of this announcement) and relevant contracts as determined from Past Performance Information Retrieval System (PPIRS) and other sources. PPIRS will be queried for all prime firms to assess performance risk. The Government may elect to consider any credible information obtained from other sources in addition to those identified by the firm if adequate information is not available in PPIRS. In the event that adverse past performance information is obtained from other sources, the firm will have the opportunity to respond to any adverse information received which it had not had a previous opportunity to comment." Question: How will this be accomplished? On: 01-Nov-11.
Government Response. . Contractors are given an opportunity to comment on adverse performance evaluations in ACASS. They may also comment on adverse information during interviews and on their SF330 submissions. On: 18-Nov-11

the submission within the last three years from the date of this announcement. Does this mean that projects must be completed within the last 3 years or can they be ongoing within the last 3 years? On: 02-Nov-11.
Government Response. . Firms shall provide a maximum of 5 projects. This experience must be within the last 3yrs from the date of the announcement. This may or may not include completion in that window. The relevant issue is 'experience', which implies performance during the stated window. On:

With the 50 page limit for Part I of the proposal, assuming 1 page for A-C, D and G each, a minimum of 17 resumes, and 5 projects, that puts the page number at 25. The limit of 5 pages for Section H puts the page count at 30. Five pages is very restrictive for the amount of information requested we address in that portion of our proposal. Can the page limit on Section H be increased? On: 02-Nov-11.
Government Response. . The 5 page limit on Section H has proven sufficient on prior acquisitions, so that limit remains unchanged. On: 10-Nov-11

4259765 General Section F Section F
Are our 5 projects limited to 1 page per project or can they be 2 pages in length? On: 02-Nov-11.
Government Response. . The page limitation is not tied to the project. How each respondent takes advantage of the 5 pages afforded is at their discretion. On: 10-Nov-11

In 4.0 SECONDARY SELECTION CRITERIA, (a) Small Business Participation Plan: Is the required subcontracting plan included in the Section H page limitation? If yes, would the USACE allow this requirement to be placed in the Appendix (and not be included in the page count) to allow the extra space to be used for responding to the numerous selection criteria/technical requirements listed in the solicitation? On: 03-Nov-11.
Government Response. . The only item not included in the stated limits is JV paperwork, as applicable. Everything else must fit in the 50 page limit, as indicated. Likewise, Section H has a 5 page limit. Small Business Participation Plan information shall also fit within the 50 page limit. On: 10-Nov-11

Please clarify what is meant by "full potential value." Is this the uncommitted remaining value of the contract or the total potential contract value including not yet awarded option years and awarded and completed work? On: 03-Nov-11.
Government Response. . Section 3(d) of the notices requires respondents to "Identify the full potential value of any current Indefinite Delivery contracts that the firm has with the Government." By definition, options contribute to the total potential value of a contract. Although Section 4(d) explicitly excludes the consideration of options when looking at the Volume of DoD Contract Awards, Section 3(d) does not include this prohibition when evaluating Capacity. We are a large firm with an extensive Governmental portfolio of active contracts. Providing information about all of our government contracts will use up the majority of the 5 pages allotted to Section H. Will you consider allowing us to:
a.Submit an aggregate total amount of estimated contract value or b.Provide this list for DoD clients only or c.Add the list as an attachment excluded from Section H and the 50 page limit for SF330 Part I On: 03-Nov-11.
Government Response. . No. All required information must be included in the 50 page limit, with the exception of JV documentation. Allowing one respondent to include information in an attachment would provide an unfair advantage. All respondents must comply with the 50 page limit for Part 1 and the 5 page limit for Section H. The Small Business Participation Plan is required per DFAR 215.3 which supplements FAR Part 15 (Contracting by Negotiation). However, this solicitation is based on FAR 36.6. A review of DFAR 215.3 confirms that this requirement is applicable to FAR Part 15.3. Also there is a reference to "Best Value" Selection in the Small Business Participation Plan, which also is not appropriate for FAR 36 selections. Will the requirements for small business participation be defined in FAR 52.219-8 and 52.219-9 and not DFAR 215.3? On: 03-Nov-11.
Government Response. . Although FAR 36.6 does address A-E Services, it was never intended as a wholesale replacement for the other requirements of the regulation, as evidenced by the caveat included at FAR 36.101(a) which clearly states that "architect-engineer contracts are subject to the requirements in other parts of the regulation, which shall be followed when applicable." Although the general source selection principles included in FAR Subpart 15.3 and DFARS 215.3 apply, the specific selection approach in this acquisition will follow Brooks Act requirements. Nonetheless, to consider best value only within the Small Business Participation Plan secondary criteria is not only appropriate and allowable, it is also in the best interests of the respondents, the Governement and the taxpayer. Subcontracting Plan Submittal as required by FAR 52.219-9. a.It has been our experience on FAR 36.6 solicitation that Subcontracting Plans are submitted after firms are selected for negotiation. Will the Subcontracting Plan be required as part of the negotiation process and not part of the qualifications evaluation? b.If the Subcontracting Plan is required as part of this initial qualifications submission, will the Plan be an addendum to the qualifications package and therefore not be included in the 50-page limit? On: 03-Nov-11.
Government Response. . As stated in the notice "...large business offerors must also submit", so yes it is required an no it is not considered an addendum outside the 50 page limit. All required items must be included in the 50 page limit; the only exception is JV documentation. On: 16-Nov-11

Concerning Section 2.0 (c) (4) Scope a.Please confirm, in reference to FAR 16.505(a)(8)(ii) within Section 2.0 (c) (4) although Contractor personnel must be registered Architects or Engineers, such personnel will not be required to sign and seal drawings or plans as part of the supervision and inspection processes. Such action is not consistent with traditional practice within the scope of master planning and programming services. "In accordance with FAR 36.209, the A-E Contractor and its subcontractors, suppliers, and consultants selected for award will not be considered eligible for Department of Defense (DoD) construction contracts or any TO that relates to work awarded under the contract."
b.This restriction may prove to be overly broad and not clearly defined. Suggest using the language in 36.209, "No contract for a construction project shall be awarded to the firm that designed the project or its subsidiaries or affiliates."
Adding, "Further restrictions on contract and task order awards are governed by FAR 9.5 and DFAR 209.5." Please provide more clarity to the restriction as stated in the SOL. On: 03-Nov-11.
Government Response. . (a) The registered and licensed professionals required by this acquisition may be required to sign and seal items in connection with this procurement. (b) The language included in the notice is very clear in relation to the prohibition..."will not be considered eligible for (DoD) construction contracts or any TO that relates to work awarded under the contract." Government Response. . What is/is not included in a Letter of Commitment is up to the individual or firm preparing the letter. Note, as indicated in the notice, enforceable commitments are weighted more heavily than non-enforceable commitments. As stated in the notice "If a prime firm is using key subcontractors experience to qualify, the prime firm shall submit letters of commitment from those subcontractors and any key personnel." Reference Sect 1.0 , second paragraph, first sentence states that, "consultants selected for award will not be considered eligible for construction design-build contracts or any TO that relates to work awarded under this contract."
If planning documents prepared under this contract are a matter of public record, why is there considered a potential conflict? Is this applicable for just Huntsville managed follow-on design-build projects or ANY project regardless of what USACE agency manages the D-B project (e.g., USACE Savannah) On: 04-Nov-11.
Government Response. . The stated prohibition does not hinge on what office or agency manages the subsequent project, it hinges on whether the project relates to work awarded under this contract. This is a standard prohibition detailed in FAR 36.209. On: 16-Nov-11

Reference Section 4.0 (a) - Small Business Plan, item 2. How shall "enforceable vs un-enforceable commitments" to SB firms be determined and judged by the government? On: 04-Nov-11.
Government Response. . The terms of an agreement between a prime and a sub are as unique as the parties to the agreement. For this reason, it is difficult to quantify "enforceable". Some agreements may include penalties and damages to prevent non-compliance. Obviously, agreements that include these types of enducements would be considered more enforceable than agreements without such consequences. Likewise, agreements with clear and objective criteria and triggers tied to compliance with the agreement would by their very nature be considered more enforceable than agreements with widely ambiguous terms and open ended commitments. Enforceability of commitments is just one of five areas that Small Business Participation Plans will be evaluated on. On: 16-Nov-11

Please provide further information to explain what types of documents are expected. 3) In Section 3.0 PRIMARY SELECTION CRITERIA, (a), the FBO notice states, " . . . Are the Small Business Participation Plan and Small Business Subcontracting Plan excluded from the 50-page SF-330 page limit requirement? And, in which Section of the submission should these documents be included? Section H has a 5-page limitation. On: 05-Nov-11.
Government Response. . (1) The posting currently listed in FBO is labled as a "presolicitation".
Nonetheless, this is the ONLY solicitation that will be issued before the selection Board convenes and the anticipated MATOCs are subsequently awarded. IAW USACE Engineering Pamphlet 715-1-7, an individual project solicitation or Request for Price Proposal (RFPP) will be issued to offeror(s) when it is time to initiate a Task Order (TO) on a MATOC. 1) Under (a) Specialized Experience and Technical Competence, your solicitation states "If a prime firm is using key subcontractors experience to qualify, the prime firm shall submit letters of commitment from those subcontractors and any key personnel". Our team includes subcontractors for whom we will provide resumes, but whose scope will not reach the 10% level that you have defined for "key subcontractors." Nor will we be using their projects as one of our 5 allowed in Section F for specialized experience. As such, would you please confirm that no letters of commitment (for the firm or their professionals) would be required for these subcontractors? On: 07-Nov-11.
Government Response. . As indicated in the notice, a key subcontractor represents 10% or more of the prime contract. Section 3(b) clearly details the resume requirements included in the notice. Letters of Commitment and resumes are welcome but not required from subcontractors and subcontractor personnel considered non-key. Again, a subcontractor is considered key if they represent 10% or more of the contract. On: 16-Nov-11

2) We have found that our clients sometimes have differing expectations about the appropriate college degree emphasis (major) and registration required for a professional in the Environmental Engineer position. Please clarify what will be considered acceptable in your evaluation of this position. On: 07-Nov-11.
Government Response. . The term "acceptable" implies a pass/fail criteria. There is no such pass/fail education criteria included in the notice. Education is mentioned in Section 3(b) as only one item that will be considered. As there is no objective guideline that indicates which degrees/institutions are considered acceptable, no further detail is available. On: 16-Nov-11

Is the 75m listed mean that it is 15m per year totaling 75m? and will each firm have the 75m limit or will that total be divided between multiple firms? On: 08-Nov-11.
Government Response. . The exact distribution of total capacity per year, across the pool, will be determined at time of final selection based on the demographics of the successful offerors and the most current demand data available from the customer. This may equate to an equal distribution of $15M per year total, or it may not. No one firm will have a $75M limit as the Brooks Act requires the selection of no less than three firms. Government Response. . In the case of a JV, Block 15 should include both the firm name and the JV name, with clear indication as to which name represents the JV. RFP Section 4 (a) (5) states, "Separate from the Small Business Participation Plan, large business offerors must also submit a Subcontracting Plan (Individual Contract Plan) as required by FAR 52.219-9. Large businesses will not be eligible for award if they fail to submit an acceptable Subcontracting Plan." Further, FAR 52.219-9 (a) states, "This clause does not apply to small business concerns." As of 16 November 2011, industry has asked the Government a variety of questions seeking clarification of whether the subject Plan is included within the 50 page restriction for SF330, Part I submittals. The Government has confirmed that the Plan is included in the 50 page restriction. This offeror observes that, with the clarification that the requirement is only applicable to large business offerors (as outlined above), the Government's interpretation that the Plan is included in the page restriction provides small business offerors an unfair advantage by not imposing this same requirement, essentially allowing them to allocate page count to other Part I requirements. Will the Government consider removing the required Plan from the 50 page Part I restriction to avoid the potential for protests? On: 16-Nov-11.
Government Response. . The Government has removed the Subcontracting Plan requirement for large firms, in its entirety; this change will be posted in FBO.gov today. The Small Business Participation Plan is still required from all offerors and is included in the 50-page limit. On: 18-Nov-11
