Electronic Security System (ESS) V MATOC
1. Contracting Activity: United States Army Engineering and Support Center, Huntsville, Alabama (CEHNC).
2. Description of Action: The proposed modifications are to extend the ordering period for the Electronic Security System (ESS) V Multiple Award Task Order Contract (MATOC) by six months. Listed in the table below are the contracts to be extended. This modification will be using Other Than Full and Open Competition as identified in FAR 6.302-1(a)(2)(iii), Only One Responsible Source. The additional six months will provide the ability to continue ordering required services until the follow-on contracts are awarded.

The total capacity for this MATOC is $900 million. As of November 2015, $508,335.302.48 of capacity has been utilized leaving $391,664,697.52 of available capacity. Based on the burn rate over the past five years, the remaining capacity is adequate for this six month extension and an increase is not necessary.
3. Description of Supplies/Services: The U.S. Army Engineering and Support Center, Huntsville (CEHNC) maintains Centers of Expertise in both Intrusion Detection Systems (IDS) and Utility Monitoring and Control Systems (UMCS). As Centers of Expertise, CEHNC provides worldwide support to the Department of the Army, other Department of Defense (DoD) agencies, and non-DoD agencies in ESS, UMCS, and related systems in the procurement and installation of these systems. The purpose of the modifications is to provide an additional six months of world-wide technical support, procurement, installation, monitoring, maintenance and service for ESS, UMCS and related systems.
4. Authority Cited: Federal Acquisition Regulation (FAR) 6.302-l(a)(2)(iii); Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. Reason for Authority Cited: The ESS V contracts identified provide a uniquely qualified group of contractors that allow USACE to fulfill the ESS requirements of various DoD and non- DoD agencies without experiencing unacceptable delays in requirement execution. Over the five year ordering period of this MATOC, the contractors have demonstrated their unique skills, knowledge and qualifications to execute specialized ESS projects. These contractors are familiar and experienced in the USACE business processes, applicable Government regulations and technical criteria required for successful execution of ESS projects.
CEHNC is currently conducting a competition for a new $450 million MATOC with an estimated award date of August 2016. However this competitive award cannot be made within the timeframe needed for projected awards in January – July 2016.
This lapse in an ordering period would result in new requirements being awarded as stand-alone actions as opposed to task orders. This would result in increased administrative costs and longer lead times to competitively solicit new requirements open market and be in compliance with all regulatory requirements associated with new actions. As the current time frame would be leading into the 4th quarter it would not be possible to meet the schedule for all new requirements resulting in mission failure.
6. Efforts to Obtain Competition: The current MATOC consists of six small businesses and five large businesses that can perform these services. However, the time required to issue a solicitation/evaluation and award of a new contract can take up to 18 months, which will not meet the needs of the program and the new ESS VI will be in place by that time. Therefore, based on the current needs and the time required to award additional contracts, there is no additional benefit to the Government to compete for a new contract.
The Government will use the procedures in FAR 16.505(b) (1), Fair Opportunity, for each task order awarded under this contract to ensure adequate competition is obtained for each order.
7. Actions to Increase Competition: Market research will be conducted and updated for the long term competitive acquisition that is currently underway. The follow-on MATOC is being fully and openly competed. For maximum competition, the action will be publicly announced and selection made to the best value offerors. Large businesses will be required to provide a subcontracting plan and include subcontracting goals for small businesses.
8. Market Research: Extensive Market research was conducted for the new ESS VI MATOC identifying several contractors that are qualified and interested in supporting the ESS program.
However, based on the reasoning mentioned in section 5 above these sources cannot meet the Government’s need at this time. The program manager / Contracting Officer Representative was contacted and confirmed that the contractors on the current MATOC are qualified and have performed satisfactorily.
9. Interested Sources: No sources have indicated interest in this acquisition. No notice was posted in accordance with the exception in FAR 5.202(a) (11).
10. Other Facts:
a. Procurement history.
(1) Contract Numbers and dates of the last several awards: These services were previously procured on the ESS V MATOC mentioned above awarded January 2011 and the ESS IV MATOC (W912DY-05-D-0013 through W912DY-05-D-0021) awarded December 2005.
(2) Competitive Status of these actions: The previous contracts were awarded under full and open competition.
(3) Authority previously cited if less than full and open competition was used:

Based on the foregoing justification, I hereby approve the modification to extend the ESS V MATOC by six months on an other than full and open competition basis pursuant to the authority of FAR 6.302-1(a)(2)(iii) provided that the services and property herein described have otherwise been authorized for acquisition.
