SECTION M

52.212-2, EVALUATION FACTORS FOR AWARD

1. The Government intends to evaluate proposals and award a contract under FAR Part 12, Simplified Acquisition Procedures. The Government will award a contract resulting from this solicitation, which is advantageous to the Government, price and other factors considered. Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a price and technical standpoint. The following factors shall be used to evaluate the offers:

Factor I. Technical/Management Approach

Factor II. Past Performance Factor III. Cost/Price

The Offeror proposal shall be evaluated for Technical Acceptability and Reasonableness of Price. The term “technical,” as used herein, refers to the non-price elements listed below. The proposal will be rated as "Acceptable" or "Unacceptable" in regards to the ability to meet each element. (NOTE: The below Factors are evaluated but not separately rated). The minimum requirements of each element must be met in order for the technical factor to be considered acceptable, and for the proposal to be considered for award. Once the minimum requirements are established, the proposal shall be evaluated against these requirements using the ratings and descriptions outlined in Table C-1.

The following factors shall be used to evaluate offers:

Factor 1: Technical/Management Approach

Each offeror’s technical and management proposals shall be evaluated to determine if the offeror provides a sound, compliant approach that meets the requirements of the PWS, and demonstrates a thorough knowledge and understanding of those requirements. The technical proposal addresses each of the following subfactors in sufficient detail.

Rating Description

Acceptable Proposal meets the requirements of the solicitation.

Unacceptable Proposal does not meet the requirements of the Solicitation.

Table 1. Technical Acceptable/Unacceptable Rating Method

Factor 2: Past Performance

The Government will evaluate all relevant data from retrieval type systems.

The past performance assessment will assess the confidence in the offeror’s/joint venture member’s ability (which includes, if applicable, the extent of its critical subcontractors’ involvement) to successfully accomplish the proposed effort based on the offeror’s demonstrated present and past work record. The recency and relevancy of the information, the source of the information, context of the data and general trends in the contractor’s performance will be considered.

More recent and more relevant performance usually has a greater impact in the confidence assessment than less recent and less relevant performance. For purposes of this evaluation, recency is defined as active or completed efforts performed within the past three (3) years from the issuance date of this solicitation. The Government will perform an independent determination of relevancy of the data provided or obtained.

In assessing present and past performance, the Government will employ several approaches, including, but not limited to:

1. The Past Performance Team evaluation is not limited to review of the information provided in the offeror’s Present/Past Performance volume. Present/Past performance information shall be obtained from the Government’s Federal Awardee Performance and Integrity Information System (FAPIIS) and the Past Performance Information Retrieval System (PPIRS). The Government reserves the right to use performance information from other sources such as Defense Contract Management Agency (DCMA), Fee Determining Officials, or commercial sources. Data from previous source selections may be used if the data is recent and relevant.

If no past performance information is available, the offeror will be evaluated as neutral for this evaluation factor.

(a) Cost/Price Factor The offeror’s Cost/Price proposal will be evaluated for Reasonableness and Balance,

a. Reasonableness. Adequate price competition is expected to support the determination of reasonableness. Price analysis techniques may be utilized to further validate price reasonableness. The Government will evaluate pricing in accordance with FAR 13.106-3, and evaluate all aspects of the price proposal for fairness, reasonableness and unbalanced pricing. The Offeror shall submit a Firm Fixed Price (FFP) for this effort.

The Government reserves the right to award without discussions. The Government also reserves the right to make no award if a reasonable price cannot be obtained.

b. Options Periods. The Government will evaluate offers for award purposes by adding the total price for all optional periods to the total price for the base requirement (1 year).

The Government may determine that an offer is unacceptable if the Optional Periods prices are significantly unbalanced.

• NNOTE: Evaluation of Optional Periods shall not obligate the Government to exercise the option(s).

• Evaluation of Optional Periods will be conducted in accordance with FAR 52.217-8 and 52.217-9, Option to Extend the Term of the Contract. The Government will evaluate the Option to Extend Services by using half the proposed price for option year one.

NOTE: Contractors are required only to price the Base Period (1 year), and (4) 4 Year Option periods.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed

52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (MAY 2020)

(a) Definitions. As used in this clause--

Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.

Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (d) of this clause. Such a concern is ``not dominant in its field of operation'' when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.

(b) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, upon occurrence of any of the following:

(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.

(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.

(3) For long-term contracts--

(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and

(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.

(c) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, when the Contracting Officer explicitly requires it for an order issued under a multiple-award contract.

(d) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code(s) assigned to this contract. The small business size standard corresponding to this NAICS code(s) can be found at https://www.sba.gov/document/support--table-size-standards.

(e) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.

(f) Except as provided in paragraph (h) of this clause, the Contractor shall make the representation(s) required by paragraph (b) and (c) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause, or with its offer for an order (see paragraph (c) of this clause), that the data have been validated or updated, and provide the date of the validation or update.

(g) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (f) or (h) of this clause.

(h) If the Contractor does not have representations and certifications in SAM, or does not have a representation in SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:

[The Contractor shall enter the name or names of the WOSB concern eligible under the WOSB Program and other small businesses that are participating in the joint venture: .] Each WOSB concern eligible under the WOSB Program participating in the joint venture shall submit a separate signed copy of the WOSB representation.
