The following questions and answers are provided for information purposes only and will not be incorporated into the award.

1. Equipment Utilization

Can the Government confirm whether the estimated equipment hours listed for each CLIN are for bid evaluation purposes only, or whether they represent the anticipated equipment utilization during contract performance?

ANSWER: The represented CLIN equipment hours represent the Government’s best estimate of hours necessary to complete the work.

2. Multiple Equipment Operations

Will all listed equipment be expected to operate simultaneously, or will equipment be utilized as needed throughout the project based on construction sequencing?

ANSWER: It is anticipated equipment will be utilized, as needed, throughout the project. It is also anticipated that equipment will be ready to do the work when needed, without delay.

3. Mobilization/Demobilization

Does the Mobilization/Demobilization CLIN include all movement between work locations within the project limits, or will inter-site moves be compensated separately?

ANSWER: The CLIN breakdown represents the Government’s best understanding of the entirety of the work. No additional costs should be contemplated outside the CLINS for the proposed project. Therefore, Demob/Remob between sites must be incorporated into the existing CLINS and the work for that effort would best be represented by the Mobilization/Demobilization CLIN.

4. Dump Truck Operations

Can the Government provide the anticipated average haul distance and identify the anticipated borrow source(s), spoil disposal location(s), and/or material stockpile areas associated with the dump truck CLINs?

ANSWER: Material will be provided at staging areas in the immediate vicinity of the working area. Excavated material will be placed on the landward side of the levee at Site 1 as directed by the government. No excavated material will need to be hauled to a disposal site.

5. Material Responsibility

Will borrow material, clay, riprap, and other construction materials be Government-furnished, or is the Contractor responsible for procuring these materials?

ANSWER: All earthwork materials will be furnished by the Government.

6. Fuel

Is the Contractor responsible for furnishing all fuel and lubricants for the rented equipment throughout the duration of the project?

ANSWER: The Government will not have any means to provide fuel and/or lubricants. All efforts should be anticipated to be provided by the Contractor.

7. Work Schedule

What anticipated daily working hours and work week (5-day, 6-day, or 7-day) were used in developing the estimated regular and overtime hours?

ANSWER: The hours were developed based on a 6-day schedule (Mon-Sat)

8. Estimated Quantities

Can the Government provide estimated excavation quantities, clay keyway dimensions, resurfacing quantities, and anticipated riprap quantities?

ANSWER: All material quantities noted on plan set in the solicitation.

9. Site Access

Will all project access roads be prepared and maintained by the Government, or will the Contractor be responsible for access improvements?

ANSWER: The Government will not have any means to provide or maintain access roads. All efforts should be anticipated to be provided by the Contractor.

10. Standby Time

If weather, river conditions, or Government direction delays work, will standby time for equipment and operators be compensated under the hourly bid items?

ANSWER: Barring any extraordinary circumstances, equipment and operators will be compensated under hourly bid items for delays determined by the government representative.

Can we bid some of the equipment or do we have to bid on all of the equipment listed for our bid to be considered?

ANSWER: The intent is to make a single award to the quoter/bidder who provides all the requisite items/equipment. There is currently no intention to make multiple awards as a result of this solicitation.

Will the contract be awarded entirely to the lowest collective responsible, bitter (sic), or will it be awarded as it has typically been awarded before to the lowest bidder for each piece of equipment?

ANSWER: The intent is to make a single award to the quoter/bidder who provides all the requisite items/equipment. There is currently no intention to make multiple awards as a result of this solicitation.

Since these are being bid as firm fixed price, however, they are based on hourly estimates, in the event that the contractor is directed to use more hours will the firm fixed price be adjusted and if so, how will that be adjusted?

ANSWER: Any changes to the contract such as an increase in quantities will be at the direction of the Contracting Officer via a supplemental agreement pursuant to RFO 52.212-4. Any increase in quantities will be at the hourly rate accepted/stated in the original firm-fixed price award.

In the event that the contractor works fewer hours than the firm fixed price. Will the hours be adjusted or will the fixed price that has been entered be paid?

ANSWER: Payment will be made for actual hours worked at the hourly rate accepted/stated in the original firm-fixed price award.

Is there a reason that the ACE(sic) has gone away from the traditional method of hourly contracting and has switched this to a firm fixed price? It seems like it’s a recipe for disaster because once the contract is entered as firm fixed, it will require change orders to ultimately reconcile everything.

ANSWER: Seattle District USACE contracts for equipment rental are firm-fixed price. The quoted price is firm and fixed. The hours are estimated. Payment will be made for actual hours worked at the quoted hourly rate.

There is no way that we can provide a performance bond as there is no performance criteria in this contract. No bonding company will issue a performance Bond based on an hourly contract because it effectively puts them on the hook for an unknown dollar amount and scope of work. Can you eliminate the requirement for a payment and performance Bond? If not, can you revise this to only be a payment bond?

ANSWER: Pursuant to the Revolutionary FAR Overhaul (RFO) Part 28.102 Performance and payment bonds and alternative payment protections for construction contracts 40 U.S.C.

chapter 31, subchapter III, Bonds (formerly known as the Miller Act), requires performance and payment bonds for any construction contract exceeding $150,000.

On page 15, A bid Bond is required, why? Again, there is no contract with a performance criteria in it. A Bond must have a specified contract that it guarantees will be completed. The only thing that a bid Bond guarantees is that the contractor will execute the contract. Can this be eliminated?

ANSWER: Pursuant to the RFO Part 28.101 Bid guarantees, bid guarantees must be required whenever a performance bond or a performance and payment bond is required.
