If the Offeror is unable to obtain a completed PPQ from a client for a contract(s) before the proposal closing date, the Offeror shall complete and submit with the proposal the first page of the PPQ (Attachment B) which will provide contact and client information for the respective contract(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires.

The Offeror should explain problems encountered and actions taken for any submitted contract. If the client requests, questionnaires may be submitted directly to the Government's point of contact, McKenna Rain, via email, mckenna.t.rain@usace.army.mil, prior to proposal closing date. Offerors shall not incorporate by reference into its proposal PPQs previously submitted for other solicitations. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

c. The Information contained in the questionnaires will be used to evaluate the Offeror’s past performance. If any negative past performance information is received, the Offeror will be given an opportunity to provide a rebuttal if it has not already provided such a rebuttal. The Offeror is responsible for ensuring it submits a copy of past performance assessments (CPARS or PPQs) or notifies the Government and ensures that an assessment is already in CPARS. An Offeror that has no past performance ratings shall indicate such in its proposal, i.e., that it has no previous clients and that the questionnaires cannot be provided. It is the

Offeror’s responsibility to ensure the referenced documentation is provided, as the Government shall not be obligated to make an additional request for past performance from the references. The evaluation form shall be provided to the Government's point of contact, McKenna Rain, via email, mckenna.t.rain@usace.army.mil. Offerors are not to request past performance questionnaires on contracts that have final CPARS evaluation. If a past performance questionnaire is received on a contract where a final CPARS evaluation exists, the CPARS evaluation will serve as the official rating of record for evaluation purposes.

d. The Government may (but shall not be obligated to) contact references provided as part of Factor 1 – Experience, for information regarding the Offeror’s past performance on the contract, and for the purposes of assessing and verifying the scope of work performed. Offerors should provide accurate, current, and complete contact information for references provided in the contract descriptions.

e. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

f. Verification. The Government reserves the right to verify any of the past performance record of cited contracts or other recent and relevant contracts not submitted by the Offerors by reviewing Past Performance Information Retrieval System (PPIRS), or other Government appraisal systems, or by contacting owner or references. The Government may verify any or all cited references and supplied information. An Offeror will be afforded the opportunity to reply to or explain adverse past performance information which the Offeror has not previously had an opportunity to address.

5.1.2 Evaluation Criteria

a. Relevant Contracts (as defined in paragraph 4.1.2) will be evaluated to determine whether the Offeror will successfully perform the efforts required by the solicitation.

b. If any Offeror has multiple functions or divisions, the Government will only evaluate past performance of the division or unit submitting the proposal. Owners/references may be asked to comment on items such as quality of construction, timeliness, management of the work, subcontractor management, including timely payment to subcontractors or suppliers, small business participation, safety, relations between owner and contractor, level of support for such things as as-built documentation, Operations and Maintenance (O&M) manuals, training, correcting construction errors, warranty work, etc. The Government will target areas covered in the requirements of this proposal including records of conforming to quality, schedule, cost control, customer satisfaction, level of support for items such as, as-built documentation, O&M manuals, training, resolution of problems for construction errors, warranty work, and safety. The Government will not release the interview forms to the Offeror at any time, in order for the Government to solicit candid, unbiased interview comments.

c. In addition to the information provided above, the Government may obtain and evaluate additional past performance information from the Client on the submitted contracts, or other Relevant Contracts. The Government may contact and interview the Client (on a submitted contract) and reserves the right to interview other individuals acting for the listed owners or the owner’s representative, if the listed reference is not available. The Government may use personal knowledge or information from other sources in its evaluation of an Offeror’s past performance. In rating past performance, the Government may consider available past performance information that it discovers on predecessor companies. The Government’s evaluation is not limited to past performance information on the submitted example contracts. Offerors without a history of past performance will receive a rating of “Unknown”.

d. The Government may review any other sources of information for evaluating past performance to include official performance documentation on current contracts that have not achieved substantial completion. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming agreement, or parent company / subsidiary / affiliate) identified in the Offeror’s proposal; inquires of owners’ representative(s);

Responsibility/Qualification (R/Q) in SAM.gov and Integrity Information System (FAPIIS); Electronic Subcontract Reporting System (eSRS); and any other sources not provided by the Offeror.

e. Each Offeror will be rated on its own performance (or that of an affiliate, sister or predecessor entity in accordance with paragraph 4.1.1.d).

5.1.3 Basis of Evaluation. The Government will use the following as the basis of evaluation:

Note: In the case of an Offeror without a record of past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (See FAR 15.305(a)(2)(iv)). Therefore, the Offeror shall be determined to have an “neutral” past performance. In the context of acceptability / unacceptability, a neutral rating should be considered acceptable.

6.0 VOLUME II – GENERAL AND CONTRACT DOCUMENTATION (PRICE

PROPOSAL)

6.1.1 SUBMISSION INSTRUCTIONS

Volume II shall be clearly marked “VOLUME II – General and Contract Documentation (Price Proposal)” and include the following:

Factor 2, Past Performance

Adjectival Rating Definition

Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is Neutral (see note below).

Unacceptable Based on the Offeror’s performance record, the Government does not have a reasonable expectation that the Offeror will be able to successfully perform the required effort.

stated herein and that evidence of such will be provided after contract award.

e. A list of present commitments, including the dollar value thereof.

Include names and telephone numbers of personnel within the organization who are familiar with company’s performance. For a newly formed JV, each JV partner must submit a list of present commitments.

f. Bid Bonds

g. Organizational Conflicts of Interest (OCI) Disclosure. The Offeror shall provide a disclosure statement with its proposal that concisely describes all the relevant facts concerning any past or present OCIs relating to the Solicitation. If applicable, in the same statement, the Offeror shall provide information to assure the Government that the conflicts of interest have been mitigated and/or neutralized to the maximum extent possible. If a conflict of interest is discovered after award, the PCO will decide on whether or not to terminate the contract. If no conflicts of interest exist, the Offeror shall provide a statement stating no Conflicts of Interest exist.

6.1.2 FACTOR 3: PRICE EVALUATION CRITERIA (VOLUME

II, TAB 1)

Per FAR 15.404-1, price will not be rated or scored but will be evaluated for reasonableness through the use of price analysis. Proposals will be checked for the appearance of unbalanced line-item prices.

Price will be the determining factor for award after the determination of the technical acceptability of all offers. It is the Government’s intent to award to the Offeror who presents the lowest priced, technically acceptable proposal.

Supplemental Price Breakdown. If deemed necessary to evaluate elements of the price proposal, the Government will request a breakdown of elements of the Offeror’s price in Excel format. The Government will provide details on where and how to send the breakdown. This information may be required for the initial proposal, and if requested, for any revised proposals. This information is not an opportunity for an Offeror to revise its non-price or price proposal.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (iii)).

The body of each wage determination lists the classifications and wage rates that have been found to be prevailing for the type(s) of construction and geographic area covered by the wage determination.
