- Provide Unique Entity ID (as indicated in SAM), CAGE, and Tax Identification Number.

Offerors are required to be fully registered in SAM at the time a quote is submitted. Quotes from offerors who are not fully registered in SAM will not be evaluated and will not be eligible for award. There are no exceptions.

Evaluation Criteria:

FACTOR 1 – Price mailto:lindsey.t.gay@usace.army.mil

The offeror shall submit proposed pricing for the base period and each option period; this is applicable to all Contract Line Item Numbers.

Offerors shall enter the total price in each line item. Proposals shall be provided with only 2-digits after the decimal point. Prices provided shall be fully loaded, inclusive of all fees, overheads, G&A, insurance, profits, or any other markups. Failure to do so may be a cause for the proposal to not be considered for award. In the event there is a difference between a unit price and the total amount, the unit price will be held to be the intended proposal and the total of the CLIN will be recomputed accordingly.

FACTOR 2 – Technical

- Washington State Department of Agriculture (WSDA) Commercial Applicator License – Submission: In accordance with PWS Paragraph 1.6.8.2, the offeror shall submit documentation demonstrating that at least one employee, employed by the offeror, has a current and valid WSDA Commercial Applicator License. Upon contract award, the contractor must provide proof of license for all personnel engaged in the mixing, handling, and application of pesticides on

YTC.

FACTOR 3 – Past Performance for the Prime Contractor –

Offerors shall submit supporting documentation demonstrating a minimum of three (3) years of “relevant” performance history within seven (7) years preceding the issuance of this solicitation.

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES

(NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Award will be made in accordance with FAR Part 13 – Simplified Acquisition Procedures and using the Lowest Price Technically Acceptable (LPTA) source selection process.

Except communications conducted for the purpose of minor clarifications, the Government intends to evaluate offers and issue a Firm-Fixed-Price (FFP), Requirements contract, without discussions. Therefore, each initial offer should contain the offeror’s best terms from a technical and pricing standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the Contracting Officer to be necessary.

Evaluation Factors:

Factor 1: Price Factor 2: Technical Factor 3: Past Performance

Factor 1 – Price

Price will not be rated. Price analysis will be conducted to determine reasonableness.

Price will be evaluated using various price analysis techniques and procedures IAW FAR 13.106-2(b) including but not limited to, comparison of the proposed price received in response to the solicitation, comparison to the Independent Government Estimate (IGE), and Market Research.

Factor 2 – Technical

- Washington State Department of Agriculture (WSDA) Commercial Applicator License –

Evaluation: This factor is met when the offeror provides documentation demonstrating that at least one employee, employed by the offeror, has a current and valid WSDA commercial Applicator License in accordance with PWS Paragraph 1.6.8.2.

ADJECTIVE DEFINITION

Acceptable Offeror provides a current and valid copy of at least one employee’s WSDA

Commercial Applicator License.

Unacceptable Offeror does not provide a current and valid copy of at least one employee’s

WSDA Commercial Applicator License.

Factor 3 – Past Performance

Offerors shall provide supporting documentation demonstrating they have a minimum of three

(3) years of “relevant” experience within seven (7) years preceding the issuance of this solicitation.

“Relevant” experience is defined as performance of efforts involving requirements that are similar or greater in: Scope (types of services identified and defined in the PWS requirements within the Columbia River Basin specifically) and Magnitude of Effort (a contract or aggregated contracts during the 7-year time period totaling at least $50,000). At a minimum, the offeror shall provide the following information for each contract that it relies upon to demonstrate acceptable past performance:

a) Project title and customer name;

b) Contract number (if such a designation exists);

c) A narrative explaining the requirement and how it is relevant to the requirements of this solicitation;

d) Contract performance

Evaluation of Past Performance will be on an “Acceptable” / “Unacceptable” basis. The following definitions will be used in evaluating the degree the offeror will satisfactorily provide the required services based on past and current performance records. An Acceptable or Unacceptable rating will be determined as follows:

ADJECTIVE DEFINITION

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below)

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

*Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

In order to be considered for award, the Offeror must receive a fair and reasonable price determination for Factor 1 and “acceptable” ratings for Factors 2 and 3.

Factor 1 Price – Price is determined to be fair and reasonable Factor 2 Technical – Acceptable Factor 3 Past Performance – Acceptable

Award will be made based on the lowest priced quote with “acceptable” ratings for Factors 2 and 3.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.

(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial products or commercial services, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.
