INSTRUCTIONS TO OFFERORS

1. The solicitation is “100% small business set-aside”. All work shall be in accordance with the Scope of Work (SOW), attachments, and all other terms and conditions herein.

2. Quotes shall be submitted per the following:

Faxed quotations will NOT be accepted.

Quotes must set forth full, accurate and complete information, as required by this RFQ.

3. PROSPECTIVE OFFERORS: Contractors shall be registered in the System for Awards Management (SAM) prior to award of a contract or agreement resulting from solicitations.

“Registered in the System for Award Management (SAM) database” means that –

(1) The Offeror has entered all mandatory information, including the unique entity identifier and the EFT indicator, if applicable, the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14), into the SAM database;

(2) The offeror has completed the Core, Assertions, and Representations and Certification, and Points of contact sections of the registration in the SAM database;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The Offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process.

(4) The Government has marked the record “Active”.

This rule more efficiently implements the Debt Collection Improvement Act of 1996, as it requires contractors to be registered in SAM for consideration of future solicitations, awards, and payment. Registration is required prior to award of any contract, basic agreement, basic ordering agreement, or blanket purchase agreement from a solicitation. LACK OF REGISTRATION IN THE SAM DATABASE WILL MAKE AN OFFER INELIGIBLE FOR AWARD. The web site may be accessed at www.sam.gov.

SAM Priority Processing Request: The notarized letter must have both the vendor signature page AND the notary signature page signed. If missing a signature (or other required data) GSA will reject the letter. This will cause the review and activation of the account will be delayed further. Any prioritization requests received on Friday are subject to delays because of the weekend. For a request you send on Friday afternoon, you may not receive your response until Monday morning.

4. ELECTRONIC FUNDS TRANSFER (EFT): Effective 99 Jun 01, the Government will make all payments by

ANNOUNCEMENT TO OFFERORS

Due to recent national events Seattle District US Army Corps of Engineers shall be conducting business under heightened security for the foreseeable future.

Access to Federal Center South, 4735 E Marginal Way S, Building 1202, Seattle, WA 98124 will be through the front lobby only. The building is under Federal Protective Service, which means that persons entering the facility are subject to inspection; including purses, packages, etc. All deliveries shall be thoroughly inspected. In addition, visitors may be required to be escorted by Corps personnel while in the building.

SITE VISIT INFORMATION

THIS PROCUREMENT IS:

Small Business Set-Aside, 100% Total Small Business.

SITE VISIT

The purpose of the site visit is to familiarize Offerors with the scope of work and provide an opportunity to become familiar with the existing site conditions. It is the intent of the Government that all prospective Offerors visit the jobsite for the purpose of acquainting themselves with local conditions. All questions shall be submitted no later than January 15, 2021, 12:30 p.m. local time. Attendance at the site visit is strongly recommended.

An organized site visit has been scheduled as follows:

January 12, 2021 at 11:00 a.m., local time (Pacific Standard Time)

Albeni Cove Campground:

From Highway 2 in Newport, Washington, turn south onto Highway 41. Follow for .5 miles and turn east on Fourth Street into Oldtown, Idaho. Follow for approximately 3 miles to the campground.

Site visit participants shall proceed to the Albeni Cove Campground, we will meet at the delivery location, we will be unable to go to the project site, due to COVID requirements and social distancing.

Requests for attendance received after close of business on 11 January 2021 will not be accepted. Due to security requirements and limited field staff available for site visits, only one site visits will be offered. Individual requests for site visits will not be granted. Offerors should visit the site and take such other steps as may be reasonably necessary to ascertain the nature and location of the work, and the general and local conditions which can affect the work or the cost thereof. Failure to do so shall not relieve Offerors from the responsibility of estimating properly the cost of successfully performing the work. Hardhats, hard toed boots, and safety reflective vests are required. Cameras will not be allowed. However, the Government will bring a camera and take pictures as requested, to be reviewed and approved by the security officer prior to release. SCOPE OF WORK

Strong Island

(Equipment w/ Operator) Oldtown, ID

LOCATION:

The project is located at Strong Island, Oldtown, ID near the Albeni Cove Campground. (See attached drawings.)

WORK TO BE DONE:

The goal of the construction work will be to protect the shoreline from erosion to prevent the disturbance of the shoreline. The site is approximately 1000 feet long by 20 feet wide. 2”x4” quarry spalls will be placed on the entire length of the project over the existing embankment, then Class III riprap. The site will be top dressed with topsoil, mulch and planted for the finished product. All work on the embankment will be done from the water side off barges. Material will be moved via barge approximately 1.25 miles from the stockpile to the worksite. See attach drawings for stockpile and work site locations. All work will be completed from the barge no heavy equipment can be placed on the shore.

EQUIPMENT REQUIRED:

The following equipment is needed to construct the revetment.

CE-1: Track Mounted Hydraulic Excavator w/ Hydraulic Thumb (Minimum 35 foot reach w/ barge as a work platform for the excavator and spuds.)

Mobilization/Demobilization Base: 160 Hours of Regular Time and 80 Hours of Overtime Option: 80 Hours of Regular Time and 40 Hours of Overtime

CE-2: Tug or Similar w/ (2) Barges Any equipment capable of moving loaded barges or method similar of executing the same work in the same time allotted. Barges must be capable of hauling a minimum of 100 tons of up to Class III Riprap. Barges will either have spuds or contractor may drive piles at the loading site to tie barges off to. The piles will be removed after work is complete. (NOTE: If piles are the preferred method this cost will be covered in the mobilization costs.)

CE-3: Track Mounted Hydraulic Excavator w/ Hydraulic Thumb (Similar to 300 series / Minimum 200 hp / Minimum 70,000 lbs / Minimum 35 foot reach) This piece of equipment will be used to load the material barges.

PERIOD OF PERFORMANCE:

It is anticipated work shall commence on or about July 15, 2021 and shall end on or before September 15, 2021.

Once work has commenced work will continue until work is complete. Anticipated schedule would be to work 6 – 10 hour days.

SECURITY:

All contractor and all associated sub‐contractors’ employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.

SAFETY REQUIREMENTS:

Operation of equipment shall be conducted in accordance with the requirements of EM 385-1-1, “Safety and Health Requirements Manual”. All personnel are required to have PPE in accordance with EM 385 1-1. EM 385 1-1 can be found at https://www.usace.army.mil/Missions/Safety-and-Occupational-Health/Safety-and-Health-Requirements- Manual/. Contractor will have and provide appropriate spill kits for all vessels and barges.

MOBILIZATION AND DEMOBILIZATION:

Payment will be made at the purchase order lump sum price for (items including) mobilization and demobilization.

Payment shall constitute full compensation for assembling equipment at site preparatory to starting work and for removing it there from at completion of the work under direction of the Contracting Officer.

INSPECTION AND SUPERVISION:

All work shall be conducted in coordination with Emergency Management Branch, Seattle District, Corps of Engineers.

WORK WEEK:

For the purpose of calculating payrolls, the work week is based on seven (7) consecutive days, beginning at 0001 hours Monday and ending 2400 hours Sunday. This work week shall remain fixed throughout the performance period of this contract.

52.204-8 ANNUAL REPRESENTATIONS AND CERTIFICATIONS (MAR 2020)

(a)(1) The North American Industry Classification System (NAICS) code for this acquisition is 238910.

(2) The small business size standard is $16,500,000.

(3) The small business size standard for a concern which submits an offer in its own name, other than on a construction or service contract, but which proposes to furnish a product which it did not itself manufacture, is 500 employees.

(b)(1) If the provision at 52.204-7, System for Award Management, is included in this solicitation, paragraph (d) of this provision applies.

(2) If the provision at 52.204-7, System for Award Management, is not included in this solicitation, and the Offeror has an active registration in the System for Award Management (SAM), the Offeror may choose to use paragraph (d) of this provision instead of completing the corresponding individual representations and certifications in the solicitation. The Offeror shall indicate which option applies by checking one of the following boxes:

52.204-17 OWNERSHIP OR CONTROL OF OFFEROR (AUG 2020)

(a) Definitions. As used in this provision--

Commercial and Government Entity (CAGE) code means—

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity by unique location; or

(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as a NATO CAGE (NCAGE) code.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
