A proposal missing resumes for either team member or where one or both team members are lacking specified qualifications will receive an Unacceptable rating.

FACTOR C: PAST PERFORMANCE OF THE PRIME CONTRACTOR:

Submittal for Evaluation: Demonstration of past performance of the Prime Contractor will be evaluated using Contractor Performance Assessment Reporting System (CPARS) database critiques accessed through the Past Performance Information Retrieval System (PPIRS). There may be consideration of any performance ratings from the past five (5) years. The Government reserves the right to contact evaluators on previous work to verify construction experience of the prime contractor.

Customer Satisfaction Surveys: If an offeror does not have past performance available in CPARS or PPIRS, or wishes to augment the available system ratings, the offerors may ask customers to submit the Customer Satisfaction Survey found at the end of this section.

Instructions concerning the surveys are as follows:

(i) Provide a completed customer satisfaction survey for each project constructed for public or private industry within the last 5 years, for which an offeror has requested submission of a survey.

(ii) All customer Satisfaction Surveys must be submitted to the Government from the customer or agency that is providing the information. See further instructions at the top of the Customer Satisfaction Survey.

(iii) Only include surveys of relevant projects. A relevant project is one of the same scope, cost and complexity as this solicitation project.

(iv) There will be no consideration of surveys submitted directly by the offeror.

(v) Please do not submit past performance information for other members of the team, only the prime contractor will be evaluated for past performance.

(vi) As a maximum, no more than five (5) customer satisfaction surveys will be considered for the prime firm (i.e., the firm signing the Standard Form 1442, Solicitation, Offer and Award) for work not listed (i.e., civilian projects) in the Government CPARS system. If there are more than five submitted surveys, only the five deemed to be most relevant will be utilized in the evaluation.

Ratings Method: The method of rating Factor C shall be as follows:

Acceptable: The overall level of customer satisfaction on submitted Contractor Past Performance Customer Satisfaction Surveys is acceptable and/or all ratings concerning past performance on CPARS evaluations is satisfactory or above, and based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown (See note below).

Unacceptable: An unsatisfactory Contractor Past Performance Customer Satisfaction

Survey is unacceptable and/or unsatisfactory past performance on CPARS evaluations will be determined to be unacceptable. Unacceptable past performance will indicate to the Government that there is no reasonable expectation the offeror will be able to successfully perform the required effort.

NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

Evaluation Summary: The scoring of each proposal shall be in accordance with this section.

The Government’s evaluators will assign an “acceptable” or “unacceptable” rating based on the Offeror’s proposal and its response to the requirements for each Factor.

FACTOR D: Price

Price is equally important to the technical evaluation; its evaluation is independent of the evaluation of technical criteria. A review of price will be for reasonableness, as well as the Offeror’s financial capacity and ability to obtain bonding. Price will be the determining factor for award after the determination of the technical acceptability of all offers. It is the Government’s intent to award to the Offeror who presents the lowest priced, technically acceptable proposal.

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO REFLECT EVALUATION OF THE

CONTRACTOR’S PERFORMANCE

Rating Definition Note

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract.

There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.

(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

(N) Not Applicable No information or did not apply to the contract

Rating will be neither positive nor negative.
