LIMITED SOURCE JUSTIFICATION PURSUANT TO FAR 13.106-1

1. Contracting Activity: US Army Corps of Engineers (USACE), Seattle District, 4735 East Marginal Way South, Seattle WA 98134.

2. Description of Action: Approval is requested for limited source justification to a certified International service dealer within the Pacific Northwest, to modify and retrofit a USACE owned 2018 International truck/tractor (bobtail), model SBA 6x4, serial number HX620, vehicle identification number (VIN) 3HSDTAPT8JN347185, into a dual use dump truck with plowing capabilities for Chief Joseph Dam (CJD) in Bridgeport, WA.

The modification and retrofit involves shortening the total length of the truck, adding bed and front hydraulics, an 8 10 yard dump body, plow mounts and plow, removing the secondary fuel tank and remove permanent fixed axel, relocate batteries and regeneration, install plow and dump controls in the cabin of the truck and reprogram the central processing unit (CPU). The total estimated cost of this contract is .

3. Authority Cited: FAR 13.106-1(b) Soliciting from a single source. (i) For purchases not exceeding the simplified acquisition threshold.

4. Reason for Authority Cited: Pursuant to FAR 13.106-solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name or industrial mobilization.)

The modifications needed for the retrofit requires the servicing contractor to be an authorized International service dealer, to ensure performance and compatibility, preserve service life, reduce life-cycle cost and increase mission capabilities. The truck/tractor is currently configured with International proprietary instrumentation and control systems. Without significant data and knowledge inherent in the role of the design authority/Original Equipment Manufacturer (OEM), such as the CPU interface with control systems, the specification will lack the detail required to ensure proper configuration of the retrofit. The dump bed and plow accessories are critical for the safe operation of the truck during underway operations.

5. Basis for Restricting Competition: Using an International authorized dealer/repair facility to not only modify the chassis and provide International genuine parts for the retrofit but to ALSO install them provides the best value to the Government due to the warranty that would be inherent to the work performed. FAR 46.709 contracting officer should take advantage of commercial warranties, including extended warranties, where

A non-International dealer would not be able to provide the needed commercial warranties on the parts. Outfitting the truck/tractor with anything other than OEM equipment and components would require extensive modification of the existing truck/tractor bobtail, control systems, and instrumentation systems for proper fitment and operation.

A modification and retrofit of a USACE-owned International truck/tractor into a dump truck, with plowing capabilities, will replace the existing 20-year-old truck on CJD, which is deteriorated and exceeds the maintenance expenditure limit (MEL). CJD experiences high averages of snow in fall and winter seasons, and snow removal by Government employees is found to be most cost-effective means of ensuring safe driving conditions for USACE employees and the public.

fectively remove snow on USACE fee-owned property and therefore needs the modified truck prior to the upcoming snow season. The current truck is underweight, under powered, and runs the plow off electronics instead of hydraulics. General Maintenance calculated approximately 200 hours of lost labor and time per season due to the current truck frequently being down for safety, an estimated $18,000 worth of repairs over 5 years. Last year snow removal was done by hand and small tractors, at 5 times the labor cost and time. From 1999 to 2018 this vehicle was the primary means of snow removal, with seasonal use exceeding 50 hours per week during heavy snow years.

6. Market Research: Initially working with the General Services Administration (GSA), a list of capable, qualified vendors in the Pacific Northwest were identified. There were three (3) vendors identified that are authorized International service dealers.;. One company does the type of modifications needed for the retrofit, but could not start work until late January/February of 2020. Two (2) out of the three (3) companies were identified as being able to complete the retrofit within the needed timeframe.

Additionally, an extensive Google and System for Award Management (SAM) search was conducted by the contracting office and compared the results with the International authorized dealers list to identify any additional authorized service dealers within a reasonable distance to CJD, not to exceed (NTE) 250 miles as the contractor would have to drive to CJD to pick up the truck and deliver back to CJD after the retrofit work was completed. There was a result of four

(4) businesses, two of which were already found earlier. Calls were placed to all 4 and out of the 4, one was identified as being able to do the work and complete the work within the needed timeframe. There are at least three (3) companies who are authorized International dealers who are able to provide the work within the timeframe needed.
