Section C - Descriptions and Specifications

STATEMENT OF WORK

SECURITY GATE INSTALL AT HOWARD A HANSON DAM (HAHD)

1. DESCRIPTION OF WORK: Provide all plant, labor, tools, equipment, and materials and perform all work in strict accordance with this Statement of Work, all Federal, State and local codes and regulations and all applicable industry standards to:

Construct a Security Gate at Howard A Hanson Dam, located in Ravensdale WA that meets current federal security requirements for a K4 Crash Rated Gate.

The word “PROVIDE” shall be defined as DESIGN, FURNISH, INSTALL, TEST and MAKE READY FOR USE.

2. GENERAL REQUIRMENTS FOR ALL WORK:

2.1. Physical security features will comply with AR 190-13 (31 May 1991) and DOD 5200.8R.

2.2. One year warranty against any product malfunctions and defects in material or workmanship that affects the performance of the product.

2.3. Contractor is responsible for performing a utility locate prior to start of work.

2.4. Work site must be restored to original condition prior to end of the project.

2.5. The K4 crash rated system shall not affect the performance of the drainage ditch that runs along the Lower Portal Road.

3. PRINCIPAL ITEMS TO BE ACCOMPLISHED ARE:

3.1. Base Bid Item 0001 - Install a Crash Rated Barrier System on the Lower Portal Road at HAHD:

General items of work to be accomplished in Item 0001

3.1.1. The contractor shall construct a K4 crash rated barrier system on the Lower Portal Road at HAHD at the location identified in Image 1. The barrier system must utilize a manual, K4 crash rated, horizontal swing style gate that can accommodate, at a minimum, a 20ft opening. The gate must be operable by the force of one individual. The barrier system must be constructed in such a manner that no motorized vehicles, the size of an ATV (4 foot width) or larger, can bypass on either side of the gate. The contractor can disallow bypass on either side of the gate by utilizing K4 crash rated bollards, a larger gate, or a combination of the two. The Lower Portal road is typically 20 feet wide with 8 foot shoulders on either side. The final location of the gate must be approved by the Project Manager. Contractor must ensure that use of the Lower Portal road is available to HAHD staff during the entirety of this project. The new gate shall be installed according to the manufacturer’s recommendations and in accordance with AR 190-13.

4. SPECIFICATIONS: The following guide specifications are pertinent to this project.

6. PRE-BID SITE VISIT

6.1. A pre-bid site visit has been scheduled(See FAR clause 52.236-27 Alt I in solicitation). All bidders must contact the Project Manager or the Contracting Officer 24 hours prior to the site visit so that their name can be added to the visitor list. All parties will initially meet at the security gate near the Green River Filtration Facility (36932 Green River Headworks Rd, Ravensdale, WA 98051).

7. CONDITIONS AFFECTING CONSTRUCTION

7.1. Work Coordination:

7.1.1. The Contractor shall attend a pre-construction meeting prior to commencing construction activities. The Contractor shall contact the Project Manager within five (5) days of issuance of the Notice to Proceed to establish a date and time for the pre-construction meeting. The Contractor shall submit a proposed site-specific construction schedule and a proposed site-specific work plan at the meeting for approval unless such items have been previously approved by the Government. The schedule shall be in sufficient detail to identify all aspects of the work including any special circumstances or conditions. The schedule shall show project tasks with durations and start and finish times. During construction, biweekly coordination meetings are required. The Contractor’s Superintendent shall schedule the biweekly coordination meeting with the Construction Representative and Operating Project Manager.

The Contractor will keep minutes of all meetings, and will provide copies of such minutes to the Government within 2 days following the meeting.

7.2. Interface with Others:

7.2.1. Government use of these facilities is anticipated while the work under this contract is being performed. The work shall be planned and accomplished so that there will be a minimum of interference and inconvenience to the users of the facility. Blockage of any roadways is not allowed. The Contractor is responsible for daily cleanup of all work areas.

7.3. Construction Restrictions:

7.3.1. Working Hours: The Contractor is required to work within the hours of 0730-1600, Monday through Friday. Any requests to work outside of these hours require a seven (7) working days written notification to the QAR/Project Manager and the Operations Project Manager. No work will be performed during Federal Holidays.

7.3.2. Laws, Rules, Regulations and Compliance: All Contractor and subcontractor employees shall observe and comply with all applicable local, State and Federal laws, rules and regulations, including those concerning fire, safety, sanitation, security, vehicle operation, and hazardous material handling while performing this contract. All construction shall meet or exceed applicable industry standards related to materials and workmanship. The Contractor shall be responsible for obtaining any permits, approvals or licenses required to perform the work.

7.3.3. Safety Requirements: The current edition of the U.S. Army Corps of Engineers Safety and Health Manual, EM 385-1-1 (30 Nov 2014), shall be considered a part of this contract and will be enforced as such. The most recent Safety Manual can be found here:

7.3.4. The OPM, PM, and Construction Representative shall be notified immediately of any deviations or variations from the applicable Specification or Reference Drawings or this Statement of Work.

7.4. Security:

7.4.1. The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of the training.

7.4.2. All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance or access privileges, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas.

7.4.3. The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award.

8. CONSTRUCTION FACILITIES:

8.1. The Government shall make available to the Contractor, from existing outlets and supplies, reasonable amounts of potable water without charge. The contractor shall reasonably conserve potable water furnished. The Contractor at their own expense shall install and maintain necessary temporary connections and distribution lines and shall remove the connections and lines prior to final acceptance of construction.

8.2. Subject to available supply, reasonable amounts of electric current shall be made available by the Government, without charge, to the contractor for performing work at work area. The contractor shall carefully conserve electricity furnished.

8.3. The Contractor shall provide portable toilet facilities for the use of personnel on site.

8.4. If requested by the Contractor, a staging area may be provided for the Contractor if available as directed by the Contracting Officer’s Representative (COR) or a HAHD authorized representative.

8.5. In addition to the requirements of any other contract clauses, the Contractor shall protect all Government property within the work area, and shall be responsible for any damage to Government property caused by Contractor or subcontractor personnel during the performance of this contract.

9. SUBMITTALS:

9.1. The following submittals will be kept on the job site; if a job trailer is not available they will be kept on site in the superintendent’s vehicle: Accident Prevention Plan, and the Quality Control Plan. The Accident Prevention at a minimum shall contain the following documentation: equipment safety checklists (initial & dailies), required training records, Activity Hazard Analyses, safety meetings, crane inspections & crane operator qualifications (if required), and the qualifications of the SSHO.

9.2. All items listed below are required per the contract specification shall be submitted for review or approval as indicated. Any proposal deviations to the design shall be submitted for approval prior to installation. ENG Form 4025 shall accompany all submittals.

9.3. All submittals, must be sent to the COR, and the PM of this project via email.

10. CONTRACT COMPLETION REQUIREMENTS: The Contractor shall provide the items indicated below to the KO, COR, and the PM prior to contract completion:

10.1. Warranty: In addition to the standard one year warranty, the Contractor shall pass all manufacturers’ extended warranties to the Government.

11. PERFORMANCE PERIOD:

11.1. The Contractor is required to commence work under this contract within ten (10) calendar days after the date of issuance of the Notice to Proceed (NTP) for the Base Item(s), prosecute the work diligently, and complete all work on all Base Item(s) no later than 90 calendar days after the date of issuance of the Notice to Proceed for the Base Item(s). The time stated for completion includes final cleanup of the premises and submission of all required close-out documentation.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

52.203-18 PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN INTERNAL

CONFIDENTIALITY AGREEMENTS OR STATEMENTS--REPRESENTATION (JAN 2017)

(a) Definition. As used in this provision-- Internal confidentiality agreement or statement, subcontract, and subcontractor, are defined in the clause at 52.203- 19, Prohibition on Requiring Certain Internal Confidentiality Agreements or Statements.

(b) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235) and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions), Government agencies are not permitted to use funds appropriated (or otherwise made available) for contracts with an entity that requires employees or subcontractors of such entity seeking to report waste, fraud, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.

(c) The prohibition in paragraph (b) of this provision does not contravene requirements applicable to Standard Form 312, (Classified Information Nondisclosure Agreement), Form 4414 (Sensitive Compartmented Information Nondisclosure Agreement), or any other form issued by a Federal department or agency governing the nondisclosure of classified information.

(d) Representation. By submission of its offer, the Offeror represents that it will not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).
