SOLE SOURCE ANNOUNCEMENT

1. Introduction

The USACE Seattle District intends to award a sole source contract to Biomark Inc..

2. Description of Services

The Locks are located in the City of Seattle along the Lake Washington Ship Canal. The facility forms a boundary between the fresh waters of Lake Washington and the salt water of Puget Sound. The existing smolt flumes are currently used to convey smolt (young salmon) over the dam spillway to Shilshole Bay and Puget Sound. The Government has employed PIT tag technology at the Locks since 2000 at the facility fish ladder and existing smolt flumes. The existing PIT tag equipment for the flumes is failing and in need of replacement.

This is a new contract requirement for a firm-fixed price contract to acquire non-personnel services to fabricate smolt flumes w/ Passive Integrated Transponder (PIT) tag detection equipment for the Hiram M. Chittenden Locks (Locks) to replace existing aged and failing equipment. The work will include final design and fabrication of (1) prototype replacement smolt flume with integrated PIT tag detection equipment with an optional task to fabricate (1) additional duplicate smolt flume depending on the results of flume testing. The Contractor shall provide all services, labor, materials, supplies, and equipment necessary to conduct the tasks as defined in the Performance Work Statement (PWS).

The NAICS code is 334220.

3. Authority

41 U.S.C. 1903 and FAR 13.106-1(b)

4. Reasons for Sole Source

Pursuant to FAR 13.106-1(b)(1)(i) “Contracting Officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name or industrial mobilization.)”

Pursuing a different technology for monitoring activities is not practical given the historical and on-going investment both by the regional stakeholders and by the Corps at the Locks. If a different type of radio frequency identification (RFID) technology were deployed, it may not be compatible with the tags used by the partners and may not be compatible with the existing Locks PIT tag equipment. Purchasing the equipment and services from Biomark is necessary to ensure integration and compatibility with the existing PIT tag monitoring system at the Locks and ensure sensible and efficient maintenance of the broader PIT tag monitoring system at the Locks.

5. A solicitation package will be issued. This Notice of Intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 2:00 PM Pacific Time on 25 February 2016. Inquiries will only be accepted via email to Vincent.e.daniels@usace.army.mil. No telephone requests will be honored.

A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
