AMENDMENT 00001

Questions and Answers:

The following questions and answers are provided for information only. Nothing contained below amends or revises any provision of the solicitation.

This is for bidder’s reference only, and is not to be considered as a part of the Contract Documents.

Contract award will be based on what is contained in the printed Plans and Specifications in a hard copy format or Electronic Bid Set if provided and as posted on SAM.Gov.

Q1. Please provide the Water Quality Certificate that applies to this contract and any/all other permits applicable to this scope of work.

The specifications refer to section 00 90 02 as containing the WQC, however it is not provided.

A1. Attached please find the New York State Department of Environmental Conservation (NYSDEC) Water Quality Certificate for the maintenance dredging of the Buttermilk Channel, NY Federal Navigation Project.

Q2. Could the Government please confirm that the BEC Utility cable passes through the Buttermilk Channel dredge area? If so, please provide as-built drawings of the utility cable with its location and corresponding depth.

A2. It is confirmed that the BEC utility cables pass through the Buttermilk Channel dredging area. As-built drawings of the utility cables are attached to this amendment. However, the contractor is also responsible for coordinating with the utility owner(s) to obtain BEC Utility Location Maps with Coordinates. Prior to the preconstruction conference, the BEC Utility Location Maps with Coordinates shall be submitted to the Contracting Officer. A possible contact for coordination with the utility owner(s) is Shawn Picard, Vice President of Engineering at TigerGenCo (shawn.picard@tigergenco.com; (207) 731-4252).

Q3. Will a “no spud/dredging” zone be enacted near the BEC utility cable?

A3. A “no spud/no anchoring zone” is now indicated on the revised drawing (Sheet 3 of 4, AM 0001) attached to this amendment. There is no “no dredging zone”.

By this amendment, the following revisions are made to the Technical Specifications:

- Section 01 30 00 – Administrative Requirements, Paragraph 1.2 – Submittals, under SD-01 Pre-Construction Submittals, G, the following is added: “BEC Utility Location Map And Coordinates; G The contractor shall submit the BEC Utility Locations Map with Coordinates obtained from the coordination with the utility owner(s).”

- Section 01 30 00 – Administrative Requirements, Paragraph 1.8 – Physical

Conditions, under b. Utility Crossings, the following is added:

“NAN-2008-01564-M3 Permit Description: 7 JUL 2011: Permit to install approximately 6.5 miles of three parallel 345 KV alternating current submarine electric beneath the waters of Kill Van Kull, Upper NY Bay and Gowanus Bay;

between the cities of Bayonne, Hudson County, NJ and the Con Edison Gowanus substation in Brooklyn, Kings County, NY.

BEC UTILITY CORRIDOR: NO SPUDDING & NO ANCHORING WITHIN +/- 65 FT

FROM THE CENTERLINE OF THE BEC UTILITY CENTER CABLE.

Additional restrictions and requirements may be provided by the utility owner(s).

The BEC utility lines shall not be disturbed. The Contractor is required to coordinate with the utility owner(s) prior to dredging within the BEC Corridor for preventative measures. If damage or displacement of the BEC utility line were to occur, the Contractor shall coordinate with the utility owner(s) to restore the condition of the BEC utility line at no additional cost to the Government”.

Q4. Is Hopper dredging and/or Hydraulic dredging allowed on this project?

A4. No. Hopper/hydraulic dredging is prohibited on this project. Per the NYSDEC Water Quality Certificate, an environmental bucket is required for dredging silt and/or other fine grained unconsolidated materials.

Q5: The requirements have 5 days to commence after receipt of the notice to proceed and 31 days to complete work. The specifications state that 30 days’ notice is required to move and Aids to Navigation (as required by USCG). Given the location of the project, it is likely several navigational aids will need to be relocated. Please confirm that this will be accomplished prior to issuance of the NTP and after award by the USACE or that the USACE will work with the successful offeror and the USCG to accomplish the moves prior to the issuance of the notice to proceed.

A5: USACE will work with the successful offeror and the USCG to accomplish the moves, to successfully achieve the contract objectives.

Q6: The documents state that the work will take place summer/fall 2022. Can the USACE provide a better idea of when the NTP would be issued? Or is it rather that the successful offeror will have the entire time from award to do the work however the work cannot take more than the specified 31 days?

A6: Currently, the work is scheduled to start in early summer 2022. The winning bidder will have 31 days to complete the work from the contractor’s acknowledgment of the Notice to Proceed.

Q7: There is another solicitation, W912DS22B0004 - Maintenance Dredging of New York and New Jersey Harbor – Kill Van Kull Federal Navigation Project bidding a week away from this solicitation. Given the similarity of equipment required and relative location of the projects to each other, it is possible the offer for each solicitation may intend to use the same equipment to accomplish both requirements. Can the USACE please provide clarity on if these solicitations will be required to be accomplished simultaneously or if the USACE will work with the successful offer, should it be the same for each requirement, to schedule the work tip-to tail (one starting immediately after the other ends).

A7: USACE plans to accomplish the work simultaneously. Winning Bidder will be required to complete all work within the specified performance period from the date of Notice to Proceed.
