Maintenance Dredging of New York and New Jersey Harbor – Kill Van Kull

Federal Navigation Project

OFFERORS' QUESTIONS AND GOVERNMENT REPLY: Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors “for information only” and do not revise the solicitation, plans or specifications. By this Amendment Offerors are advised of this provision, applicable to all RFI responses.

RFI 1 Q1: Please provide the Best Management Practices that apply to this scope of work regarding bucket hoist speed, seasonal windows, and all of the aforementioned above.

RFI 1 A1: The NYSDEC Water Quality Certificate (2-6500-00053/00001, dated 25 August 2014) Condition 10 – Contract Reach Best Management Practices is answered in the NYSDEC Authorization to Proceed (2-6500-00053/00001, dated 17 March 22) Items 1, 2 and 3. Silt curtains are not required as a Best Management Practice for this solicitation.

RFI 1 Q2: Are there any other Permits applicable to this scope of work that have not been provided in the Specifications?

RFI 1 A2: NYSDEC Authorization to Proceed (2-6500-00053/00001, dated 17 March

22) provided by Amendment 1.

RFI 2 Q1: Please confirm that when the typical environmental bucket encounters sand or refusal, the contractor will be allowed to use a heavier non-enclosed bucket.

RFI 2 A1: The NYSDEC WQC Authorization to Proceed (2-6500-00053/00001, dated 17 March 22) Special Condition 1 specifies that an environmental bucket be used for all dredging. It is not anticipated that the dredge material for this maintenance cycle will cause refusal. If refusal dredge material is encountered and deemed significant then USACE will apply to the NYSDEC for a modification as necessary.

RFI 2 Q2: Please provide section 00 45 00 Representation and Certification. It is missing from the specifications but states “To be provided by Contracting Division”.

RFI 2 A2: Section 00 45 00 is provided in this amendment

RFI 3 Q1: The requirements have 5 days to commence after receipt of the notice to proceed and 36 days to complete work. The specifications state that 30 days’ notice is required to move and Aids to Navigation (as required by USCG). Given the location of the project, it is likely several navigational aids will need to be relocated. Please confirm that this will be accomplished prior to issuance of the NTP and after award by the USACE or that the USACE will work with the successful offeror and the USCG to accomplish the moves prior to the issuance of the notice to proceed.

RFI 3 A1: USACE will work with the successful offeror and the USCG to accomplish the moves, to successfully achieve the contract objectives.

RFI 3 Q2: The documents state that the work will take place summer/fall 2022. Can the USACE provide a better idea of when the NTP would be issued? Or is it rather that the successful offeror will have the entire time from award to do the work however the work cannot take more than the specified 31 days?

RFI 3 A2: Currently, the work is scheduled to start in early summer 2022. The winning bidder will have 36 days to complete the work from the contractor’s acknowledgment of the Notice to Proceed.

RFI 3 Q3: There is another solicitation, W912DS22B0007 - Maintenance Dredging of Buttermilk Channel, New York, Federal Navigation Project bidding a week away from this solicitation. Given the similarity of equipment required and relative location of the projects to each other, it is possible the offer for each solicitation may intend to use the same equipment to accomplish both requirements. Can the USACE please provide clarity on if these solicitations will be required to be accomplished simultaneously or if the USACE will work with the successful offer, should it be the same for each requirement, to schedule the work tip-to tail (one starting immediately after the other ends).

RFI 3 A3: USACE plans to accomplish the work simultaneously. Winning Bidder will be required to complete all work within the specified performance period from the date of Notice to Proceed.

This amendment does not change any other parts of the solicitation.
