B. Section 00 22 10 - PHASE 1 OF 2 PHASE DESIGN BID-BUILD SELECTION PROCEDURES
1. The following PARA has been REVISED and REISSUED:
Para. 2.5 Teaming Agreements:
If any Offeror is submitting a proposal with a Teaming Agreement, the Teaming Agreement must be in compliance with the requirements of FAR9.6. Any offerors submitting a proposal with a teaming arrangement must submit a copy of the teaming arrangement with their proposal. If you are a small business submitting a proposal for this project, and are proposing with a Teaming Agreement with a large business, you must submit at least one project of your own demonstrating recent and relevant design build experience but can also submit the experience of the firm named in your Teaming Agreement.
2. The following PARAGRAPH has been REVISED but NOT REISSUED:
Para. 4.0 TAB A – Factor 1: PAST EXPERIENCE SUBMISSION REQUIREMENTS:
“To demonstrate recent, relevant experience, the Offeror must use the Specialized Experience forms – (Attachment 2 for construction experience).
If the Offeror is a Joint Venture, Limited Liability Corporation, members of a Teaming Agreement, or integrated design bid-build firm provide recent and relevant experience information for design build construction, demonstrating the experience of each proposed entity as is relevant to their proposed role on this project.
Please note that USACE will only evaluate design build construction subcontractors that are part of a teaming arrangement.
The offeror shall demonstrate not less than two (2) but no more than four (4) examples of relevant design build projects no less than 75% complete or physically completed within the last seven (7) years. The Offeror must have completed at least one of the projects that they submit with the/e firm that they intend to work with on this project.
Relevant projects are those which are similar in scope, magnitude and complexity.
If the Offeror has not previously worked on relevant projects with the A/E firm it intends to use on this project, the AE shall submit two (2) design projects demonstrating similarities to scope, complexity and magnitude to receive satisfactory rating for this factor.
In all relevant experience projects submitted by the offeror it shall be clearly stated the projects scope, magnitude and complexity, as well as the Offerors involvement (% of work performed prime/sub and contract type DB DBB).”
C. BIDDER’S QUESTIONS AND GOVERNMENT REPLY
(Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors “for information only”and do not revise the solicitation, plans or specifications.)
1) A Small Business Prime Contractor is teaming with a larger construction entity with which we have established a teaming arrangement. Will we be able to include a project from the prime, a project from the teaming partner large business, and 2 projects from the A/E?
We request clarification of submission requirements for Experience:
* There appears to be a conflict between Page 29 which allows experience from Teaming Agreements and Page 30 which states experience should only be from Offeror or A/E firm
* RFP Page 29 states: "If the Offeror is a Joint Venture, Limited Liability Corporation, members of a Teaming Agreement, or integrated design bid-build firm provide experience information for construction, demonstrating the experience of each proposed construction entity as is relevant to their proposed role on this project.
* RFP Page 30 states "Past experience must be the Offeror's and proposed A/E firm (if applicable) only, and may not include projects completed by predecessor companies or projects completed by proposed non design subcontractors or any project where the Offeror was a primary subcontractor."
Answer - Yes. If you are a small business submitting a proposal for this project, and are proposing with a Teaming Agreement with a large business, you must demonstrate your own experience but can also submit the experience of the firm named in your Teaming Agreement. Please note that USACE will only evaluate subcontractors that are part of a teaming arrangement. A teaming arrangement partner is not considered a non-design subcontractor.
Any offerors submitting a proposal with a teaming arrangement must submit a copy of the teaming arrangement with their proposal.
