1. General: Rental of rubber tired only truck mounted crane, either, hydraulic or fixed length boom, to include operator and oiler and all required hoisting and auxiliary equipment, proper rigging, mats, blocking, fuel, lubricants, field repairs and operating supplies, completely assembled and ready for use as specified below.
2. Period of Rental: The contract includes the following periods of rental:
Base Year: 1 Dec 2012 – 30 Nov 2013 Option Year 1: 1 Dec 2013 – 30 Nov 2014 Option Year 2: 1 Dec 2014 – 30 Nov 2015 Option Year 3: 1 Dec 2015 – 30 Nov 2016 Option Year 4: 1 Dec 2016 – 30 Nov 2017
For each contract period of rental awarded, crane services may be ordered at any time during the contract period. For a typical contract period of rental, the crane is required for a two to three consecutive day period during the month of December and for a two to three consecutive day period during the month of April. The crane may also be required at other times of the year for emergencies. The total number of days of usage for each contract period of rental will not exceed 6 days unless the contract is modified to include additional days. The exact number of days and actual dates of usage will be coordinated with the Contractor as soon as possible following award prior to the actual dates required but no later than one week prior to the actual work dates.
3. Crane Requirements: Crane must be capable of safely performing the following lifts: 25 tons at a 35 ft radius; 13 tons at a 40 ft. radius; 7 tons at a 50 ft. radius. Crane and crane operators must meet all applicable safety requirements (including crane operator training and certification) contained in the US Army Corps of Engineers Safety and Health Requirements Manual EM385-1-1, including all updates. The manual is available on the internet:
http://140.194.76.129/publications/eng-manuals/em385-1-1/2008_English/toc.html
4. Special Conditions: The Crane will typically be used in December of each year for removal of Patrol Boat “Sentinel II” and sectional barges from the water and placing them on shore. The crane will also be used to place a government furnished cofferdam at the north end of the lock and to place an access walkway across the lock at the south end. The crane may also be used to place a stoplog cofferdam at the south end of the Federal Lock. The crane will also typically be used in April of the following year for re-installation of the Floating Plant identified above and for the removal of cofferdam(s) and the access bridge. Wood blocking and lifting slings for all floating plant and for placement/removal of cofferdams will be provided by the U.S.
Government under this contract. The contract also provides for use of the crane, if required, during other parts of the year to assist with emergency repairs to the lock or floating plant. The crane typically is required a total of four to six days per year.
5. Payment:
(a) Mobilization/Demobilization: There will be no separate payment for Mob/Demob. All costs associated with mobilization and demobilization of the contractor’s equipment including all costs associated with round trip transport of equipment to and from the job site, set-up of all required equipment at the job site and all applicable fees and permits for transporting the equipment over the highway to and from the job site shall be included in the contractor’s daily rate for “Crane Services.”
(b) Crane services: The bid schedule includes a daily rate for the estimated maximum number of crane usage days (6 days) anticipated for crane services during each year. Actual payment for crane services will be made on the basis of the daily rate quoted in the bid schedule for the actual number of working days in which the equipment is at the job site, unloaded and fully assembled, ready and available for use, including all Mob/Demob costs as indicated above.
A working day shall include Mondays through Fridays, but shall not include Holidays, Saturdays and Sundays. Bidders are advised to provide a “1/2 day rate” to be applied only if a full day use of the crane is not required. Payment for partial workdays will be made in ½ day increments with up to 4 hours paid at the quoted “1/2 day rate” and 4-8 hours paid at the quoted “full day rate”. Should a “1/2 day rate” not be provided, the Contractor will be paid 50% of the contract daily rate for crane services up to 4 hours in any one day and 100% of the contract daily rate for crane services in excess of 4 hours on any one day.
6. Award: Bidders shall provide a daily rate for crane services for the contract base year (1 Dec 2012 through 30 Nov 2013) and for each of the four option years (1 Dec 2013 through 30 Nov 2017). Award will be made to lowest bidder for Crane Services for the base year only.
Subsequent modification of the contract to award each contract option year may be made based upon the Government’s favorable review of the Contractor’s bid price for the option year(s).
7. Contractor Responsibility: The contractor shall be responsible that his employees strictly comply with all Federal, State and Municipal laws that may apply to operations under the contract, and it is understood and agreed that the Contractor assumes full responsibility for the safety of his employees, plant, and materials and for any damage or injury done by or to them from any source or cause, except damage caused to plant or equipment by acts of the Government, its officers, agents or employees, in which event such damages will be the responsibility of the Government in accordance with applicable Federal laws. For the purpose of this clause, the term “officers, agents, or employees” of the Government shall not include persons who are employed by the Contractor and whose services have been furnished to the Government, pursuant to this or any other contract.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(ii) Examples.
(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).
