RE: Federal COl1sistency Ddel111ination / Water Qua:ity Certification File: 0000-01-1003.1 (CDT 080001) Project: Maintenance Dredging of the Raritan River and Arthur Kill Reach of t:te NY & NJ Channels

Dear Mr. Hmtz:

This letter is forwarded in response to your June 2, 2008 request for a Federal Consistency (FC), as required by Section 307 of the federal Coastal Zone Management Act (16lJSC 1451 ~ ""-'1.) m,d Water Quality Certification (WQC) as required by Section 40 I of the federal Clean Water Act (33 USC 1251 et ""g.) for the mall1tenance dredging of the Rarilan River navigation channel. This FCfWQC serves to authorize the maintenance dredging of the Raritan River Federal NavigatlOn Main Channel, miles 0.0

4.0 and the Arthur Kill Reach oflhe New York ano New Jersey channels

The 2008 dredging cycle involves the maintenance dredging of the Arthur Kill Reach of the New York and New Jersey channels to maintain a chanJJel depth of -35 below mean luw water (MLW) plus 2 foot overdredge. The proposed dredging is as follows:

The maxirncm volurne of material to be renoved Cncluding oveTdrcdge) as part of this dredging cyc,le is 3pproxim8tely 103,995 cubic yards of ma1eri21.

The 2008 dredging cycle involves the ma~men3.nce dredging of the RaritlD River Federal Navigation Main Channel, milts 0.0 - 4.0 to maintain a channel depth of -24 below mean low water (MLWI plcs 1 fooloverdredge.

The maximum volume of material to be removed (including overdredge) as part of this dredging cycle is approximately 55,705 cubic yards of meterial.

The Department has reviewed the sediment data for both the Raritan River and Arthur Kill. The following parameters were found to be 1I1 exceedance of the residential soil cleanup criteria:

The apparent low bidder identified for this conh-act will be required to secure all necessary permits and approvals for the proposed upland placement site for the material. This informatlOn would then be submitted to the NY District as part of the contract procurement procedure. The DepaIiment finds this process acceptable provided the NY District submits a request for an amendment to this federal consistency detcm1ination once an acceptable pem1itted upland site is identified for this conh-act by the apparent low bidder.

The Rules on Coastal Zone Management (NJ.A.C. 7:7E) constitute New Jersey's enforceable policies under its federally approved Coastal Zone Management Program. The Raritan River and ,"",hur Klll

Maintenance Dredging Project has been reviewed under the following Rules on Coastal Zone

Management: Navigation Channels (7:7E-3.7), Ports 0:7E-3.
