About this file

This document contains an amendment to a solicitation for the Herring Bay and Rockhold Creek Maintenance Dredging Project in Anne Arundel County, Maryland. The U.S. Army Corps of Engineers, Baltimore District is seeking bids to dredge approximately 38,000 cubic yards of silty to sandy material from Herring Bay and Rockhold Creek to achieve and maintain a channel depth of 7 feet plus 2 feet of allowable overdepth in specified areas. Dredged material will be hydraulically pumped via pipeline approximately 3.5 miles to an existing upland placement site owned and operated by Anne Arundel County. Earthwork and weir box repairs may also be required at the placement site. The period of performance is 110 days beginning around May 1, 2023 after the June 15 environmental dredging window opens. The solicitation is 100% set aside for small businesses. The amendment provides responses to contractor questions on notice to proceed timing, private dredging requests, survey responsibilities, and pipeline submergence requirements.

SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE (SF 30)

The following have been added by full text:

AMENDMENT 0002

Herring Bay/ Rockhold Creek RFIs

1. Does the USACE have an anticipated date when the NTP may be issued?

Answer: The NTP for this project is expected to be issued on/around 1 May 2023.

2. If the NTP is issued on or before the shutdown date of March 1, how will the 106 days between

March 1 and June 15 to be handled?

Answer: The period of performance will begin once the Notice to Proceed (NTP) is issued. The period of performance for this contract will be 110 days. The NTP for this project is expected to be issued on/around 1 May 2023. This will allow adequate time for the dredging to be completed after the environmental window opens on 15 June 2023 after submittal review and mobilization.

3. If the 106 days of mandatory water work stoppage is not counted as part of the 110 days from notice to proceed, will the contractor be allowed to work on non-water tasks without the penalty of days counted towards the 110 days in the contract documents?

Answer: Yes, the contractor will be able to work on non-water tasks prior to 15 June. Only dredging is restricted to begin after 15 June.

4. Will the contractor have free access to the CDF as well as the landward pipeline route between now and the bid date, or do we need a representative from the USACE with us?

Answer: Contractors should contact Anne Arundel County Department of Public Works to allow for access to the placement site. The site and landward pipeline route are owned and operated by Anne Arundel County.

5. Does the USACE anticipate any restoration on the landward pipeline route to the CDF?

Answer: No.

6. From station 7+283 to the CDF, are there any requirement in this contract for the pipeline to be submerged?

Answer: The pipeline should be submerged due to the large number of vessels that have the potential to use the waterway north of Station 7+283. There are many docks and piers adjacent to this part of the waterway that have the potential to need access during the time of year dredging will occur.

7. Are there any sensitive areas on the landward pipeline route? If so, does the USACE have any direction on how to handle the sensitive areas?

Answer: Limited disturbance to any wetlands located along the pipeline right of way route from Rockhold Creek to the placement site should be implemented. Reduction techniques can include, but are not limited to, using mats, low pressure equipment, maintaining travel and pipeline through to the waterway as much as possible. Please refer to Section 01 57 19 of the specifications for further details on repairing landscape damage during and after the project.

8. Speaking with one of the marina owners, he said the last time this channel was dredged, the contractor was allowed to dredge the private marinas as long as they were on or ahead of schedule. Is that allowed during this contract?

Answer: Any private marinas who would request dredging would have to go through the proper permitting process. Any business agreements between the marina owners and a contractor are their business. Private dredging shall only occur after the federal navigation channel dredging is completed.

9. Would there be a cost per CY that the marina would pay for disposing into the CDF?

Answer: Unknown. This would need to be discussed between the private marina owners, the contractor, and Anne Arundel County (as the placement location landowner/operator).

10. Please confirm USACE will be doing all the Hydro Graphic Survey work on this project.

(Including the Pre and Post surveys the monthly surveys for payment applications.)

Answer: Yes, USACE will be performing the Immediately Before Dredge (IBD) Survey and the After Dredge (AD) Survey.

11. Will there be a pre-dredge survey done right after the notice to proceed?

Answer: Yes, an immediately before dredge (IBD) survey will be conducted post NTP and prior to dredging. The contractor will need to officially request an IBD based on their anticipated start dredging date.

12. While it is understood that the pipeline must be submerged in the high traffic areas, will the

USACE give the contractor some leeway for the floating pipeline behind the dredge within the immediate work area? (Example: The contractor must have a practical amount of floating dredge pipe leaving the dredge in order to move ahead during the dredging process. Because of the floating line behind the dredge will be limited to no boat traffic in or out of the marinas on either side until the dredge and pipeline is clear of the marinas access. The floating pipeline will hinder boat traffic for the immediate dredge area for approximately 24 hours. After 24 hours the dredge will move ahead approximately 200’ and can the attach to the next length of submerged pipeline.

At that time, the floating line will limit the next 200’ of marinas on both side of the channel. Will that be acceptable? The contractor can be responsible to notify any marinas or homeowners in advance, on both sides of the channel, informing them about the floating pipeline and the dates they will be affected.

The specifications say the submerged pipeline shall rest on the channel bottom where a pipeline crosses a navigation channel and while submerged; the top of the pipeline and any anchor securing the pipe shall be no higher than the required project depth for the navigation channel in which the pipe is placed.

Answer: Yes, floating the pipeline directly adjacent to the immediate area of work, as long as it is properly identified as stated in the specifications, is acceptable.

13. Please clarify the intent of this language. If the contractor will begin dredging at station 0+00, the pipeline will need to be submerged and secured at the existing depth. This would not meet the conditions of the contract documents. If the contractor begins dredging the channel from station 7+283 heading towards station 0+00,the channel will be cut to ‘REQUIRED Project Depth.”

When moving forward, submerged pipeline will be installed. The submerged pipeline installed would then be installed on the “required project depth”, but the pipeline and anchoring system would surely be above the “required project depth” for the navigational channel. This also would not comply with the contract documents. Please clarify the intent of the “no higher than the required project depth” language in the contract documents.

Answer: Prior to dredge an area of the channel the dredge pipeline may rest on the existing bottom of the channel. Post dredging of those locations, the dredge pipeline will it no higher than required project depth.

14. Given the fish window constriction of no dredging from 3/1 to 6/15 and the performance period requirement of 110 days, if the contract was awarded 2 weeks after the bid opening on 3/16, the period of performance would end on 7/4. That scenario would only give the contractor only 19 days including Sundays and holidays to complete mobilization, dredge, and demobilize from the site. What is the expected Notice to proceed date? Can the period of performance begin after the end of the fish window?

Answer: The period of performance will begin once the Notice to Proceed (NTP) is issued. The NTP for this project is expected to be issued on/around 1 May 2023. This will allow adequate time for the dredging to be completed after the environmental window opens on 15 June 2023 after submittal review and mobilization.
