About this file
This justification document approves a sole source contract with Daou Engineers, Inc. to provide comprehensive revalidation of the heating, ventilation, and air conditioning system design for the United States Army Medical Research Institute of Infectious Diseases replacement facility at Fort Detrick, Maryland. The scope of work includes revalidation of the control system and HVAC equipment design, an assessment of key construction aspects, and a determination of whether the designed system could be properly commissioned. The justification cites Daou Engineers' expertise in biocontainment and familiarity with the original facility design as requirements necessitating a sole source award. The Department of the Army Corps of Engineers, Baltimore District plans to award a firm-fixed-price contract utilizing fiscal year 2020 military construction funds in January 2020.

USAMRIID BSL-3/4 HVAC Systems and Controls Design Revalidation and Assessment
Fort Detrick, Maryland
December 2019
JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
Justification and Approval: Revalidation of United States Army Medical Research Institute of Infectious Diseases (USAMRIID) Replacement Facility Heating Ventilation Air Conditioning (HVAC) System, Fort Detrick, Maryland
1. CONTRACTING AGENCY: Department of the Army Baltimore District, Corps of Engineers 2 Hopkins Plaza Baltimore, MD 21201
2. DESCRITPION OF ACTION: The U.S. Army Corps of Engineers, Baltimore District requests approval of a new firm-fixed-price sole source contract with Daou Engineers, Inc. (DEI). The Government projects award in January 2020 and fiscal year 2020, Military Construction (MILCON) funds will be used.
3. DESCRIPTION OF SUPPLIES/SERVICES OR NATURE OF CONSTRUCTION: The purpose of this new sole source firm fixed price contract is for DEI to provide a comprehensive revalidation of the design of the USAMRIID Replacement Facility control system, the associated HVAC equipment and systems, and key architectural elements of the laboratories that contribute to the maintenance of containment and directional airflow under all required operational modes including normal, specific operational, and failure scenarios. In addition, the scope will provide an assessment of key aspects of the construction known or suspected to factor into the overall success of required laboratory function.
The USAMRIID Facility is an Army Facility located on Fort Detrick, Maryland that is presently under construction.
This revalidation will result in a written assessment (i.e. deliverable) of the key design elements and the overall commission-ability of the systems as presently designed and constructed, and if found necessary, identification of modifications required to achieve the design intent, or recommended to significantly reduce the testing and commissioning time or improve overall system reliability.
Additionally, the revalidation shall provide a final written assessment (i.e. deliverable) of whether the as-designed HVAC and controls system equipment and components, performing according to the sequences of operation and other contract-defined performance parameters, is reasonably achievable by a controls contractor properly qualified and experienced in the industry, in the course of an adjustment and tuning effort typical for critical bio-containment facilities.
4. AUTHORITY CITED: 10 United States Code 2304(c)(1) as implemented in Federal Acquisition
Regulation 6.302-1(a)(2)(iii)(B), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. REASON FOR AUTHORITY CITED: The market of engineering firms with expertise in bio-containment and control/HVAC systems in BSL-3 and 4 laboratories is extremely limited. DEI is the only firm, independent of the designer of record and the construction contractor, with the expertise, as well as, familiarity with the original design of the USAMRIID Replacement facility.
Both of these qualifications are required for this contract. The contractor will evaluate the current operation of the integrated systems (i.e. supply air, exhaust air, programming) that are installed in the building.
There is no other firm that can provide these expert services in the time frame required per the contract. DEI is the only contractor that is an expert at bio-containment and control/HVAC systems in BSL-3 and 4 laboratories that can provide validation services in the time frame required.
6. EFFORTS TO OBTAIN COMPETITION: The Baltimore District reviewed all its current contract holders and there were no firms who met the qualifications required to successfully complete the requirements of the scope of work. The Baltimore USAMRIID determined that the only firm that had both the qualifications and some familiarity with the design that was not the designer of record was DEI. A notice of intent was posted to beta.sam.gov (Government Point of Entry) in accordance with FAR 5.201. It requested that any firm that believed they were capable of working on this requirement should submit a capability statement that would be independently reviewed by the Government. This notice was posted for 15 days and no firms responded with capability statements.
7. ACTIONS TO INCREASE COMPETITION: Not applicable. The Government posted the notice of intent to find additional firms that would be capable of performing the requirement, but no such firms existed.
8. MARKET RESEARCH: The Government posted the notice of intent to allow other firms the opportunity to submit capability statements. The Government also reviewed qualifications of firms that have worked with the Baltimore District. This was all conducted over the past month.
9. INTERESTED SOURCES: To date, no other sources have written to express an interest. DEI is the only firm is an expert at bio-containment and control/HVAC systems in BSL-3 and 4 laboratories and has some familiarity with the original design of the USAMRIID Replacement facility.
