Limited Source Justification

ChemScan Analyzer Maintenance and Services
Control No. – NAB-19-010
1. Contracting Activity: USACE Baltimore, 2 Hopkins Plaza, Baltimore, Maryland 21201.
2. Description of Action: This acquisition is for a firm fixed price service contract for the annual service and maintenance of three ChemScan Analyzer units located at the Washington Aqueduct Division.
3. Description of Supplies/Services: To provide annual maintenance and repair services for the Washington Aqueduct’s three ChemScan Analyzer units, model UV-2150/S via ASA Analytics service program. The estimated cost for a base year plus four option years is $93,160.00.
4. Authority Cited: FAR 13.106(b)(1), Sole source (including brand name) acquisitions.
5. Reasons for Authority Cited: ASA Analytics the manufacturer of the equipment has no partnership agreements with any other companies to service their equipment and as the manufacturer is the only company capable of providing required repair parts and ensuring the equipment continues to meet OEM standards and requirements. Competing this requirement would not prove to be advantageous to the government.
6. Efforts to Obtain Competition: There is effectively no competition as Applied Spectrometry Associates, Inc is ASA Analytics designated distributor for parts and services in this region.
7. Actions to Increase Competition: Washington Aqueduct can neither practically nor cost effectively increase competition for the annual maintenance and services for the ChemScan Analyzer units.
8. Market Research: ASA Analytics the manufacturer of the equipment has no partnership agreements with any other companies to service their equipment and as the manufacturer is the only company capable of providing required repair parts and ensuring the equipment continues to meet OEM standards and requirements. IAW FAR 5.203(a)(1), a notice of intent to issue a single/sole source contract will be publicized on Federal Business Opportunities (FBO). The purpose of this notice will be to determine whether to conduct a competitive procurement.
9. Interested Sources: A limited sources justification will be posted to FBO.
