Performance Work Statement

Infrared Deer Survey Services Raystown Lake, Huntingdon County, PA

1. Introduction: The U. S. Army Corps of Engineers at Raystown Lake is requesting infrared deer survey services. Contractors shall be capable of providing infrared deer surveys on Federal lands. The contractor shall furnish all labor, materials, and equipment, including equipment operators, necessary to complete infrared deer surveys on the Raystown Lake Project in Huntingdon County, Pennsylvania.

2. Background: The U.S. Army Corps of Engineers, Raystown Lake Project has developed an integrated approach to the management of white-tailed deer at Raystown Lake. The purpose of the program is to maintain the biological diversity of the Project through the long-term monitoring of the resident deer herd. White-tailed deer are important recreational and aesthetic components of Raystown Lake and the Corps has taken a proactive approach in the management of the deer herd to insure a healthy forest ecosystem.

3. General Requirements:

The contractor will furnish all labor, equipment, materials, including equipment operators, and quality control necessary to conduct three thermal infrared imaging surveys to determine white-tailed deer population on approximately 21,727 acres at Raystown Lake. Cumulative acres survey will be approximately 53,427 acres. Surveys will be done using an aerial radiometric infrared camera. Survey aircraft are required to be equipped with properly functioning Differentially Corrected Global Positioning Systems (DGPS) to assist in aircraft guidance and flight recording. Helicopter or fixed winged aircraft may be used. Night surveying is recommended for Line Items #1 & #3, but daylight surveys will be permitted to insure surveys can be completed within desired timeframes. Daylight surveys are required for the deer season survey (Line item # 2).

The contractor must notify the Corps, local 911, FAA, and Huntingdon State Police prior to conducting flights over Federal lands. This notification must occur each day that flights will occur.

3.1 Infrared Survey Description: The contractor will furnish all labor, equipment, materials, and quality control necessary to conduct infrared deer surveys at the Raystown Lake Project, Baltimore District, US Army Corps of Engineers in accordance with the specifications contained herein as follows:

Survey 1: The pre-season survey will encompass approximately 21,727 acres (Appendix C) and occur after leaf drop but prior to the Pennsylvania Regular Firearms season.

Approximate survey dates are October 31 – November 18, 2016.

Survey 2: The in-season survey will encompass approximately 21,727 acres (Appendix C) and occur November 28 – December 10, 2016. Surveys will occur during daylight hours and GPS hunter locations will be included.

Survey 3: The post-season survey will encompass approximately 21,727 acres (Appendix C) and occur after the Pennsylvania Regular Firearms season. Approximate survey dates are January 4 – January 29, 2017.

3.2 Operator Certification/Qualification:

3.2.1 Pilot. The Contractor must provide a properly licensed pilot with a minimum of three years of experience conducting aerial deer surveys and more than 3,000 hours of total flight time. The pilot shall be required to provide copies of the flight logs to the Contracting Officer Representative (COR) upon completion of the wildlife surveys.

Pilots used shall be trained in the use of GPS, shall be Federal Aviation Administration (FAA) qualified to operate the aircraft specified in the bid, and shall meet or exceed the experience minimums as the pilot in command. The Contractor must supply totals for each pilot to be used in this contract for the categories listed below at the pre-work conference (Section 2.4.). The Government reserves the right to approve or disapprove the pilot in command based on the following minimum requirements:

3.2.2 Biologist/Sensor Operator: The Contractor shall use a professionally Certified Wildlife Biologist to interpret aerial survey data. The Biologist shall have a minimum of 5 years total experience performing aerial deer FLIR surveys and interpreting aerial deer FLIR population data and a minimum of three years of aerial infrared survey experience in Pennsylvania. The Contractor must supply proof of experience for each biologist/sensor operator to be used in this contract at the time of quote submittal.

3.3 Aircraft Specifications and Operational Limitations:

Licenses - Every aircraft furnished for this contract must be properly registered under regulations of the FAA.

Conditions - Each aircraft must fully comply with laws, regulations, directives, and specifications of the FAA.

Safety – Each aircraft must satisfy all safety regulations prescribed by the FAA.

Equipment - All equipment specified in this contract for use in or upon any aircraft must be FAA approved or the Contractor must have an FAA field approval (FAA Form 337) from the FAA Flight Safety District Office serving the Contractor's home base of operations.

Incapacitation - In the event that any aircraft under contract becomes incapacitated it must be repaired within 24 hours of the original breakdown. If the aircraft cannot be repaired and returned safely to full operation, it must be replaced with an aircraft of similar capabilities subject to all of the provisions of these Contract Specifications.

Engines - Each aircraft engine shall pass FFA inspection.

Aircraft Refueling – The aircraft must be refueled with the engine shut down and follow all FAA refueling regulations.

Reserve Fuel - A minimum of thirty (30) minutes for daytime and forty-five (45) minutes for nighttime is required.

Loading - The pilot is responsible for the proper loading of the aircraft. Loading is under the pilot's direction and must be inspected by the pilot before takeoff. The weight must not exceed the maximum gross weight specified by the aircraft manufacturer. The pilot must compensate for altitude, temperature, landing zone conditions, and any adverse flying conditions.

Visibility - The aircraft windshield or bubble must be kept clean.

Acceptable Aircraft – Rotary or fixed wing aircraft may be used. Other aircraft not listed that are capable of conducting the specified aerial thermal imaging must be approved by the Corps prior to conducting surveys.

3.4 Aircraft Survey Equipment:

Survey Equipment – Contractor must use the Kelvin 350II Radiometric Infrared Camera system or equivalent. If other equivalent equipment other than the Kelvin 350II is to be used the Contractor must provide the U.S. Army Corps of Engineers with the technical specifications prior to use.

Sensor Equipment - A Thermovision 1000 sensor or equivalent must be used.

Flight Tracking – The Contractor shall use a DGPS, Garmin 496, Garmin Basecamp, or other equivalent system to that is capable of being imported into GIS and accurately logs the aircrafts flight path. The guidance system being used shall allow the flight log to be downloaded to a computer for post-flight analysis and review. The flight log must show the entire flight of the aircraft from takeoff to landing.

3.5 Contractor Report:

The Contractor is responsible for providing the following products in accordance within the specification of this contract. Reports and data must be submitted to the Corps by February 26, 2017.

Report of Findings - The Contractor will provide a report of findings that must adequately describe the methodology used to collect data, dates and time of field collection, and a summary of results of the findings.

GIS Coverage File - The Contractor will provide a GIS shapefile coverage that identifies each observed deer group with deer data on the number of deer within the group. The shapefiles must be compatible with ArcGIS 10 and be provided in the projection of UTM zone 17, NAD 1927 or Pennsylvania State Plane, NAD 83 Pennsylvania South, feet. The contractor may use conversions from image locations or other airborne software to create the shapefile.

Raw Image Data - All imagery collected will become property of the Government and shall be provided to the Government on an approved storage device.

3.6 Period of Performance:

Services provided under this Contract must occur during designated time periods. The period of performance for this contract shall run from date of award – February 26, 2017.

Surveys shall only be conducted during the survey dates specified above and when weather conditions are favorable to achieve optimal infrared imaging.

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor.

3.7 Compliance: All work conducted under this contract shall be performed in compliance with all county, state and Federal laws and regulations. Federal regulations include, but are not limited to:

Clean Air Act Extension, Public Law (PL) 91-604, 31 December 1970, as amended in

1990 (PL 101-549).

3.8 Pre-Work Conference: The Contractor is required to attend a pre-work conference before the commencement of work. The meeting will be held at Raystown Lake or via teleconference at a time that is mutually agreeable to the Contractor and the Government.

The Contractor shall submit the following documents with their quote submittal to be reviewed before the Pre-work conference.

Pilot and Biologist/Sensor Operator Certifications/Qualifications (see Section 3.2) Proof of Insurance (see section 3.11) Quality Control Plan

The contractor shall submit the following documents with 14 days of award before the pre-work conference and commencement of work.

Letter of designation for on-site safety officer

Accident Prevention Plan (see section 3.9) Proposed flight schedule Work Schedule Outline (see section 4.2)

An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award please see section 3.10.6.

3.9 Safety: The Contractor and Contract Employees will meet all applicable requirements of

Corps of Engineers Manual EM 385-1-1 dated 15 September 2008 entitled “Safety and Health Requirements Manual” (website location http://140.194.76.129/publications/eng-manuals/em385-1-1/2003_Arabic/toc.html), OSHA Regulations, and all State and Local safety codes while in performance of this contract.

3.9.1 Safety Officer: The Contractor shall designate an employee to be responsible for overall supervision of safety activities. Such duties shall include assuring applicable safety requirements are incorporated in work methods, and inspecting the work to ensure that safety measures are in action.

3.9.2 Reporting: The Contractor shall maintain an accurate record of, and report to the COR exposure data. All accidents resulting in death, traumatic injury, occupational disease, and damage to property, materials, supplies and equipment incidental to work performed under this contract will be documented. All accidents shall be reported within 24 hours of the occurrence. All accidents resulting in death or injury requiring medical attention shall be reported immediately.

3.9.3 Vehicle Operation: The Contractor shall observe all speed limits, weight limits, and other posted traffic signs in the operation of vehicles and equipment.

Trucks or other vehicles will be operated in a safe manner and will not be parked in unsafe positions.

3.9.4 Accident Prevention Plan: The Contractor shall develop and submitted within 14days of award, a written detailed accident prevention plan. This plan must indicate in detail the general policies and procedures for safe operation in the accomplishment of this contract. A cover letter identifying the Contractor or Company name, address, phone number, email (if applicable), Contract number and current year will accompany the plan. The plan shall show how the Contractor intends to perform all services in full compliance with the safety requirements set forth in EM 385-1-1, Appendix A. A signed letter of certification which references the contract and current year and states if the original plan remains current (or lists changes if applicable) is acceptable following the base year pre-work conference. All plans, or subsequent revisions, must be acceptable to government BEFORE work commences.

3.10 Security: The Contractor and Contractor employees will insure all gates and other areas will be secured, in the manner in which they were encountered, upon vacating the area.

3.10.1 Keys: The Contractor will be issued keys, if needed, to access contract areas exclusively for the performance of this contract.

3.10.2 Restrictions: Any use of Government keys other than for the performance of this contract is strictly prohibited. Making or being in the possession of duplicate keys is prohibited. Misuse of keys is grounds for dismissal of Contract Employees or termination of the contract.

3.10.3 Loss: Any loss of keys will be reported to the Government within 24 hours. Any loss of the keys and/or failure to report the loss may result in a deduction of up to $ 300.00 from the contractor’s final invoice and accepting the burden of reestablishing the integrity of the project lock and key system.

3.10.4 Access and General Protection/Security Policy and Procedures: All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.

3.10.5 Suspicious Activity Reporting Training: The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of the training.

3.10.6 Pre-screen candidates using E-Verify Program: The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award." *When contracts are with individuals, the individuals will be required to complete a Form I- 9, Employment Eligibility Verification, with the designated Government representative. This Form will be provided to the Contracting Officer and shall become part of the official contract file.

3.10.7 The Contractor will be escorted in areas where they may be exposed to classified and/or sensitive materials.

3.11 Insurance Requirements:

3.11.1 Required Insurance: Contractor shall provide insurance pursuant to the contract clause entitled, 52.228-5, Insurance – Work on a Government Installation.

The Contractor shall procure and maintain the required insurance during the entire period of performance under the contract, following minimum insurance:

3.11.2 Documentation: At the time of quote submittal, the Contractor shall furnish to the COR and Contracting Officer a current certificate or written statement of insurance requirements of the contract. Policies evidencing required insurance shall contain an endorsement to the effect that cancellation or any material change in policies adversely affecting the interests of the Government in such insurance shall not be effective for such period as may be prescribed by the Laws of the State in which this contract is to be performed and in no event less than thirty (30) days after written notice thereof to the Contracting Officer. Additionally, said policies shall list the Government as additionally insured.

4. Performance Requirements: The contractor will furnish all labor, equipment, materials, and quality control necessary to perform infrared surveys at the Raystown Lake Project, Baltimore District, U.S. Army Corps of Engineers in accordance with the specifications contained herein. The contractor is responsible for being in compliance with all county, state and Federal laws and regulations.

4.1 Required Timeframe: All work shall be completed from date of award – February 26, 2017, Monday through Saturday, excluding holidays, unless prior approval is given by the COR or their representative.

4.2 Work Schedule: The Contractor will provide the COR a schedule outlining the infrared flights, to include dates and times, by October 1, 2016. Variations from the schedule in excess of three days must be approved before work can continue. The schedule shall be resubmitted when variations of more than five days occur. This schedule will be used in part to provide a fair and accurate inspection of the Contractors work.

4.3 Quality Control Plan: The contractor shall establish a quality control plan for the performance requirements of this contract and shall provide for the COR's approval a written detailed copy with the quote submittal. The contractor shall maintain the quality control plan throughout the contract and submit to the government if any changes are made for concurrence. All plans, or subsequent revisions, must be acceptable to government before work commences. The Contractor shall provide a signed letter to the COR designating the name(s) of the Contractor’s QC(s) who will be physically present on site with authority and power to conduct all overall management, coordination, and supervision whenever work specified herein is being performed. This letter shall also include the QC(s) schedule(s) of work and contact information.

5. Government Provided Materials.

5.1 Upon request by the Contractor, the Government shall provide a “Safety and Health Requirements Manual”. The updated manual can be found at the following website:

5.2 Keys will be provided to the Contractor by the Government for executing the duties of this contract per Section 3.10.

6. Inspections, Deductions, and Default.

6.1 Inspections. All work shall be performed in an orderly fashion consistent with the specifications as outlined in this contract. During the execution of the contract the COR will conduct inspections of all equipment and data collected to determine if the acceptable quality level (AQL), of 95%, is being met. The Contractor will provide a letter stating that all infrared deer surveys have been completed and all required products have been provided to the Government in accordance with the contract requirements.

Once the COR receives this letter a final inspection of the provided products will be documented and an evaluation of timeliness and efficiency will be performed at this time.

Work found not to be done in accordance with the contract specifications will be redone at the contractors’ expense.

6.2 Deficiencies. If any of the services, in any measure, do not conform with contract requirements the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When defects in services cannot be corrected by re-performance, the Government may require the Contractor to take necessary action to ensure that future performance conforms to contract requirements, at no increase in contract amount.

6.3 Deductions. If the Contractor fails to correct defects by re-performance and/or take the necessary action to ensure future performance in conformity with contract requirements in a timely fashion the Government may, by contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service. These charges will be deducted from the Contractor’s next invoice (FAR52.246-4). The Contractor shall be provided an itemized breakdown of each deduction made.

6.3.1 The Contractor shall be responsible for repairing or replacing damaged property to the satisfaction of the COR due to Contractor negligence. Repairs or replacement of damaged property must be made within seven days or less of the incident. If the Government makes the necessary repairs or replacement of damaged property then all costs associated with said repairs or replacement will be deducted from the next invoice received from the Contractor.

6.3.2 The Government may terminate the contract due to the contractor’s failure to perform the requirements specified in this contract or extensions thereof, or make progress so as to endanger performance of this contract. Default of the contract shall be considered for various reasons relating to nonperformance of the contractual specifications. Following is a partial listing of reasons for which default may be considered:

Repetitive failure to adhere to contract specifications Repetitive deductions for non-performance Repetitive safety violations Repeated abuse of key privileges Excessive cases of damage to Government or private property Excessive cases of substantiated public complaint

7. Invoices and Payment.

7.1 Invoices: The invoice shall accurately reflect work completed. Each invoice at a minimum shall contain the following information:

7.2 Corrections.

Incorrect invoices will be returned to the Contractor for correction before processing payment. Corrected invoices shall be re-dated to reflect the new submission date.

7.3 Remittance.

Invoices shall be submitted via post-mail and/or electronic mail to the following addresses for payment. Should changes occur to the mailing addresses the Contractor shall be notified.

APPENDIX A.

Performance Requirements Summary

The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.

Performance Objective The contractor shall furnish all labor, materials, and equipment necessary to perform the survey services on the Raystown Lake Project in Huntingdon County, Pennsylvania in accordance with the specifications contained herein.

The contractor shall provide Proof of Insurance per the requirements of PWS Section 3.11.

INFRARED DEER SURVEYS

THE RAYSTOWN LAKE PROJECT

1. INTRODUCTION

This Performance-Based Quality Assurance Surveillance Plan (QASP) has been developed pursuant to the requirements of the Performance Work Statement for Contract No. (TBD) – Infrared Deer Surveys at Raystown Lake. This plan sets forth procedures and guidelines that the U.S. Army Corps of Engineers (USACE) will use in evaluating the technical and safety performance of the Contractor. A copy of the Performance Metrics is furnished in the PWS (Appendix A) so that the Contractor will be aware of the methods that the Government will employ in evaluating their performance on this contract.

2. PURPOSE OF THE QASP

The QASP is intended to accomplish the following:

a) Define the roles and responsibilities of participating Government officials;

b) Define the types of work to performed with required end results;

c) Document the evaluation methods that will be employed by the Government in assessing the

Contractor’s performance;

d) Describe the process of performance documentation;

e) Outline quality assurance procedures to be employed by the Government during performance of this purchase order to confirm that the site characterization is conducted utilizing proper procedures and in accordance with the approved work and safety plans.

3. ROLES AND RESPONSIBILITIES OF PARTICIPATING GOVERNMENT OFFICIALS

AND MILITARY SERVICE REPRESENTATIVES:

4. PRIMARY METHOD OF SURVEILLANCE

The Contracting Officer’s Representative will monitor the contractor’s performance, which will be evaluated by the Contracting Officer using the Performance Metrics listed in the PWS.

Quality Assurance Surveillance Activities In general, the work will be evaluated in terms of how well the requirements of the task order are satisfied as reported to the COR by the Technical Monitors on site. At the discretion of the COR or the Contracting Officer or Project Manager, other government officials approved by the Contracting Officer or COR may be asked to evaluate a particular task or set of tasks. Quality Assurance included but is not limited to the following:

Inspections of equipment used and date collected will be performed by the COR or COTR to ensure that the contractor is meeting all contract requirements. Inspections will include inspection of equipment used, compliance with safety plan, review of work outline, and review of the Contractor’s post-survey report.

5. SCOPE OF PERFORMANCE

The contractor shall furnish all labor, materials, and equipment, including equipment operators, necessary to perform Infrared Deer Surveys on the Raystown Lake, Baltimore District, U.S. Army Corps of Engineers in accordance with the specifications contained in the Performance Work Statement (PWS).

6. PERFORMANCE STANDARDS

The contractor will complete all specifications contained in the Performance Work Statement (PWS) and within the performance metrics listed in Appendix A of this PWS.

7. ACCEPTABLE QUALITY LEVEL (AQL)

The COR or COTR will inspect the equipment used and data collected to ensure work performed meets the specifications outlined in the PWS for each line item.

8. EVALUATION METHODS

A team approach that includes the OPM, COR or COTR will inspect the equipment used and data collected to ensure work performed meets the specifications outlined in the PWS for each line item.

9. INCENTIVES (POSITIVE/NEGATIVE)

If the work performed does not meet the specifications set by the Government in the PWS; the Contractor shall correct any and all issues noted by the COR at no additional charge to the Government.

Submission Requirements: Past performance refers to the quality of recent project experience from the customer’s perspective. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance does not meet some contractual requirements.
