INSTRUCTION TO OFFERORS

SUBMISSION OF QUOTES:

The U.S. Army Corps of Engineers – Baltimore District has a requirement for Dredge Cable Maintenance/Repairs.

The Government is using FAR Subparts 12 and 13 and will award a firm-fixed-priced contract resulting from this solicitation to the responsible contractor whose quote conforms to the solicitation.

The Government anticipates award of a Firm-Fixed-Price (FFP) Lowest Price (Cost) Technically Acceptable contractor, i.e. to the contractor with the lowest evaluated realistic price of quotes meeting the acceptability standards for non-cost factors. To receive consideration for award, a rating of no less than “Acceptable” must be achieved for the Technical factor. Award will be made with appropriate consideration given to the three evaluation factors: Factor 1-Technical, Factor 2 - Past Performance, and Factor 3-Cost/Price.

The Government intends to evaluate quotes and make award without questions to contractors.

Therefore, the initial quote should contain the contractor's best terms from a Technical and Cost standpoint. Unclear quotes may not result in questions for clarifications. Offers with an omission or unclear quote may be judged to mean the contractor does not fully understand the requirements or understand what it takes to meet the requirements, regardless of the proposed cost/price and will be rated unacceptable. In that case, the contractor may be found unacceptable, and ineligible for award. The Government reserves the right to ask questions of contractors if the Contracting Officer determines them to be necessary.

Offerors must be registered on the System for Award Management (SAM) to be eligible for award. The Government reserves the right to award without discussions. In order to be eligible for award, a contractor must be determined to be responsible in accordance with FAR 9.104.

Quotes shall be submitted via e-mail to tamara.c.udasco@usace.army.mil ATTN: Tamara Udasco, no later than the time and date specified on Standard Form 1449, Block 8. Unclear quotes may not result in questions for clarifications.

Quotes received after the required time and date deadline will not be evaluated.

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT

YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE

RATING DEFINITION NOTE

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit.

The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating.

Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract.

There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.

(U) Unsatisfactory

Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

(N) Not Applicable

No information or did not apply to your contract Rating will be neither positive nor negative.

PERFORMANCE WORK STATEMENT

PERFORMANCE WORK STATEMENT

FOR USACE BALTIMORE DISTRICT

DREDGE CABLE REPLACEMENT AND TENSIONING

WASHINGTON AQUEDUCT

November 5, 2015

1. Introduction: River solids, removed during the water treatment process, are deposited continually in sedimentation basins. The solids residuals are collected from each of the two Georgetown Reservoir basins using 60 HP electric driven auger dredge manufactured by Liquid Waste Technologies, Inc. (LWT). These dredges move through the basins using a tensioned steel cabling system. The tensioned steel cable system that the basin two dredge rides along has frayed, making the dredge unsafe to operate. Water treatment residuals in the basin cannot be removed and are accumulating. The non-removal of water treatment residuals will eventually adversely affect the treatment process causing water quality issues. The Washington Aqueduct has an urgent requirement for servicing of the dredge cabling system to allow for the continued operation of the dredges.

2. Background: The Washington Aqueduct (WA) is a critical infrastructure that operates two water treatment plants (WTPs), the Dalecarlia WTP and the McMillan WTP. Raw water solids are removed during the water treatment process. As part of the Washington Aqueduct’s National Pollution Discharge Elimination System (NPDES) permit, residual solids are collected and transferred to the Residuals Processing Facility (RPF). Residuals are collected from each of three Washington Aqueduct facilities – Dalecarlia Sedimentation Basins, Georgetown Reservoir basins and the Dalecarlia Forebay.

Collected residuals are then transferred to the RPF for dewatering and disposal. At the Georgetown Reservoir, the residuals collection equipment consists of automated self-propelled, cable driven, dredges. The dredges operate on a cable multiple winch positioning system. The transverse cables in basin #1 and basin #2 must be replaced and all cable systems re-tensioned.

3. General Requirements: The Washington Aqueduct has a requirement for acquisition of services to replace the dredge transverse cables in basins #1 and #2, and inspect, tension, and grease the entire tensioned cable system at Georgetown Reservoir.

Non-Personal Services. The Government shall neither supervise contractor employees nor control the method by which the contractor performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual contractor employees. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services, If the contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the contractor's responsibility to notify the Procuring Contracting Officer (PCO) immediately.

3.1. Period of Performance: The work shall be completed within 35 days from award.

3.2. Site Security. All personnel working on this project will be required to follow all security and access rules and regulations (i.e., physical access and/or network access requirements) as set forth by the US Government in order to gain access to the USACE offices and/or systems to perform work assignments and/or for the delivery of equipment.

The Washington Aqueduct has been designated a Critical Infrastructure Facility under the National Critical Infrastructure Program which was outlined in Presidential Decision directive 63. All Contractor and sub-contractor personnel must consent to a review of public records and screening of personal background information before access is granted to Washington Aqueduct facilities. Failure to provide requested information may result in denial of access to facilities. No information will be released to outside agencies. The following major types of adverse information may exclude a Contractor from gaining access to restricted areas or general unescorted access to Washington Aqueduct property. Each case will be reviewed on its own merit:

a. Illegal use or abuse of drugs or alcohol, theft or dishonesty, unreliability, instability, use of force, violence and weapons related incidents that indicate a general disregard for the law.

b. Aberrant, deviant sexual behavior or bizarre sexual conduct. Contributing to the delinquency of minors, child molestation, and/or rape. Records or testimony of employment, education or military service where the individual was involved in serious offense or incidents that would reflect adversely on the honesty, integrity, trustworthiness, or stability of the individual.

c. Excessive indebtedness, bad checks, financial difficulties or irresponsibility.

d. Failing or refusing to sign the proper authorization documents to conduct the background screenings.

e. Knowingly providing false information on Official Government Documents.

Each employee assigned to this project by the Contractor and subcontractors shall be required to display at all times, while on the project site, an approved form of identification provided by the Contractor, as an authorized employee of the Contractor/subcontractor. In addition, on those projects where identification is prescribed and furnished by the Government, it shall be displayed as required and it shall immediately be returned to the Contracting Officer’s Representative (COR) for cancellation upon release of the assigned employee and or completion of project.

3.2.1 Access and General Protection/Security Policy and Procedures.

All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.

Suspicious Activity Reporting Training (e.g. iWATCH, CorpsWatch, or See Something, Say Something).

The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT five (5) calendar days after the completion of the training.
