REFUSE SERVICES

1.0 Introduction: Raystown Lake is located in Huntingdon and Bedford Counties in South Central Pennsylvania, approximately 95 miles west of Harrisburg and 175 miles east of Pittsburgh. It is south of the town of Huntingdon and approximately 70 miles from the Pennsylvania-Maryland border. Raystown Lake is approximately 28 miles long and maintains 12 developed recreation areas that require refuse services.

1.1 Contract – A mutually binding legal relationship (enforceable by law) obligating the seller to furnish supplies or services and the buyer to pay for them.

1.2 Contracting Officer (KO) - A person with the authority to enter into, administer and/or terminate contracts and make related determinations and findings. A Corps of Engineers employee vested with the authority to approve, modify, and issue contracts.

1.3 Contracting Officer’s Representative (COR) – The person designated by the KO with the authority to administer the contract.

1.4 Technical Point of Contact (TPOC) – Person in the field that works directly with the Contractor during contract execution.

1.4 Contractor’s On-Site Representative – Person on site, designated and empowered by the contractor to submit schedules, verify work completed and make other day to day decisions on behalf of the contractor.

1.5 Contractor Employees - Those persons hired by the contractor and approved by the Contracting Officer’s Representative to assist in the performance of this contract.

1.6 Contract Period – Base Year and Option Years as renewed by the Corps of Engineers (Refer to Section 3.)

2.0 General Information

2.1 Period of Performance: The contract period will consist of one (1) base year and four (4) option years.

The beginning and ending dates are as follow:

Base Year Date of contract award – December 31, 2024 Option Year 1 January 1, 2025 – December 31, 2025 Option Year 2 January 1, 2026 – December 31, 2026 Option Year 3 January 1, 2027 – December 31, 2027 Option Year 4 January 1, 2028 – December 31, 2028

2.2 There are eight (8) line items listed in the bid sheet for each of five years. The contractor must bid on all line items for all periods of performance years to be considered for award.

2.3 Pre-Work Conference. The contractor is required to attend a pre-work conference at the beginning of each contract year prior to the start of services to review the contract specifications, the accident prevention plan, quality control plan, schedule of equipment inspections, and to verify insurance and safety requirements. At this meeting the contractor will identify all contractor employees having roles to meet the requirements of the contract.

2.4 Non-Personal Services. The government shall neither supervise contractor employees nor control the method by which the contractor performs the required tasks. Under no circumstances shall the government assign tasks to, or prepare work schedules for, individual contractor employees. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services. If the contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the contractor's responsibility to notify the COR or the KO immediately.

3.0 Performance Requirements:

3.1. The contractor shall furnish the necessary supplies, labor, tools, containers (except as noted) and equipment for the collection, transportation, and disposal of trash, rubbish, construction and demolition, recycles, and garbage at various public use and administrative facilities located throughout the Raystown Lake Project.

3.1.1. The contractor shall provide, maintain, disinfect and sanitize containers as per inventory listed for refuse. The specific location is listed in Appendix A. Such containers shall be green or brown in color, top loading with plastic, closing lids, with the words "REFUSE" and “NO PARKING IN FRONT OF CONTAINER” in minimum 12-inch high white letters on the visible side of the container. The containers shall be placed as per the aforementioned inventory listing.

3.1.2 The contractor shall provide a special 10 yard roll-off type container as per inventory listed for recycles. The specific location is listed in Appendix A. Such containers shall be green or brown in color, top loading with plastic, closing lids, with the words "Recycles" and “Paper, Plastic, Glass” etc. in minimum 12-inch high white letters on the visible side of the container. The COR and Contractor shall agree upon required wording at the pre-work conference. Contents will include such items as glass, cardboard, newspaper, shredded paper, plastic, and aluminum. The container shall be placed as per the aforementioned inventory listing. Location is subject to change when given a seven (7) day notice or at the time of collection from the COR.

3.1.3 The contractor shall provide a special 30 yard roll-off type container as per inventory listed for refuse and other materials. The specific location is listed in Appendix A. Such containers shall be green or brown in color, top loading, full open, with the words describing the intended contents. Such as "Construction and Demolition “in minimum 12-inch high white letters on the visible side of the container. The COR and Contractor shall agree upon on any specific wording at the pre-work conference. The container shall be placed as per the aforementioned inventory listing. Location is subject to change when given a three (3) day notice or at the time of collection from the COR.

4.0 General Conditions

4.1. The contractor will be required to dedicate one truck to the collections for 3, 6, and 8 yard containers at Raystown Lake so that weight tickets may be generated at the landfill showing the total weight exclusively for the Raystown refuse. Additional dedicated trucks are permitted for 10 and 30 yard (special) containers.

Refuse collected from other locations should not be included in the collection truck from the Raystown contract service.

4.2. Weights and collection amounts listed in these specifications are approximations. The total weights to be collected listed in this contract represent estimated collection weights. Actual weights may vary depending on the amount of refuse in each container and the amount (if any) of refuse placed on and around the container.

4.3 Additional pickups (All years inclusive)

4.3.1. The contractor shall collect the garbage, trash, and refuse from the containers at some or all of the bid items found in Appendix A on the day following the official Memorial Day holiday, July 4 holiday, Labor Day holiday, and during other special events, upon the request of the Contracting Officer. Other special events may include, but are not limited to, Raystown Clean-Up Day. Additional pickups may occur on weekends as well as weekdays. When not included in the schedule of services, the Contracting Officer’s Representative (COR) will notify the Contractor of dates and service locations at least one week before additional service is required. Additional service is contained in the bid schedule. Such additional service shall be in accordance with paragraph 3.1 and 4.1.

4.4. Special pickups Roll-offs (All years inclusive)

4.4.1. The contractor shall collect the garbage, trash, refuse, construction and demolition, and recycles from the special containers at some or all of the bid items found in Appendix A upon the request of the Contracting Officer. Other special events may include, but are not limited to, Refuse Clean-Up Day(s).

Additional pickups may occur on weekends as well as weekdays. When not included in the schedule of services, the Contracting Officer’s Representative (COR) will notify the Contractor of dates and service locations at least one week before additional service is required. Additional service is contained in the bid schedule. Such additional service shall be in accordance with paragraph 3.1 and 4.1.

5.0 Inventory of Refuse Collection Sites

5.1. The Inventory of Refuse Collection Sites is listed in Appendix “A” for reference purposes only. Potential contractors are encouraged to inspect each site for level of difficulty, size, distance, obstacles, etc.

6.0 Schedule of Services

6.1. A general schedule of service is shown in Appendix B. See Appendix C for the five year detailed calendar dates.

7.0 General Conditions

7.1. The contractor shall dispose of all trash, rubbish, and garbage collected in accordance with Pennsylvania Department of Environmental Resources requirements and the Pennsylvania Solid Waste Management Authority and other applicable laws, rules, and regulations. Contractor shall provide suitable covers for vehicles to prevent garbage, paper, and other debris from scattering.

7.2. Garbage pickups in all areas shall be completed between 6:00 A.M. and 2:00 P.M. Exceptions to these hours may be requested in writing to the COR.

7.3. All garbage containers shall be emptied and all bags, boxes, or other disposable items adjacent to the garbage containers shall be collected. Garbage containers shall not be removed except to empty same and shall be returned to their original locations. The contractor shall pickup any spillage from the containers and trucks.

7.4. The contractor must have sufficient labor, equipment, and supplies to perform all work required. The contractor shall provide, or make arrangements to provide, all containers (except as noted), equipment, materials, and supplies. All containers, supplies, and materials shall be subject to approval of the authorized representative of the Contracting Officer (COR or TPOC).

7.5. Contractor shall use the existing service routes in the public use areas and the camp areas in making collections. Drivers of all contractor vehicles will comply with all applicable federal, state and local laws and regulations including the use of seat belts. All vehicles shall comply with federal, state and local laws and regulations. Only the contractor or contractor employees may be authorized to ride in or on the trucks or other equipment used by the contractor.

7.6. Special care shall be exercised to avoid damaging any public facilities. The contractor will restore or repair any damage to such facilities, buildings, signs, etc., resulting from the contractor's failure to exercise reasonable care in the performance of the work. If the contractor fails or refuses to repair any such damage promptly, the contracting officer may have the necessary work performed and charge the cost thereof to the contractor. The contractor will exercise extreme care so as to protect all visitors and their property from injury, harm and/or damage. The contractor shall be responsible for all damage incurred to self or others during the scope of this contract resulting from contractor negligence. The contractor shall report all damaged Government items found during the normal scope of this contract to the COR or TPOC. See section 11.

Required Insurance.

7.7. The Government reserves the right to have the contractor remove an employee from the job site if the employee, in the opinion of the Government, acts in such a manner as to endanger property or persons, including him or herself. An employee shall also be removed, if in the opinion of the Government, he or she behaves in an abusive, threatening or otherwise unacceptable manner toward the public, government employee, government facility, or any other government contractors.

7.8. The contractor shall notify the COR or TPOC of the contractor’s perceived misuse of Government refuse receptacles by the non-recreating public. Misuse is primarily concerned with the dumping of household refuse into Government refuse receptacles. Contractor will note the date, location, and general inventory of items found in this occurrence.

7.9. The contractor’s refuse hauling vehicles must be inspected by the appropriate Pennsylvania Department of Agriculture Bureau of Weights and Measures designee to certify properly calibrated weights and measures no less than annually, if applicable. Current copies of these certifications for each vehicle used must be provided to the COR or TPOC at the beginning of each contract year if vehicles contain internal scales.

7.10. The contractor shall remove, or turn upside down, each contractor-owned refuse container within two weeks of the final scheduled pick up from each collection site. All containers shall be replaced, or turned up-right, and prepared for service no less than two weeks prior to the first calendar year pick up from each collection site. The contractor will be responsible for the disposal of any and all refuse left in the containers in the off-season.

8.0 Quantities

8.1. Quantities listed are estimated. The Manager, Raystown Lake, reserves the right to decrease or increase line item quantities based on actual need. The contractor will be given at least one week written notice of a change in the schedule. The effective date of the notice will be the date on the written notice as signed by the COR or his TPOC. Services may be verbally deleted as a result of flood control operations or adverse weather conditions and followed by written notification. Contractor will not be reimbursed for pickups that may be deleted by the COR or TPOC with such notice.

8.2. Variations in quantities of less than or equal to 30% based on total contract cost will preclude any adjustment in the contract amount.

9.0 CONTRACTOR PROVIDED MATERIALS AND RESPONSIBILITIES

9.1 Communication Plan. The contractor shall provide a communication plan which demonstrates the contractor’s ability to maintain communications between the contract employees and government personnel during times when services under this contract are being performed. This plan must include contact phone numbers and email addresses used, and/or identification of alternate method of communication. Although the Corps of Engineers does not endorse any product or service provider, cellular communication using area providers (Verizon and AT&T for highest quality reception) is recommended to meet this requirement.

9.2 Service Procedure. The contractor shall provide for the contract employee’s use, service procedures for each type of facility. This plan will include a sequence of actions that will result in meeting contract requirements at that type of facility. Itemized plans in checklist or bullet format are acceptable.

9.3 Training Program. The contractor shall provide a summary of employee training requirements and methods. This program must demonstrate that sufficient training methods will be provided to all contract employees, to allow them to meet all requirements of this contract. Verification of a trainee’s ability to successfully provide service is needed to adequately meet this requirement.

9.4 Training Record. The contractor shall provide an itemized training record for all contract employees which demonstrates either successful or unsuccessful completion of the training program. Although part of the Quality Control Plan, completed training records may follow submission/approval of the plan, and within three

(3) days of the contract employee’s start date.

9.5 Equipment and Material Inventory. The contractor shall provide an inventory of all equipment and materials to be used during services under this contract. Safety Data Sheets (SDS) will accompany any applicable materials. Equipment and materials which do not appear on this list will not be permitted on the project or in the service of this contract.

10.0 Security.

10.1 Storage. The government may provide a designated space within a gated compound for contractor related equipment and other material storage if desired by the contractor. The contractor will provide a request storage to the COR for approval. The contractor shall keep the space clean and neat condition. Unused equipment will be removed from government property.

10.2 Keys. The contractor and contractor employees will be issued keys to access contract areas exclusively for the performance of this contract. The contractor and contract employees will ensure all doors, gates and other areas will be secured, in the way they were encountered, upon vacating the area.

10.3 Restrictions. Any use of government keys other than for the performance of this contract is strictly prohibited. Making or being in the possession of duplicate keys is prohibited. Misuse of keys is grounds for dismissal of contractor employees or termination of the contract.

10.4 Loss. Any loss of keys will be reported to the government within 24 hours. Any loss of the keys and/or failure to report the loss may result in the contractor accepting the burden of reestablishing the integrity of the project lock and key system.

10.5 Access and General Protection/Security Policy. All contractor employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by the Project Manager. Contractor employees must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the government may require changes in contractor security matters or processes.

10.6 Suspicious Activity Reporting Training (e.g. iWATCH, CorpsWatch, or See Something, Say Something). The contractor shall receive a brief/training (provided by the COR) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the Project manager or his/her authorized representative. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of the training.

10.7 Escorts. The contractor shall coordinate with the COR and/or the facility security office for access when required. All contract employees who are not in possession of the appropriate security clearance or access privileges, will be escorted into areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas.

10.8 Pre-Screen Candidates Using E-Verify Program. The contractor must pre-screen candidates using the E-verify Program (http://www.dhs.gov/E-Verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the candidate has two valid forms of government issued identification prior to ensuring the correct information is entered into the E-verify system. An initial list of verified/eligible candidates must be provided to the COR no later than t h r e e ( 3) business days after the initial contract award."

11.0 Safety

11.1 The contractor shall comply with the latest version of the Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1 (including interim changes), and submit all reports required therein to the COR or TPOC. Where more stringent safety and occupational health standards are set forth in these requirements and regulations, the more stringent standards shall apply. 11.2 The contractor shall provide the Corps of Engineers with a written accident prevention plan and activity hazard analysis prior to commencement of work. The accident prevention plan will provide all the necessary information required by EM 385-1-1 and ENG Form 6293 (Accident Prevention Plan Worksheet). For option years, a signed letter from the contractor referencing the contract number and current year of service must be provided stating that the originally accepted plan remains current with applicable updates. All plans including subsequent revisions must be acceptable to the government before work commences.

11.3 The contractor shall provide the Corps of Engineers with the required developed Activity Hazard Analysis(s) (AHA) for all activities. AHA(s) will provide all necessary information required in EM385-1-1 and ENG 6206 (Activity Hazard Analysis). Completed from(s) shall be submitted to COR or TPOC. 11.4 The contractor shall designate a Site Safety Health Officer (SSHO). SSHOs must be present at the site of work and located so they have full mobility and reasonable access to all major work operations occurring during the shift. The designated SSHO(s) shall review and sign the mandatory ENG Form 6282 (Site Safety and Health Officer Designation Letter). The name of that person shall be provided at the pre-work meeting each year and may change if provided in writing by the contractor. Completed from(s) shall be submitted to COR or TPOC.

11.5 All refuse collection equipment will meet the requirements identified by their manufacturer, OSHA standards, and the Corps of Engineers Safety Manual, EM385-1-1, and all other applicable standards.

11.6 Equipment to be used at Raystown Lake by the contractor shall be mechanically sound, in good state of repair, and in compliance with all safety standards. Safety guards are not to be removed from equipment or made inoperable at any time. The government reserves the right to inspect any equipment at any time during the contract.

11.7 Equipment found to be unsafe will be removed from service until appropriate repairs and/or safeguards are instituted. All injuries to employees or recreational users and all damages to property, government or private, will be reported immediately to the COR.

11.8 The contractor shall observe all speed limits and other posted safety signs while operating vehicles and equipment. Trucks or other vehicles will be operated in a safe manner and will not be parked in unsafe positions.

12.0 Insurance. The contractor shall provide insurance as required in Clause 52.228-4001 “Required Insurance”.

Prior to start of contract work, the contractor shall furnish to the COR a current certificate or written statement of insurance requirements of the contract. Policies evidencing required insurance shall contain an endorsement to the effect that cancellation or any material change in policies adversely affecting the interests of the government in such insurance shall not be effective for such period as may be prescribed by the Laws of the State in which this contract is to be performed and in no event less than thirty (30) days after written notice thereof to the KO. Additionally, said policies shall list the government as “additionally insured.”
