1.1. COLLECTION REQUIREMENTS
1.1.1. Routes/Schedules Submittals: All refuse shall be collected. Vehicle routes and collection schedules shall meet the requirements of Appendix A.
1.1.2. Unscheduled Collections: The contractor shall perform unscheduled collection, disposals, and relocation of containers for special events, holidays, or other occasions as requested by the Government. The contractor shall be notified in advance of special collections not otherwise noted in Appendix A. Response to unscheduled collection, disposals, and relocations of containers for special events will be within 24 hours of notification by the Contracting Officer’s Representative (COR).
1.1.3. Excess Quantities of Refuse: Excess refuse beyond the normal quantity resulting from holidays or special events shall be disposed of at no additional cost to the Government. This should be accomplished with minimum interference to regular collection schedules. The COR will notify the contractor for the need of additional collection when containers are near overflow. All refuse placed at collection stations adjacent to refuse containers shall be the contractor’s responsibility to remove and dispose of according to the contract requirements.
1.1.4. Inclement Weather Schedule: Refuse shall be collected during periods of inclement weather. In cases of severe weather or park closure, the Contracting Officer or the Contracting Officer’s Representative (COR) may authorize exceptions. When exceptions are granted, all missed collections shall be performed within 24 hours after the severe weather or park closure has terminated, unless the Contracting Officer or the COR authorizes additional time. It is the contractor’s responsibility to notify the Contracting Officer or the COR when they are not able to perform services due to inclement weather.
1.1.5. Points of Collection: General collection locations for refuse materials are identified within Appendix A. The specific locations within each of the general locations noted within Appendix A will be identified by the COR. The COR will provide adjustments to the specific locations if necessary to better service the area. Containers shall be positioned for customer ease in depositing refuse. Containers shall be positioned to minimize interference with adjacent parking areas, sidewalks, roadways, overhead utilities, trees, and other potential obstructions. The Contractor may secure the refuse containers at each location, however, securing refuse containers shall not prevent the depositing of refuse within the containers.
1.1.6. Maintaining Containers and the Collection Areas: Containers shall be placed in their original location after servicing, in an upright position with the lids closed. Any spills, debris, etc., which may occur during servicing of containers shall be cleaned up. All refuse on the ground around the container, whether spilled by the contractor or placed there by visitors, shall be removed during collection. Debris such as, tree branches, sacks, cartons, boxes, cans, tied bundles, or other containers placed at collection stations shall be collected.
1.1.7. Refuse containers shall be placed at the designated locations in each park during the last week in April so that each refuse container is accessible on May 1st. Refuse containers shall be removed from the designated locations in each park during the first 2 weeks of October but shall remain accessible through October 1st. Scheduling and access for temporary storage of refuse containers shall be coordinated with the COR during Government workdays and work hours. Refuse containers shall be available for use and serviced at the Administration Area as listed in Appendix A. The COR shall provide an area for storage of the containers removed from the park areas outside of the listed use months. The storage locations may not be a single location and may not be in a secure area; the Contractor shall be responsible for securing the refuse containers to prevent removal of the refuse containers and to prevent the public from disposing refuse into the containers. The Contractor will not be responsible for public drop-offs at the storage locations adjacent to the secured refuse containers.
1.2. SANITATION REQUIREMENTS
1.2.1. The Contractor shall provide equipment, such as garbage trucks, and refuse containers that comply with industry and sanitation standards.
1.2.2. The interior and exterior of all refuse collection equipment shall be periodically cleaned. All trucks, including the bodies, used for hauling refuse shall be maintained in a clean, neat, condition to prevent the propagation or attraction of vermin.
1.2.3. All containers shall be cleaned and sanitized at least one (1) time per year.
1.3. SPECIAL COLLECTION REQUIREMENTS
1.3.1. Special Collections: The contractor shall review Appendix A and schedule pick-ups for special events as noted. During holiday weekends and other events lasting 3 or more days, the contractor shall schedule collection as necessary to prevent excessive overflow of containers. The COR will determine what is excessive and request additional collection as necessary.
1.3.2. Missed Pickups: Refuse at missed pickup points shall be collected at no additional cost to the government within two (2) working hours from notification by the Contracting Officer or the COR.
1.4. DISPOSAL
1.4.1. Apparent Serviceable Material: Materials which have obvious value and appear to have been inadvertently placed near the collection point will not be disposed of, unless such material is designated as refuse by the COR. If the contractor is in doubt as to the value of the material, he shall check with the COR. The contractor shall be liable for intentionally disposing of serviceable items or material.
1.5. REPORTS AND RECORDS
1.5.1 At the Government’s discretion and request, the Contractor shall submit Refuse Collection Tonnage and Disposal Reports to the COR no later than the 5th day of each month following the month covered in the report. The report shall provide workload data for refuse collection. The report shall show total tons collected. 1.5.2 Contractor Exposure Hours: The Government is required to submit monthly the contractor exposure hours for the respective month. The Contractor is to track the number of person hours completed each month to perform the services of this contract and submit to the Government within five (5)-days following the end of the month the number of person hours for that month.

Questions regarding security matters shall be addressed to the designated Government representative (e.g., Contracting Officer Representative (COR), Requiring Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)). Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and activities, and security awareness training contributes to those efforts. The Department of Defense (DoD) and Army security training requirements specified below, if applicable, are performance requirements; all applicable contract personnel shall complete initial training within 30 days of contract award or the date new contract personnel begin performance on the contract. Within five business days from the completion of training, the Contractor shall provide written documentation (e.g., email or memorandum) to the Government representative. The documentation shall include the names of contract personnel trained and which training they completed; the Contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the Government representative. Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (commonly referred to as “RAMs”), and Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures --this includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures.
1.6.1.2. Suspicious Activity Reporting training (e.g. iWATCH, CorpsWatch, or See Something, Say Something): All contract personnel shall receive initial and annual refresher training from the RA representative on the local suspicious activity reporting program. This locally developed training provides contract personnel with general information on suspicious behavior, and guidance on reporting suspicious activity to the project manager, security representative or law enforcement entity.
1.6.1.3. Pre-screen candidates using E-Verify Program: Contractors shall comply with the requirements set forth in FAR clause 52.222-54 Employment Eligibility Verification and FAR Subpart 22.18 in using the E-Verify Program at (https://www.e-verify.gov/) (website subject to change) to meet the contract employment eligibility requirements. Contractors are encouraged to cooperate with Federal and State agencies responsible for enforcing labor requirements to include eligibility for employment under United States immigration laws in accordance with FAR 22.102-1(i). An initial list of verified/eligible candidates shall be provided to the COR no later than three business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, and submit it to the Contracting Officer to become part of the official contract file.
1.6.2. Minimal Requirements: Only personnel compliant with the requirements of this contract are authorized to perform the work of this contract. The Contractor shall submit all personnel information to the Government sufficient to perform background checks. The Government may obtain the fingerprints of personnel performing work of this contract.
1.6.3. Government Property: The Contractor shall include measures to ensure the security of Government property.
The Contractor shall establish and implement methods to ensure Government provided keys for the Contractor’s use are used only for the purposes of this contract, are not lost or misplaced, and are not used by unauthorized persons or for unauthorized purposes. The Contractor shall immediately report to the Government lost or misplaced keys or any other items that may pose a security risk.
1.7. CONTRACTOR PERSONNEL
1.7.1. The contractor shall designate a person who will be responsible for the performance of the work. The name of this person and alternates who shall act for the contractor shall be designated in writing to the Contracting Officer and the COR within ten (10) days after date of award. Telephone numbers shall be provided where the Project Manager and alternate may be contacted 24/7.
1.7.2. The contractor representative or alternate shall be available within two (2) hours during normal duty hours to meet on the park grounds with the COR to discuss problem areas. After normal duty hours, the contractor representative or designated alternate shall be available within two (2) hours.
1.8. CONTRACTOR EMPLOYEES
The contractor shall not employ persons for work on this contract if such employee is identified to the contractor by the Contracting Officer and the COR as a potential threat to the health, safety, security, general well-being or operational mission of the facility and its population. A list of personnel shall be made available in writing to the Government at the start of contract.
1.8.1. All contractor personnel shall present a neat appearance and be easily recognized as contractor employees.
1.8.2. Contractor personnel shall comply with directives pertaining to operation of privately owned vehicles in Government parks.
1.9. QUALITY CONTROL
The contractor shall develop, submit for COR approval, and maintain a quality control program to ensure refuse collection services are performed in accordance with this PWS in addition to best commercial practices. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. At a minimum, the contractor shall develop quality control procedures addressing the areas identified.
During the course of the performance of the services within this PWS, the COR may require the Contractor to address additional performance objectives other than those listed within Section 2 of this PWS.
1.9.1 QUALITY ASSURANCE
The COR will periodically evaluate the contractor’s performance using a Quality Assurance Surveillance Plan (QASP). The QASP will be developed between the COR and the contractor after contract award but prior to performance of the contract.
1.9.1.1. The COR shall inform the contractor when discrepancies occur and shall request corrective action. The COR shall make a notation of the discrepancy with the date, time and discrepancy that was noted, and request the authorized contractor representative to initial the entry and provide the appropriate corrective action.
1.9.1.2. Government Remedies: The Contracting Officer or the COR shall follow FAR 52.212.4, Contract Terms and Conditions-Commercial Items (Jan 2017), for contractor’s failure to perform satisfactory services or failure to correct non-conforming services.
1.9.2. Quality Control Plan: The contractor shall establish and maintain a complete Quality Control Plan to ensure the requirements of this contract are provided as specified. The Contracting Officer or the COR will notify the contractor of acceptance or required modifications to the plan before the contract start date. The contractor shall make appropriate modifications at no additional cost to the Government and obtain acceptance of the plan by the Contracting Officer or the COR before the start of the first operational performance period. At any time during contract performance, the Government has the right to require revisions of the Quality Control Plan at no cost to the Government should the incorporated plan fail to control the quality of service provided. The plan shall include, but is not limited to, the following:
(a) A description of the inspection system, addressing all services listed in Service Summary (SS).
(b) Frequency of inspections.
(c) Title of the individual(s) who shall perform the inspections and their organizational placement.
(d) A description of methods for identifying, correcting, and preventing defects in the quality of service performed before the level becomes unacceptable.
(e) On-site records of all inspections conducted by contractor. The inspection records format shall include:
i. Date, time and location of inspection.
ii. Signature block for the person who performed the inspection.
iii. Rating of acceptable or unacceptable.
iv. Area designated for deficiencies noted and corrective action taken.
v. Total number of inspections
1.10. HOURS OF OPERATION
The Contractor shall comply with the collection schedule identified within Appendix A. The hours of operation for the days identified within the collection schedule and for Sunday or Monday through Friday (when allowed by contract) are 08:00 to 18:00 hours. The exceptions are as noted within the contract documents and for times when collection is necessary for special events and holidays; for the latter, the COR will coordinate the schedule with the Contractor. Variations to the above schedules shall not occur unless first approved by the COR.
The administration area is controlled access. The COR will either issue a key, keypad code, or remote gate opener for access (between 08:00 and 18:00 hours) or will coordinate the Monday collection time with the Contractor to occur between 07:30 and 15:30 hours; the COR will provide further guidance for access, such as telephoning or reporting to the office once onsite and to access through which gate – North or South. In the event access is the latter and Monday is a holiday, then the collection will be the next federal workday.
1.11. HAZARDOUS, TOXIC, OR SPECIAL WASTE DISPOSAL
1.11.1. The contractor is responsible for all hazardous, toxic or special wastes which cannot be disposed of as solid waste in an EPA Resource Conservation and Recovery Act (RCRA) Subtitle D landfill in accordance with all federal, state, local and environmental laws, policies, regulations and procedures as specified in, but not limited to:
Code of Federal Hazardous Regulations Manual 40 (CFR) “1985” Parts 170 through 177; and in accordance with all applicable State laws and regulations and Department of Natural Resources guidelines; the most recent edition, including all policy statements contained therein.
1.11.2. Environmental Coordinator (EC): The contractor shall appoint and identify to the Contracting Officer/COR within 15 days after the start of the operational performance period an EC and an alternate. Updates shall be provided upon changes. The EC serves as the environmental coordinator to manage all hazardous waste (HW) and hazardous material (HM) activities performed by the contractor. The EC shall serve as the liaison to the Project Operations Manager for issues concerning the management of HW/HM.
1.11.3. The contractor shall carry environmental impairment expense insurance to cover the cleanup of mishaps or releases involving hazardous materials defined in Federal Standard No. 313D, 3 Apr 1996 and C-1 21 Mar 2000.
Insurance shall be maintained at the minimum state requirement. All projects, regardless of size, shall be covered for a minimum of two occurrences or an aggregate dollar limitation. The coverage shall be maintained at this level throughout the life of the contract. Should any incident occur which reduces the number of occurrences, the contractor shall immediately obtain additional insurance which reestablishes the level of insurance and the number of occurrences called for under this contract. This action shall be accomplished within 10 calendar days from the date of the incident. If the additional insurance is not obtained within the time period, the contractor shall immediately cease work until the additional insurance is obtained. Under no circumstances shall the contractor continue to work after insurance coverage has been canceled or otherwise ceases to exist, for example where the pertaining number of occurrences has in fact occurred. The burden of documentation of the insurance is the responsibility of the contractor. In no event shall work stoppage for lack of insurance be a cause for an extension of the contractual period of performance. Insurance coverage shall survive the period of performance of this contract until such time as all contaminated material and hardware have been satisfactorily placed in the ultimate disposal facility or incinerated and compliance with all legal and environmental requirements have been accomplished.

(a) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. The Government must exercise its post-acceptance rights-
(1) Within a reasonable time after the defect was discovered or should have been discovered; and
(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.
(b) Assignment. The Contractor or its assignee may assign its rights to receive payment due as a result of performance of this contract to a bank, trust company, or other financing institution, including any Federal lending agency in accordance with the Assignment of Claims Act (31 U.S.C. 3727). However, when a third party makes payment (e.g., use of the Governmentwide commercial purchase card), the Contractor may not assign its rights to receive payment under this contract.
(c) Changes. Changes in the terms and conditions of this contract may be made only by written agreement of the parties.
(d) Disputes. This contract is subject to 41 U.S.C. chapter 71, Contract Disputes. The Contractor shall proceed diligently with performance of this contract, pending final resolution of any dispute arising under the contract.
(e) Definitions. The clause at FAR 52.202-1, Definitions, is incorporated herein by reference.
(f) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence such as, acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.

(2) Invoices will be handled in accordance with the Prompt Payment Act (31 U.S.C. 3903) and Office of Management and Budget (OMB) prompt payment regulations at 5 CFR part 1315.
(h) Patent indemnity. The Contractor shall indemnify the Government and its officers, employees and agents against liability, including costs, for actual or alleged direct or contributory infringement of, or inducement to infringe, any United States or foreign patent, trademark or copyright, arising out of the performance of this contract, provided the Contractor is reasonably notified of such claims and proceedings.
