PART 1

GENERAL INFORMATION

1. General: This is a non-personnel services contract to provide Mowing and Trimming Services at the Melvern

Lake Project. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1. Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform Mowing and trimming services at the Melvern Lake Project as defined in this Performance Work

Statement except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract.

1.2. Background: Melvern Lake is a flood control reservoir located in East Central Kansas, with the presence of an upstream drainage system consisting of 349 square miles of prairie ecosystem, composed of primarily warm-season grasses intermixed with agriculture and hardwood forest, it provides for better than average water quality and clarity. The lake is located approximately 43 miles South of Topeka, 90 miles Southwest of the

Kansas City, 35 miles Northeast of Emporia. A map of Melvern Lake can be found on the Internet at:

http://www.nwk.usace.army.mil/me/. Melvern Lake provides water for a Rural Water District, flood protection for downstream areas and is part of a network of Corps of Engineer Lakes that help control flooding in the

Missouri and Mississippi River basins. Melvern Lake encompasses approximately 6900 acres of surface water, has a storage capacity of 363,000 acre-feet (an acre-foot = 325,000 gallons). Federal lands surrounding Melvern

Lake total 23,362 acres of which 11,353 acres are leased to the Kansas Department of Wildlife and Parks

(KDWP) for land management. Land management practices used by the Corps of Engineers and KDWP are engineered to preserve their natural value, providing benefits to the nation in areas of flood damage reduction, recreation, fish and wildlife management and water quality improvements. Four parks around the lake are managed and maintained by the Corps of Engineers, these parks include roads, utility systems, campsites, group camps, swimming areas, boat ramps, picnic grounds, playground areas, day use areas, nature trails, shelter houses and shower houses. In addition to Corps-managed areas, the Corps also maintains active lease agreements with KDWP and Private entities. The Lease's provide a full range of marina services, camping, swimming areas, nature trails, horse trails, boat ramps, boat rentals, fishing and hunting areas for the public.

Additional services contracted to the private sectors include mowing, refuse collection, facility cleaning, park attendant services and Law Enforcement. The Corps manages the contracts and conducts inspections to ensure that the services are provided for visitors to the lake.

1.3. Scope: Provide all Mowing and Trimming Services at Melvern Lake necessary to ensure that all work is performed in a manner that will maintain healthy grass, trees, shrubs, plants and present a clean, neat, and professional appearance.

1.5. Flood Control. This is a flood control project. Occasional retention of floodwaters may inundate portions of the public use areas, other areas, or access roads thereto being serviced by this purchase order. If inundation materially affects the scope of work, Contractors may be requested to submit a pricing proposal covering the under-serviceable or affected portion of their work in order that an equitable adjustment to contract price can be negotiated, and an adjustment made in accordance with the appropriate contract clause [Changes, FAR 52.212-

PART 5

SPECIFIC TASKS

5. Specific Tasks

5.1. Basic Services: The following requirements in the paragraphs listed below labeled 5, are applicable to all schedules of the contract. The Contractor shall provide project Mowing and Trimming services as per the specifications, drawings, and exhibits in the PWS. Service standards consist of the following. A major issue in this requirement shall be failure to perform satisfactorily in (1) one or more critical elements, or (2) two or more non-critical elements during each mowing.

5.1.1. Project Mowing and Trimming Duties (General Information). Mowing and Trimming duties listed herein are directly related to appearance, healthy grass, trees, shrubs, plants, also public safety. It is essential that all areas be serviced as specified herein. If an area is missed, or is not properly mowed or trimmed, the Contractor shall re-perform the services immediately upon receipt of note from the

Contracting Officer or their Representative. Failure to correct noted deficiencies Within 24 hours may result in withholding of payment for services not performed. Ensure that services are performed in a manner that shall maintain a satisfactory condition and present a clean, neat, and finished appearance. All

Mowing and Trimming procedures shall be accomplished in accordance with the manufacturer’s directions and/or listed specifications and industry standards applicable to the Professional Landscaping Industry.

Mowing and trimming should be at the frequencies shown in Attachments #1 and #11 (weather permitting).

5.2. Maintain Improved Grounds: The Contractor is responsible for ensuring that all requirements and standards as stated in this Performance Work Statement, and on the Attachment 9- Maps are met throughout the

Period of Performance of this contract. All mowing shall be completed in an area prior to moving to another area. Some areas consist of rocky terrain and wooded areas and will require an extensive amount of trimming and hand mowing where larger mowers cannot maneuver satisfactorily. All trash should be picked up, not run over and all sticks and branches should be picked up and delivered to the nearest wood line or stacked on an empty campsite or empty areas for Corps personnel to haul off.

5.2.1 QC Inspections: All mowing and Trimming must be inspected be the Contractors Quality Control

Representative prior to moving to another area.

5.2.2. Lagoons: Areas surrounding lagoons shall be mowed two (2) mower passes (Approximately 12 feet) on the outside of the lagoon fences and mowed completely between the lagoon fence and the entrance roadway. Areas within the lagoon fence shall be mowed and trimmed completely. 5.3. Mowing height: Mowing shall be accomplished so that all grassed areas are maintained at a height between 3 and 6 inches (preferably 4”), the COR can determine whether to raise or lower the cutting height at the time of mowing to minimize thatch.

5.3.1. Inanimate objects: It is the Contractors responsibility to ensure no damage is done to any inanimate objects such as trees, bushes, walls, posts, signs, park equipment or other objects. (see clause 52.237-2). All costs of repair or replacement in size, kind and type resulting from damage by the Contractors equipment shall be borne by the Contractor. Repair, replacement, or payment for the damage shall be completed/received within 30 calendar days of noticed damage.

5.3.2. Wet locations: Mowing with heavy equipment will not be permitted when the ground is so wet that the mowing operations cause rutting or otherwise disturb existing turf. There are several areas requiring service that remain wet for extended periods of time, especially during times of above average rainfall.

There will be occasions when wet areas that are routinely mowed with a self-propelled machine will need to be trimmed by hand or even postponed (with COR approval) until the next scheduled mowing in an effort, to eliminate rutting. At no time will turf damage resulting from poor judgment on the part of the

Contractor, whereby he has tracked or rutted a wet area be permitted. If such an act occurs, the Contractor will be required to repair the damaged area to its original condition at his own expense. When wet conditions prohibit mowing in accordance with the mowing schedule and contract requirements, a modification to the schedule shall be coordinated with the Contracting Officer or their Representative. It is the Contractor’s responsibility to select the appropriate equipment to ensure all grass is cut to meet the standards as stated in this PWS during each mowing. During the mowing if there are areas that are too wet to use mowers then they will require other means to meet the height requirements specified for the grass.

5.3.3. Sharp turns and speed: Mowers shall be operated in such a manner as to protect against the sod/grass being torn by the wheels on turns and on the slopes. In the event sod/grass is damaged, the

Contractor shall re-dress and seed the damaged areas with KY-31 fescue seed at the rate of 100 pounds per acre or the COR’s approved equal. The cost for repairs, labor and seed will be borne by the Contractor.

5.3.4 Contractors access: Contractor shall use the appropriate means of access to all locations via existing gates or roadways. Do not drive vehicles around gates or through fields creating openings vulnerable to encroachments. Repair of these areas will be at the Contractor’s expense.

5.3.5. All Mowing and Trimming operations around buildings and roadsides shall be performed so grass clippings are thrown away from buildings, sidewalks and away from the roadways whenever possible. All clipping must be blown or swept off sidewalks, parking lots, roadways and out of building entrances and building interiors.

5.4. Trimming: Trimming height shall match surrounding area grass heights. All areas shall be trimmed simultaneously, or immediately following mowing and before moving to another area. In all instances trimming shall be completed no later than 24 consecutive hours after mowing. Grass clippings and debris shall not be left on sidewalks, etc. overnight, even if the trimming operations are not completed. Trimming shall include the removal of sprouts and heavily weeded growth.

5.4.1. Grass and weeds shall be trimmed around trees, shrubs, buildings, fences, posts, Fire hydrants, parking lots, curbs, parking lot bumper blocks (both sides), Trimming is required around lagoon fences, structures within mowed lagoon areas and along the water’s edge of the lagoons. Trimming is required at all Campsites, fire rings, picnic tables, utilities, sidewalks, boulders, playgrounds, beaches, boat ramps and other fixed obstacles. Trimming shall include 3 feet down rip rapped areas and along rock lined ditches in all campgrounds and day use areas where the mowed area meets the water’s edge or rock lined ditch. ANTITERRORISM/OPERATION SECURITY REQUIREMENTS

The security requirements described below apply to all contract personnel (including employees of the prime

Contractor (“Contractor”) and all subcontractor employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements. Questions regarding security matters shall be addressed to the designated Government representative (e.g., Contracting Officer

Representative (COR), Requiring Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)). Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and activities, and security awareness training contributes to those efforts. The Department of Defense (DoD) and Army security training requirements specified below, if applicable, are performance requirements; all applicable contract personnel shall complete initial training within 30 days of contract award or the date new contract personnel begin performance on the contract. Within five business days from the completion of training, the Contractor shall provide written documentation (e.g., email or memorandum) to the Government representative. The documentation shall include the names of contract personnel trained and which training they completed; the Contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the Government representative. Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force

Protection Condition (FPCON) measures, Random Antiterrorism Measures (commonly referred to as “RAMs”), and

Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures

-- this includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The

Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures.

All contract personnel requiring physical access to a federal installation or facility shall comply with the access control procedures of that location. Contract personnel requiring unescorted access to meet contract performance requirements on a DoD installation in the US shall be vetted by the installation/facility Provost Marshal/Directorate of Emergency Services/Security Office using the National Crime Information Center- Interstate Identification Index

(commonly referred to as “NCIC-III”) and Terrorist Screening Database (commonly referred to as “TSDB”).

Contract personnel shall comply with all personal identity verification requirements specified in installation/facility policies and procedures. Contract personnel who do not meet requirements for unescorted access to USACE facilities shall coordinate escorted access with the Government representative, as needed. Contract personnel who receive keys, access cards, or lock combinations that provide access to government-owned property shall comply with key and lock control procedures of the RA.

All contract personnel shall receive initial and annual refresher training from the RA representative on the local suspicious activity reporting program. This locally developed training provides contract personnel with general information on suspicious behavior, and guidance on reporting suspicious activity to the project manager, security representative or law enforcement entity.

Contractors shall comply with the requirements set forth in FAR clause 52.222-54 Employment Eligibility

Verification and FAR Subpart 22.18 in using the E-Verify Program at (https://www.e-verify.gov/) (website subject to change) to meet the contract employment eligibility requirements. Contractors are encouraged to cooperate with

Federal and State agencies responsible for enforcing labor requirements to include eligibility for employment under

United States immigration laws in accordance with FAR 22.102-1(i). An initial list of verified/eligible candidates shall be provided to the COR no later than three business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, and submit it to the Contracting Officer to become part of the official contract file.

Per the E-Verify Website the following exemptions apply:

Employers whose contracts are exempt from the E-Verify federal Contractor rule are not required to enroll in E-

Verify. A contract is considered exempt if any one of the following applies: (1) It is for fewer than 120 days. (2) It is valued at less than $250,000, the simplified acquisition threshold (Source: http://www.uscis.gov/e-verify/federal-Contractors/exemptions-and-exceptions).
