PERFORMANCE WORK STATEMENT

PERFORMANCE WORK STATEMENT

MOWING SERVICES

PERRY PROJECT

1. General Information

1.1. Background: Perry Lake is typical of northern Kansas, which consists of rolling uplands, eroded valleys of varying widths and meandering streams. The valley along the Delaware River is formed by irregular hills with slopes ranging from fairly gentle to steep. The steep slopes are usually covered in native woodlands.

Gentle slopes prevail in the upper valley of the main river and along tributary arms and are generally tillable.

A very noticeable quality of Perry Lake is its diverse habitats and environment. Traveling through one park may evoke impressions of the Missouri Ozarks while moments later; another area will possess characteristics of a prairie environment found in central Kansas. The rolling geography and wooded roadside provide scenic drives through some of the park areas. Most of the shorelines are enshrouded with woodlands and shrubs that partially obscure scenic views of the lake.

The Kansas River basin has a drainage area of approximately 1,117 square miles of total area above the dam. There are 39,338.47 acres of fee land and 3,449.24 acres of flowage easement, with 1,187.58 in Atchison County and 2,261.66 acres in Jefferson County for a total acquisition of 42,787.71 acres. The lake has 11,631 acres of surface area and 159 miles of shoreline at multipurpose pool.

The Corps of Engineers has primary responsibility for the lake operations, wildlife management, Federal Parks, lands outside public areas, shoreline management and numerous other aspects of management of Perry Lake. The Corps of Engineers also provides some assistance, whenever feasible, with the hunting, fisheries management and enforcement of safe boating regulations.

Perry Dam is located 3 miles north of Perry, Kansas in Jefferson County and at mile 5.3 of the Delaware River in the northeast portion of the state. It is situated within 50 miles of one-third of the state’s population. Three of the state’s four metropolitan areas are in close proximity to the lake: Topeka, Kansas City, and Lawrence. Due to the lake’s proximity to these population areas, the lake will continue to receive high use.

1.2. Scope of Work: The Contractor shall provide all manpower, equipment, fuel, tools, supervision and other items and services necessary to provide mowing and trimming of public use areas and a designated portion of the back slope of Perry Dam for the U. S. Army Corps of Engineers, Perry Lake Project, as described in the attached performance work statement (PWS) and elsewhere in the contract.

1.3. Post-Award Conference: After award, but prior to commencement of work, the Contractor shall contact the Contracting Officer’s Representative, to arrange a mutually agreeable time to meet at the Perry Project Office to review the requirements and details of the work.

1.4. Required Insurance: The Contractor shall provide and maintain during the entire performance of this contract, at least the kinds and minimum amounts of insurance required in the table below. Before commencing work under this contract, the Contractor shall present to the Contracting Officer proof of the required insurance.

REQUIRED INSURANCE SCHEDULE

Type Amount Worker’s Compensation Coverage complying with applicable state statute Employer’s Liability Minimum amount of $100,000 General Liability on Comprehensive Form of Policy

Minimum limits for $200,000 per person and $500,000 per occurrence for bodily injury, and $20,000 per occurrence for property damage.

Coverages required above are minimums. If State Statute requires higher limits of coverage, the Contractor shall be responsible for obtaining such additional coverage. 1.5. Quality Control

1.5.1. The Contractor will develop a Quality Control Plan designed to demonstrate how the Contractor will meet the needs of the project. The Quality Control Plan will document how well the Contractor is meeting these needs and will be submitted for approval prior to work on this contract. The contractor must provide and maintain an inspection system acceptable to the government covering the services under this contract. Complete records of all inspection work performed by the contractor must be maintained and made available to the government during contract performance.

1.5.2. The Contractor shall designate, in writing, a responsible on-site representative of each work crew who shall serve as a contact for matters involving quality, performance or non-performance of the required work assigned to that crew. The representative shall have the authority to correct non-performance. The Contracting Officer may disapprove any individual whom he considers to be incompetent to perform the work required. Such disapproval will be given to the Contractor by written notice, and the Contracting Officer’s decision shall represent a final decision.

1.5.3. The Contractor shall furnish to the Contracting Officers Representative (COR), a telephone number attended during normal business hours (7:30 a.m. – 4:00 p.m., CST) to which calls concerning performance or other contractual matters can be placed. For the purpose of time and date, a message will be deemed delivered to the Contractor, at such time as it is delivered to the number provided by the Contractor.

1.5.4. As each item of work is completed, the Contractor's representative at the job site shall enter the time that the item of work was completed on a Contractor's Daily Worksheet. Completed and signed worksheets shall be delivered each day work is performed, as directed by the Contracting Officer's Representative. The Government shall furnish contractor Daily Worksheet forms.

1.6. Quality Assurance Surveillance Plan

1.6.1. A Quality Assurance Surveillance Plan (QASP) will be used during the life of the contract to ensure that the Contractor is performing the services required by this PWS in an acceptable manner. The Government develops the QASP and the Project Office administers the Plan through Quality Assurance Evaluators (QAE)s.

1.6.2. The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The government shall perform inspections and tests in a manner that shall not unduly delay the work.

1.6.3. In the event that an area is missed, or is not mowed, trimmed, or has not had grass or debris removed as specified, the Contractor agrees to return and re-perform the unsatisfactory or missed services immediately upon receipt of notice form the Contracting Officer or his Authorized Representative.

1.6.4. If any of the services do not conform to contract requirements, the government may require the

Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by re-performance, the government may (1) require the Contractor to take necessary action to ensure that future performance conforms to contract requirements and (2) reduce the contract price to reflect the reduced value of the services performed. Payment will not be made for work not performed or not performed to standard.

1.6.5. The Government reserves the right to obtain services performed by a third party or Government personnel for non-compliance of requested re-performance. The cost incurred by the Government will be levied against the Contractor. Any time Government personnel are used because of Contractor's nonperformance, the cost levied against the Contractor will include all direct costs associated with the performance of the specified work. The direct cost to the Government for substitution of the Government personnel removed from their normal duties is computed on an hourly basis at the applicable wage rate.

1.7. Scheduling of Services

1.7.1. Individual requests for required services will be issued by telephone to the Contractor or his responsible individual and followed by confirmation in writing from the Contracting Officer or the Contracting Officer’s Representative. Telephone orders will be considered issued at such time as it is delivered to the telephone number provided by the Contractor. The Contractor shall commence the ordered service(s) within 48 consecutive hours after receipt of verbal telephone order or date specified in the order (whichever is first) and complete the work in the time specified. The time allowed to complete the required services shall begin either as soon as the Contractor begins the mowing and trimming services, or at the end of the 48 consecutive hours after receipt of the order, whichever occurs first.

1.7.2. In the event adverse weather or ground conditions occur after placement of an order for services that would create unsafe working conditions or result in damage to vegetation or turf, the Contractor shall cease operations and contact project personnel. Work affected by adverse conditions shall be stopped, restarted, or rescheduled at a mutually agreed upon time, to the extent possible. Payment will not be made for work not performed as a result of wet weather conditions unless an alternate date for services can be arranged, and services are performed.

1.7.3. The Government will order only complete mowings, to include but not limited to mowing, trimming of parks, roadways, lagoons, trails and other designated areas.

If the material is suitable for a campfire the limb/stick/debris may be placed at or near the fire ring at the nearest campsite.

Excessive material from storms or flooding events will be reported to the COR to determine if the limb/sticks/debris will need to be moved by Corps of Engineers personnel.

5.1.6. Soft spots or muddy areas within the mowed areas that are not associated with weather conditions and are suspected water leaks shall be reported to the COR immediately.

5.2. Mowing

5.2.1. Mowing operations shall not cause rutting or otherwise disturb existing turf. Tractors shall be operated in such a manner as to protect against the sod being torn by the tractor wheels on turns.

Mowing is not permitted when the ground is so wet that operations cause rutting or otherwise disturbs existing turf.

5.2.2. All mowers (large and small) shall be compatible with each other in mowing height and appearance of cut grass. After mowing, areas serviced under this contract shall present a neat, well-cared-for evenly mowed appearance, free from ruts, un-mowed strips, streaks, or scalping. Tractors shall be operated in such a manner as to protect against the sod being torn by the tractor wheels on turns.

5.2.3. The Government will advise the contractor on the height of the cut, which will be between 3 and 5 inches. The Government reserves the right to designate the starting point (area or items to be mowed first) when ordering services under this contract.

5.2.4. Some of the mowing areas consist of rocky terrain and heavily wooded areas, and will require an extensive amount of trimming and hand mowing where larger mowers cannot maneuver satisfactorily.

5.2.5. The contractor will be required to pick up all shredded debris that is created by mowing over any trash.

5.2.6. The Contracting Officers Representative will provide the contractor with locations that equipment can be parked during a scheduled mowing. All equipment will be removed from public lands within 24 hours of a completion of a scheduled mowing.

5.2.7. Roadsides/road edges as indicated with a red line on the maps will be mowed to the tree line (base of trees), if a tree line is not present the contractor will mow 15 feet from the road edge as measured on the ground with a wheel type measuring device. In many areas this will include mowing one or both sides of a ditch.

5.3. Trimming

5.3.1. Trimming is required in all areas. Grass and weeds shall be trimmed around trees, shrubs, buildings, fences, poles, posts, parking lots, curbs, parking lot bumper blocks (both sides), sidewalks, boulders, playgrounds, beaches, boat ramps and other fixed obstacles. The curbing at all boat ramps shall be trimmed to include five (5) feet down the riprap slope. In addition, on the first mowing ordered in the spring, vegetation in riprap areas surrounding boat ramps and boat ramp parking lots shall be trimmed for a distance of 5 feet down the riprap slope from the field side edge.

5.3.2. Trimming height shall match surrounding area grass heights. All areas shall be trimmed simultaneously, or immediately following mowing, and in all instances shall be completed no later than 48 consecutive hours after mowing.

5.3.3. Immediately following trimming, the Contractor shall remove grass clippings or debris deposited as a result of mowing and trimming operations from all sidewalks, entrances into buildings, and building interiors. If trimming is not completed in the same day as the mowing, the Contractor shall remove grass clippings or debris deposited as a result of mowing operations from all sidewalks, entrances into buildings, and building interiors. Grass clippings and debris shall not be left on sidewalks, etc.

overnight, even if the trimming operations are not completed.

5.3.4. Trimming shall include the removal of sprouts and heavily weeded growth.

5.3.5. Immediately following trimming sidewalks, entrances into buildings, and building interiors shall be swept as needed to remove clippings.

ANTITERRORISM/OPSEC

ANTITERRORISM/OPERATIONS SERCURITY REQUIREMENT

The security requirements described below apply to all contract personnel (including employees of the prime Contractor (“Contractor”) and all subcontractor employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements. Questions regarding security matters shall be addressed to the designated Government representative (e.g., Contracting Officer Representative (COR), Requiring Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)). Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and activities, and security awareness training contributes to those efforts. The Department of Defense (DoD) and Army security training requirements specified below, if applicable, are performance requirements; all applicable contract personnel shall complete initial training within 30 days of contract award or the date new contract personnel begin performance on the contract. Within five business days from the completion of training, the Contractor shall provide written documentation (e.g., email or memorandum) to the Government representative. The documentation shall include the names of contract personnel trained and which training they completed; the Contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the Government representative. Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (commonly referred to as “RAMs”), and Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures --this includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures.

All contract personnel requiring physical access to a federal installation or facility shall comply with the access control procedures of that location. Contract personnel requiring unescorted access to meet contract performance requirements on a DoD installation in the US shall be vetted by the installation/facility Provost Marshal/Directorate of Emergency Services/Security Office using the National Crime Information Center-Interstate Identification Index (commonly referred to as “NCIC-III”) and Terrorist Screening Database (commonly referred to as “TSDB”).

Contract personnel shall comply with all personal identity verification requirements specified in installation/facility policies and procedures. Contract personnel who do not meet requirements for unescorted access to USACE facilities shall coordinate escorted access with the Government representative, as needed. Contract personnel who receive keys, access cards, or lock combinations that provide access to government-owned property shall comply with key and lock control procedures of the RA.

All contract personnel shall receive initial and annual refresher training from the RA representative on the local suspicious activity reporting program. This locally developed training provides contract personnel with general information on suspicious behavior, and guidance on reporting suspicious activity to the project manager, security representative or law enforcement entity.

Contractors shall comply with the requirements set forth in FAR clause 52.222-54 Employment Eligibility Verification and FAR Subpart 22.18 in using the E-Verify Program at (https://www.e-verify.gov/) (website subject to change) to meet the contract employment eligibility requirements. Contractors are encouraged to cooperate with Federal and State agencies responsible for enforcing labor requirements to include eligibility for employment under United States immigration laws in accordance with FAR 22.102-1(i). An initial list of verified/eligible candidates shall be provided to the COR no later than three business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, and submit it to the Contracting Officer to become part of the official contract file.
