PERFORMANCE WORK STATEMENT

PERFORMANCE WORK STATEMENT

Herbicide Application Services

WILSON LAKE PROJECT, KS

C.1 General Information

C.1.1 Background: Wilson Lake, located on the Saline River, controls a drainage area of 1,917 square miles. The grassland drainage basin above Wilson makes it one of the clearest lakes in Kansas. With 9,000 acres of water and 100 miles of shoreline, it is a popular recreation area.

During periods of heavy rain the lake increases in size, as runoff is stored, providing downstream flood protection. Recreation, fish and wildlife enhancement, and water quality also are benefits of the lake. To get to Wilson Lake, from I-70 take exit 206 north on Highway 232 for nine miles.

C.1.1.1 Scope of Work: The contractor shall provide herbicide application services to areas at various locations at Wilson Lake as defined in this performance work statement (PWS). The Contractor shall comply with all Federal, state, and local laws, ordinances, statutes and regulations pertaining to the provided services.

C1.1.2 SITE VISITS: It is highly recommended that a site visit be made prior to submitting a bid. To schedule a site visit, contact the Wilson Project Office at (785) 658-2551.

C.1.2 Contractor Personnel

C.1.2.1 Contractor Employees. The contractor shall not employ persons for work on this contract if such employee is identified to the contractor by the contracting officer as a potential threat to the health, safety, security, general well being, or operation mission of the installation and its population.

C.1.2.2 Contractor personnel shall present a clean appearance and be easily recognized as contractor employees.

C.1.2.3 While on duty, the contractor’s employees shall utilize proper safety equipment to include eye protection, hearing protection, head protection (to include hard hat when appropriate) and proper foot wear which is defined as work boots (sandals or open shoes are prohibited).

C.1.2.4 The contractor shall make sure that employees have valid driver licenses before starting work under this contract.

C.1.2.5 All Contractor personnel shall be fully clothed at all times while performing these services. “Fully clothed” shall be deemed to mean that a shirt (or T-shirt), trousers and shoes shall be worn at all times, except that this requirement shall not be construed to replace or eliminate the necessity for the wearing of appropriate protective clothing. Clothing shall be clean and neat in appearance.

C.1.2.6 Contractor personnel shall utilize tact, diplomacy and courtesy at all times during contact with the public.

C.1.3. Post-Award Conference: After award, but prior to commencement of work, the Contractor shall contact the Contracting Officer Representative (COR) to arrange a mutually agreeable time to meet at the Project Office for the purpose of discussing and developing a mutual understanding of the requirements and details of the work.

C.1.4. DOCUMENTS AND CORRESPONDENCE: After award, all documents and related correspondence shall be addressed to the COR at the Project Office.

C.1.5 Quality Assurance

C.1.5.1 The Contractor shall submit, in writing, for approval of the COR at the project, a detailed plan of operation to include equipment and personnel.

C.1.5.2 Quality Assurance Surveillance Plan. A Quality Assurance Surveillance Plan (QASP) will be used during the life of the contract to ensure that the Contractor is performing the services required by this PWS in an acceptable manner. The Government reserves the right to alter or change the Plan at its own discretion. The Government develops the QASP and the Project Office administers the Plan through Quality Assurance Evaluators (QAE)s.

C.1.5.3 If it becomes apparent to the Government during the Contractor's performance that the required services may not be completed within the time frames required herein, the Contracting Officer may require the Contractor to submit a written plan demonstrating how the Contractor will meet the schedule. Such direction will be issued to insure that required services will be completed within the time frames specified.

C.1.6 Quality Control

C.1.6.1 The Contractor shall designate, in writing, a member of each work crew who shall serve as the contact for matters involving quality and performance or non-performance of the required work assigned to that crew. The designated employee(s) shall be qualified with full authority to act for, and on behalf of, the Contractor as necessary to ensure that the work described herein is performed in accordance with these specifications. The Contractor shall furnish the above written designation to the COR at the project no later than the first day of work. The designation shall include the name(s), address(es), and telephone number(s) of the responsible individuals(s).

The COR reserves the right to disapprove any individual whom he considers to be incompetent to perform the work required. Such disapproval will be given to the Contractor by written notice, and the COR's decision shall represent a final decision.

C.1.6.2 The Contractor shall furnish to the COR, a telephone number attended during normal business hours (7:30 a.m. – 4:00 p.m. C.S.T.) to which calls concerning performance or other contractual matters can be placed. For the purpose of time and date, a message will be deemed delivered to the Contractor, at such time as it is delivered to the number provided by the Contractor.

C.1.6.3 The contractor is responsible for any damage done to project features or facilities and will be required to repair or replace them to the satisfaction of the government.

C.1.7 In the event of unsatisfactory performance of specified work, the Contractor may be requested to re-perform the unsatisfactory services at no additional cost to the Government.

Failure of the Contractor to perform the work will result in withholding of payment for the portion(s) of the work not accomplished. Amounts to be withheld for work not performed or not performed to standard will be determined by prorating the amount of services satisfactorily performed against the amount of services required.

C.1.8 The Government reserves the right to cause the specified unsatisfactory work to be performed by a third party or Government personnel. The cost incurred thereby will be levied against the Contractor. Any time Government personnel are used because of Contractor's nonperformance, the cost levied against the Contractor will include all direct costs associated with the performance of the specified. Such inefficiencies are determined as the direct cost to the Government for substitution of the Government personnel removed from their normal duties computed on an hourly basis at the applicable wage rate. Government personnel will be used only when time is of the essence and the interests of the Government would not be served by securing a third party to perform the specified work.

C.1.9 LOST ARTICLES, VANDALISM, FACILITIES MALFUNCTION: To assist the visiting public in reclaiming lost articles, all property left by visitors and found during operations shall be turned in daily to the project office where it may be claimed by the owner. Any evidence of vandalism and instances where facilities are not operating properly or are in need of repair shall be reported to Project personnel.

C.1.10 The Contractor or his designated employee(s) shall meet with the COR at the Project Office before beginning work, to coordinate his work schedule in compliance with the specifications and to arrange a satisfactory operating agreement.

C.1.11 PERIOD OF REQUIRED SERVICES: Services shall be performed in accordance with the following schedule, between the hours of 7 a.m. and 8 p.m. for the service period of 1 April through 30 September.

C.1.11.1 Work will not be permitted on Saturdays, Sundays, or Holidays, and shall not begin prior to 7 a.m., nor continue after 8 p.m., unless this restriction is specifically waived in writing by the Contracting Officer or his authorized representative.

C.1.11.2 All work shall be accomplished within the timeframes specified above. Services rendered outside the time periods specified will not be compensated unless specifically approved in writing by the Contracting Officer or his authorized representative.

C.1.11.3 In the event adverse weather or ground conditions occur during scheduled services that would create unsafe working conditions or result in damage to vegetation or turf, the Contractor shall cease operations and contact project personnel. Work affected by adverse conditions shall be stopped, restarted, or rescheduled as directed by the Contracting Officer or his authorized representative. Rescheduled work shall be accomplished at a mutually agreed upon time, to the extent possible.

C1.11.5 This is a flood control project. Occasional retention of floodwaters may inundate portions of the public use areas, other areas, or access roads thereto, being serviced by this contract. In the event that inundation materially affects the scope of work, the Contractor will be requested to submit a pricing proposal covering the unserviceable or affected portion of his work in order that an equitable adjustment to contract price can be negotiated and an adjustment made in accordance with the appropriate contract clause entitled "Changes." Payment for services not performed as a result of conditions stated above will be initially withheld until execution of an equitable adjustment can be made by contract modification.

C.1.12 General Safety requirements: In order to provide safety controls for protection to the life and health of employees and other persons; for the prevention of damage to property, materials, supplies, and equipment; and for the avoidance of work interruptions in the performance of this contract, the contractor shall comply with all pertinent provisions of Federal, state, and local regulations and shall take or cause to be taken such additional measures as the Contracting Officer may determine to be reasonable and necessary for the purpose.

C.1.12.1 Contractor vehicles shall be equipped with 4-way flashers and turn signals in operating condition. Flashers shall be activated when vehicles are parked on, or traveling slowly along roadways.

C.1.12.2 Any injury, property damage, equipment malfunction or safety hazard observed by the Contractor shall be immediately reported to Project personnel.

C.1.13.1 The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the government's interest shall not be effective (1) for such period as the laws of the State in which this contract is to be performed prescribe, or (2) until 30 days after the insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer.

C.1.13.2 The Contractor shall insert the substance of this clause in subcontracts under this contract that required work on a Government installation and shall require subcontractors to provide and maintain the insurance required in the Schedule or elsewhere in the contract. The Contractor shall maintain a copy of all subcontractors proofs of required insurance, and shall make copies available to the Contracting Officer upon request.

"Service contract" means a contract that directly engages the time and effort of a contractor whose primary purpose is to perform an identifiable task rather than to furnish an end item of supply. A service contract may cover services performed by either professional or nonprofessional personnel whether on an individual or organizational basis. Some of the areas in which service contracts are found include the following:

Maintenance, overhaul, repair, servicing, rehabilitation, salvage, modernization, or modification of supplies, systems, or equipment.

(b) Routine recurring maintenance of real property.

(c) Housekeeping and base services.

(d) Operation of Government-owned equipment facilities, and systems.

"Shall" means the imperative. A task that must be complied with or performed.

C.3 Government-Furnished Supplies and Facilities:

C.3.1 The Government may designate an area for the temporary overnight storage of equipment.

All equipment must be stored off government property when not in use in the performance of the contract unless approved by the COR.

C.3.2 Maps of the areas to be sprayed.

C.4 Contractor furnished Supplies and Equipment: The Contractor shall furnish all equipment and supplies necessary to perform these requirements not identified in section C.3 of this PWS as Government-Furnished supplies or facilities and as specifically identified in this section. All contractor-furnished equipment and supplies must be approved by the COR prior to initial use.

C.4.1 The Contractor shall furnish all manpower, equipment, fuel, tools, and supplies necessary to accomplish the services specified herein.

C.4.4 All equipment shall be approved by the Project Manager prior to initial use.

C.4.5 NOTE: Equipment breakdown shall not relieve the Contractor of the responsibility of performing the work as specified. It shall be the responsibility of the Contractor to assure that he has, or can obtain on short notice, sufficient backup equipment to continue the services as specified without interruption in the event of mechanical failure of his primary equipment.

C.5 Specific Tasks: The following work shall be accomplished:

C.5.1 Apply herbicide to all areas listed under Herbicide Application sites. In most cases, the result should be a clean, vegetation free area. Some areas involve the control of certain species (ie woody vegetation). In those areas, it will be the Contractor’s responsibility to insure that the target species are all that are killed.

C.5.2 The Contractor will be responsible for selecting the appropriate chemical to be used based on site location, proximity to the public, environmental concerns, target species and best commercial practices. Information will be provided to the government regarding the chemical(s) to be used prior to application. The COR must approve all chemicals that will be used during this contract. The contractor will provide MSDS sheets (Material Safety Data Sheets) and product labels for all chemicals used on government property. Biodegradable dye will be used as a marker to insure even applications.

C.5.3 The Contractor will guarantee at least a 99% vegetation free control 100% of the time of all serviced areas during the growing season (April through September). Should the level of control fall below 99%, the contractor will be responsible for the re-treatment of the subject area(s) to achieve the desired result at no additional cost to the government. In order to maintain this level of vegetation control, the contractor will be required to make at least one Quality Control visit each month to insure that the desired results are being achieved. Payment will not be made until this level of control is accomplished.

C.5.4 The contractors monthly herbicide treatment will be conducted between the 1st and 15th of each month. The monthly Quality Control visit will be conducted between the 15th and 30th of each month. The monthly Quality Control visit can occur no less than 7 days from the date of the initial monthly treatment.

C.5.4 All contractor personnel applying herbicide shall be appropriately trained and licensed.

Copies of all licenses and certifications will be provided to the government prior to the start of work. Appropriate insurance will also be in place and documentation provided prior to the start of work.

C.5.5 The serviced areas will present a neat, even kill of all target species. Spray patterns will provide an even border between treated and untreated areas. A 1 foot (approx.) vegetation free border will be left around all hard-surfaced or rocked facilities (ie campsites, parking lots, riprap, curbing etc.).

C.5.6 Work will not be done on days when the wind exceeds 10 mph in developed areas (15 mph in undeveloped areas) or when wet weather could effect the application.

C.5.7 The government will provide water for tank filling. The Contractor will provide hoses and backflow-preventers. Clean-out of chemical tanks and disposal of chemical containers will not be done on government property. The Contractor will have spill kits available on all vehicles used on government property adequate to the type and quantity of chemical on the vehicle.

Contractor employees will be trained in the use of these kits and are expected to aggressively implement their use in the event of a spill.

C.5.8 The Contractor will be responsible for any damage to non-target species.

C.5.9 The Contractor will complete a herbicide application report form (furnished by the government) after each chemical application whether initial or follow-up. Payment will not be made until the completed forms are provided.

C.5.10 The use of aerial spraying will not be permitted in any of the areas serviced under this contract.

C.6 Payment All invoices should be submitted promptly upon completion of work.
