ATTACHMENT 3 - FAR 52.212-2
ATTACHMENT 3 - ADDENDUM TO 52.212-2
A. Basis of Award. The request for quotations uses streamlined simplified acquisition procedures pursuant to FAR Subpart 12.6 and FAR Part 13.5. The Government intends to award a Firm Fixed Price Purchase Order Contract resulting from this solicitation to the responsible offer whose offer conforms to the solicitation, meets the specifications of the Performance Work Statement, and will be the most advantageous to the Government, price and other factors are considered. Basis for award will be to the offeror providing the lowest quote determined to meet the minimum requirements. Responsibility determination will be conducted on apparent successful offeror only.
The following factors shall be used to evaluate vendors:
Factor 1 – Technical Capability Subfactor 1 – Elevator Repair Plan Subfactor 2 – Elevator Mechanic & Inspector Qualification Subfactor 3 – Price List
Factor 2 – Recent & Relevant Work Experience
Factor 3 – Price
Past performance will not be formally evaluated but will be reviewed during the responsibility determination. The Government reserves the right to seek past performance information by any means available, including, but not limited to, Contractor Performance Assessment Reporting System (CPARS), Past Performance Information Retrieval System (PPIRS) and Federal Awardee Performance & Integrity Information Systems (FAPIIS) as well any other Government-sponsored information available may be utilized to help make a responsibility determination in accordance with FAR Subpart 9.104.
As set forth in FAR 52.212-1, the Government intends to evaluate quotes and award a contract without discussion with vendors. Therefore, the Vendor’s initial offer should contain the
Vendor’s best terms from a price and technical standpoint. If competitive quotes are not received, the Government reserves the right to utilize other methods identified in the FAR to determine price reasonableness.
B. Evaluation Criteria.
1. Factor 1 – Technical Capability
The purpose of the technical factor is to assess whether the offeror’s proposal will satisfy the Government’s minimum requirements. Technical capability will be rated as “pass” or “fail”.
Overall, the technical quotation must reflect a clear understanding of the contractor’s objectives, operating environment, and the demands and constraints of the requirement.
Vendor’s technical approach shall address whether subcontracting any effort, the approach to accomplish the required services and obtain parts. The technical approach shall address the following subfactors as a minimum:
(a) Subfactor 1 – Elevator Repair Plan.
(b) Subfactor 2 – Elevator Mechanic & Inspector Qualification.
(c) Subfactor 3 – Price List.
2. Factor 2 – Recent & Relevant Work Experience
Work experience will be evaluated for recency and relevancy and provided a confidence rating. Limit of five (5) work experiences to be provided. If an offer provides additional work experiences, only the first five (5) work experiences will be evaluated.
3. Factor 3 – Price
Price is not formally scored or rated and should be provided on the Standard Form (SF) 1449. The Government expects competitive quotes to be submitted for this procurement and will use these competitive quotes to determine if the price is fair and reasonable in accordance with FAR 13.106-2. The lowest price quote acceptable for award purposes will be the combined total of all CLINs. The price quote (SF1449) shall include a unit price for each item and a total firm-fixed-price for CLIN 0001. The total firm-fixed-price shall be all inclusive for the inspection and assessment services (include all applicable taxes, labor, and equipment costs).
(a) Completeness. Each offeror is required to provide complete pricing for each contract line identified.
(b) Unbalanced Pricing. The offeror shall ensure the pricing of contract line items are not significantly over or understated, which may increase performance risk or result in unreasonably high prices.
(c) Price Reasonableness. The offeror shall ensure price should reflect fair market value and be reasonable when compared to the independent Government estimate and current market prices for same or similar services.
The Government will evaluate recent and relevant work experience, beginning with the lowest priced quote, by reviewing the required references to determine the degree to which work experience contains a recent and relevant project at a size and scope similar to this effort within the past three years from date of the RFQ. Recent and relevant work experience will be utilized to determine the quality of the offeror’s experience as it relates to the probability of success of the required effort. Due to the wide variety of work experience history of individual offerors, the Government is not required to ensure that an equal number of references be obtained for each offeror. In the case of an offeror without a record of recent and relevant work experience or for whom information on work experience is not available or so sparse that no meaningful work experience rating can be reasonably assigned, the offeror shall be determined to have unknown (or “neutral”) work experience.
The Government intends to make an award based on whether the lowest priced of the quotations or offers having the highest recent and relevant work experience rating possible represents the best value when compared to any lower priced quotation or offer.
For example, a higher priced offer that has extensive (i.e. all five experiences are both recent and relevant) recent and relevant work experience may be considered more favorable than a lower priced offer with little to no experience.
