52.204-18 COMMERCIAL AND GOVERNMENT ENTITY CODE MAINTENANCE (AUG 2020)

(a) Definition. As used in this clause--

Commercial and Government Entity (CAGE) code means--

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity by unique location; or

(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as a NATO CAGE (NCAGE) code.

(b) Contractors shall ensure that the CAGE code is maintained throughout the life of the contract for each location of contract, including subcontract, performance. For contractors registered in the System for Award Management (SAM), the DLA Commercial and Government Entity (CAGE) Branch shall only modify data received from SAM in the CAGE master file if the contractor initiates those changes via update of its SAM registration. Contractors undergoing a novation or change-of-name agreement shall notify the contracting officer in accordance with subpart

42.12. The contractor shall communicate any change to the CAGE code to the contracting officer within 30 days after the change, so that a modification can be issued to update the CAGE code on the contract.

(c) Contractors located in the United States or its outlying areas that are not registered in SAM shall submit written change requests to the DLA Commercial and Government Entity (CAGE) Branch. Requests for changes shall be provided at https://cage.dla.mil. Change requests to the CAGE master file are accepted from the entity identified by the code.

(d) Contractors located outside the United States and its outlying areas that are not registered in SAM shall contact the appropriate National Codification Bureau (points of contact available at http://www.nato.int/structur/AC/135/main/links/contacts.htm) or NSPA at https://eportal.nspa.nato.int/AC135Public/scage/CageList.aspx to request CAGE changes.

(e) Additional guidance for maintaining CAGE codes is available at https://cage.dla.mil.

(f) If the contract includes Federal Acquisition Regulation clause 52.204-2, Security Requirements, the contractor shall ensure that subcontractors maintain their CAGE code(s) throughout the life of the contract.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

SEE ADDITIONAL INSTRUCTIONS AND INFORMATION BELOW

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

ADDITIONAL INSTRUCTIONS AND INFORMATION:

A. Basis of Award. This Request for Quotation (RFQ) uses streamlined simplified acquisition procedures pursuant to FAR 12 and FAR Subpart 13.5. Basis for award will be to the contractor providing the lowest proposal determined to meet the minimum requirements. Responsibility determination will be conducted on apparent successful contractor only.

B. FACTORS TO BE EVALUATED

The following factors shall be used to evaluate offers:

Factor 1 - Performance: Subfactor (a) Past Performance Questionnaire and Subfactor (b) Work Experience Information Form Factor 2 – Price

Completed questionnaires to be e-mailed to Angela McColor at angela.u.mccolor.civ@army.mil due no later than date/time listed in Block 8 on page 1 of solicitation. Questionnaires not directly received from the experience reference will not be considered in the evaluation process.

Evaluation Criteria:

Acceptable: Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown.

Unacceptable: Based on the offeror's performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

In the case of an offeror without record of relevant past performance or for whom information on past performance is not available or that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptable/unacceptable rating or unknown, it shall be considered as acceptable.

Sub-factor (b) Work Experience. Work Experience Information Form to be completed by offeror and may provide up to three (3) reference projects of similar type and scope of work in the last three (3) consecutive years.

Acceptable: Based on the offeror's work experience form(s), the Government has a reasonable expectation of work experience of the offeror of similar type and scope of work in the last three (3) consecutive years.

Unacceptable: Based on the offeror's work experience form(s), the Government does not have a reasonable expectation of work experience of the offeror of similar type and scope of work in the last three (3) consecutive years.

FACTOR 2 - PRICE. Price will not be formally scored. The Government expects competitive proposals to be submitted for this procurement and will use these competitive proposals to determine price reasonableness in accordance with FAR 13.106-3. The lowest price proposal acceptable for award purposes will be the combined total of the base year and all option periods. The Government intends to evaluate proposals and award without discussions. Therefore, proposals should be for contractors' best pricing. If competitive proposals are not received, the Government reserves the right to utilize other methods identified in the FAR to determine price reasonableness. Each contractor is required to provide complete pricing for each contract line item identified.
