1. Maintenance Pruning - Are the trees in each Maintenance Pruning CLIN currently being maintained on a regular basis per industry standard? If so, when was the last time these trees were pruned? Does the government intend to prune these trees annually? If not, how often does the government intend on pruning these trees to keep them maintained?
The trees assigned for maintenance pruning are not being maintained on a regular basis. They are assigned per customer request or customer complaint. Only the coconuts and other palm trees are maintained/pruned on an approximate 6 mo. basis (cyclic) with consideration to budget constraints. They are listed on a technical exhibit. Trees are entirely not on a cycle. They are maintained/pruned as customer complaints are received or per project requirements.
2. Estimated Quantities - We understand that that the stated quantities for each CLIN are estimates only and that according to clause 52.216-19, the government may order items in excess of these estimates as long as the maximum dollar limits set forth in the clause are not exceeded. If an order is placed that exceeds the estimated amounts, would the contractor have an opportunity to propose a price adjustment?
We haven't encountered this type of situation ever before. Yes, the contractor will have the opportunity to propose a price adjustment that's negotiable with the government for work orders that exceed the estimated amounts.
3. Tree Removals - It is our assumption that the trees required to be removed or pruned under the contract CLINS will be easily accessible with tree equipment and vehicles. Will all trees on this contract be accessible by contractor equipment and vehicles? If not, will the government allow the contractor to add additional money to account for the additional costs associated with accessing the trees?
No, not all trees on this contract are accessible by contractor equipment and vehicles. Most tree prunings and tree removals are accessible. There may be situations where the tree(s) are not accessible by way of heavy equipment for example trees interior of the vegetation like the ranges, ammo bunkers, inaccessible fence lines, etc.. These inaccessible trees may also include the high-voltage maintenance/clearing of trees and/or trees on the hillside, which requirements are more often than not, are inaccessible by way of heavy equipment. Yes, the government will allow the contractor to add additional money to account for the additional costs associated with accessing inaccessible trees. The price has to be negotiable.
