Performance Work Statement (PWS) Hazardous Waste Testing – 10/23/19 Vision Statement Be in compliance with EPA regulations for disposition of Hazardous Waste as required.
1 Description of Services The Contractor shall provide all facilities, equipment, labor, supervision, materials, tools, and transportation necessary to sample/test, pump, package/repackage, prepare forms and transport hazardous waste in existing containers/receptacles from Army installations located on the Island of Oahu in the state of Hawaii. The predominant types of hazardous waste generated on Army installations include waste solvents, waste fuel, waste paint, waste oil, and waste acid. Testing, sampling, and transportation of samples/wastes shall be performed in accordance with U.S. Environmental Protection Agency (EPA) Regulation 40 CFR 261, Appendices II and III, SW-846, and RCRA 268.7, Hawaii Department of Health (HDOH), Department of Transportation (DOT), Defense Reutilization & Marketing Office (DRMO), Code of Federal Regulation (CFR) 40 and 49, Federal and State laws, regulations and ordinances.
1.1 Service Order
The Contracting Officers Representative (COR) or the Authorized Individual (AI) will order the work by submitting a Service Order either by email or by FAX to the Contractor (See Technical Exhibit (TE) #1 the Service Order form). The Contractor shall submit to the COR or AI a confirmation by email of receipt of the order within 24 hours of receiving the Service Order.
1.2 Prepare Forms
The Contractor shall prepare hazardous material turn-in documents to include, but not limited to the Uniform Hazardous Waste Manifest (EPA Form 8700-22 (Rev. 3-05)) (TE #2); DD FORM 1348-1A(TE #3), Land Disposal Restriction form (TE #4); and the Hazardous Waste Profile Sheet (TE # 5) (DRMS Form 1930, Oct 06). The Contractor shall prepare all documentation for all containers/receptacles to be transported to DRMO. The Contractor shall sign all forms on behalf of the Government as directed by the COR/AI (See TEs #2, & #3). The Contractor shall submit completed electronic copy of the test report within twenty-one (21) working days after receipt of Service Order.
1.3 Sampling
The Contractor shall complete all sampling within seven (7) working days after receipt of Service Order. The Contractor shall sample and test content in containers/receptacles to determine if any hazardous waste characteristics exist. The Contractor shall obtain duplicate samples from the containers/receptacles when requested by the Government.
1.3.1 Chain of Custody
The Contractor shall utilize a chain of custody procedures for all samples. The Contractor shall record all transfer of samples from one (1) person to the next. The form shall specify the samplers and others that the sample has been transferred (includes name, signature, date, time, sample description and identification).
1.3.2 Processing of Container
The Contractor shall weigh each container/receptacle as directed by the COR and AI. The Contractor shall mark each container/receptacle after sampling with a weatherproof ink to identify the containers/receptacles sampled.
1.4 Analysis of Sample
The Contractor shall complete analysis within fourteen (14) working days after sampling is conducted. The Contractor shall submit an electronic copy of the analyses report to the AI, within 21 working days after receipt of the Service Order. The contractor shall submit a hard copy of the laboratory analysis report with monthly invoice to the COR. See TE #5 for content of analysis report.
1.5 Pumping
The Contractor shall pump identified hazardous waste from the oil water separators and above ground storage tanks into new, contractor provided Performance Oriented Packaging (POP) drums/containers. All POP drums/containers shall meet the Department of Transportation (DOT) specification. The Contractor shall weigh each drum/container after pumping is completed. The Contractor shall perform pumping of the hazardous waste within three (3) working days after receipt of Service Order.
1.6 Packaging
The Contractor shall prepare all containers/receptacles to comply with U.S. EPA and DOT packing and DRMO requirements. The Contractor shall comply with the CFR for all labeling, marking of containers/receptacles and turn in documents.
1.7 Repackaging
The Contractor shall repackage any containers/receptacles necessary to comply with U.S. EPA and DOT packing and DRMO requirements. This paragraph may pertain to requirements such as pumping oil/water separators, pumping underground and aboveground storage tanks, and preventing release into the environment by leaking or damaged containers. The Contractor shall comply with the CFR for all labeling, marking of containers/receptacles and turn in documents.
1.8 Transporting
The Contractor shall transport hazardous waste containers/receptacles to Building 1526, Pearl Harbor, Island of Oahu, from various U.S. Army military installations on the Island of Oahu. The Contractor shall have an EPA Hazardous Waste Transporter number and display the proper placards on transport vehicle. The transportation of hazardous material shall be completed by the Contractor within 14 working days after receipt of Service Order.
1.8.1 Contacting of Point of Contact
The Contractor shall coordinate the transportation of hazardous waste containers/receptacles with the Transfer Accumulation Point Manager one (1) week in advance.
2.1 Non-Personal Services
The Government shall neither supervise contractor employees nor control the method by which the contractor performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual contractor employees. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services, or give the perception of personal services. If the contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the contractor's responsibility to notify the Procuring Contracting Officer (PCO) immediately.
2.2 Business Relations
The Contractor shall partner with the Government to resolve all issues and conflicts in a timely and expeditious manner.
2.3 Contract Administration and Management
The following subsections specify requirements for contract, management, and personnel administration.
2.3.1 Contract Management
The contractor shall establish clear organizational lines of authority and responsibility to ensure effective management of the resources assigned to the requirement. The contractor must maintain continuity between the support operations at Transfer Accumulation Point Manager, Bldg 6040, Schofield Barracks, East Range and the contractor's corporate offices.
2.3.2 Contract Administration
The contractor shall establish processes and assign appropriate resources to effectively administer the requirement. The contractor shall respond to Government requests for contractual actions in a timely fashion. The contractor shall have a single point of contact between the Government and Contractor personnel assigned to support contracts or Service Orders. The contractor shall assign work effort and maintaining proper and accurate time keeping records of personnel assigned to work on the requirement.
2.3.3 Personnel Administration
The contractor shall provide the following management and support as required. The contractor shall provide for employees during designated Government non-work days or other periods where Government offices are closed due to weather or security conditions. The contractor shall maintain the currency of their employees by providing initial and refresher training as required to meet the PWS requirements. The contractor shall make necessary travel arrangements for employees. The contractor shall provide necessary infrastructure to support contract tasks. The contractor shall provide administrative support to employees in a timely fashion (time keeping, leave processing, pay, emergency needs).
2.4 Subcontract Management
The contractor shall be responsible for any subcontract management necessary to integrate work performed on this requirement and shall be responsible and accountable for subcontractor performance on this requirement. The prime contractor will manage work distribution to ensure there are no Organizational Conflict of Interest (OCI) considerations. Contractors may add subcontractors to their team after approval of the Procuring Contracting Officer (PCO) or Contracting Officer Representative (COR).
2.5 Contractor Personnel, Disciplines, and Specialties
The contractor shall accomplish the assigned work by employing and utilizing qualified personnel with appropriate combinations of education, training, and experience. The contractor shall match personnel skills to the work or task with a minimum of under/over employment of resources. The contractor shall ensure the labor categories as defined in the Labor Categories document (Wage Determination No.: 2005-2153, Revision No.: 17, Date of Revision: 6/19/2013), labor rates, and man-hours utilized in the performance of each Service Order issued hereunder will be the minimum necessary to accomplish the task.
The Contractor shall provide the necessary resources and infrastructure to manage, perform, and administer the contract.
2.6 Location and Hours of Work
Accomplishment of the results contained in this PWS requires work at various Army Installations, located on the Island of Oahu and at various contractor, subcontractor, and Government facilities. Normal workdays are Monday through Friday except US Federal Holidays.
3 Special Requirements This section describes the special requirements for this effort. The following sub-sections provide details of various considerations on this effort.
3.1 Anti-Terrorism (AT) and Operational Security (OPSEC)

3.3 IWATCH Training
IWATCH within the Army is a nation-wide modern version of a neighborhood watch program focused on the threat of terrorist activity. It is an antiterrorism awareness program that the contractors' workforce, while on Army installations, must be all familiar with to promote and enhance reporting suspicious activity or behavior. The program has two elements: "passive" and "active". The passive element is an individual's situational awareness of his or her surroundings. The active element of IWATCH involves individuals taking action to report suspicious behavior or activities to law enforcement for more investigation.
Contractor personnel, to include subcontractors, performing on or within an Army controlled facility, area or on an Army installation are required to brief and train their personnel on line at IWATCH Training US Army. Contractor personnel shall train all personnel within 5 days of contract award or within 5 days of hiring action. Contractors shall report all completed training to the COR within 7 days of contract award or hiring action.
3.4 Contractor Manpower Reporting (CMR).
The Office of the Assistant Secretary of the Army (Manpower & Reserve Affairs) operates and maintains a secure Army data collection site where the contractor will report ALL contractor manpower (including subcontractor manpower) required for performance of this contract. The contractor shall complete all the information in the format using the following web address. https://crma.army.mil The reporting period is the period of performance not to exceed 12 months ending September 30 of each government fiscal year. The data must be reported by 31 October of each year. Contractors may use a direct XML data transfer to the database server or fill in the fields on the website. The XML direct transfer is a format for transferring files from a contractors system to the secure web site without the need for separate data entries for each required data element at the website. The specific formats for the XML direct transfer may be downloaded from the web site
