QUESTIONS AND ANSWERS

Questions and Answers Range Grounds Maintenance

1. Question: Is this a follow-on requirement? If so, who is the incumbent?

Response: This is a new DPW contract. It is a combination of several requirements some of which were performed under contracts issued by another agency. Contracts awarded by RCO-HI were issued to REK Associates LLC, Nugate Group LLC.

2. Question: Request extension of the solicitation closing date by two weeks.

Response: See Amendment 0004.

3. Will revised drawings/maps depicting actual Areas of Responsibility be provided for all areas?

Response: Yes. See revised Exhibits.

4. Question: Will the Government revise “from center of road ten feet out on both sides” to “ten feet from outer edge of both sides” on all roads? Also please confirm that only grass cutting is required and not tree trimming or clearing of sides of the roads.

Response: No. “center of road ten feet out on both sides” remains. See revised PWS.

5. Question: CLIN 0001 SBMR PWS Para 3.1 Specify cutback height of brush, especially for those instances where there is overhanging brush or small trees.

Response: See revised PWS. Paragraph re-numbered to 3.2.

6. Question: Will the Government consider increasing frequency of the cuts considering range accessibility, constant training schedule changes?

Response: See revised TE #4, pricing sheet and SF1449.

7. Question: Will a 2nd DZ be included in updated drawings?

Response: Yes. See revised PWS.

8. Question: Will frequency of cuts be revised (suggest 6X per year) due to DZ height requirements?

Response: Yes. See revised PWS.

9. Question: CLIN 0003 Drum Road/Poamoho Bypass PWS Para 3.4 Nearly 75% of the road has heavy overhang. Would the Government add cutback and height requirement in these areas?

Response: Yes. See revised PWS.

10. Question: Firing ranges or training grounds are very schedule sensitive. How accessible will this bypass road be i.e., daily, monthly, semi-annual, pre-scheduled, etc?

Response: The range has a monthly stand down time for maintenance. Contractor will work with range control for scheduled maintenance.

11. Question: There seems to be a discrepancy in the number of acres (19 miles = 27 acres). Please review.

19 miles x 20 ft (10 ft out on both sides) should be 46 acres. See computation below.

19 miles x 5,280 LF (mile) – 100,320 LF 100, 320 LF x 20 FT (width) – 2,006,400 SF 2,006,400 SF / 43,560 SF (acre) – 46.06 acres

46.06 acres x 2 services = 92 acres

Response: See revised TE #4.

12. Question: CLIN 0005 Kahuku Training Area (KTA) Drop Zone PWS Para 3.5. Would the Government consider increasing the frequency of cuts to six times per year due to DZ height requirements?

Response: See revised TE #4, pricing sheet and SF1449.

13. Question: CLIN 0008 PMR. PWS Para 3.7.15 is not included in the CLIN description. Please clarify.

Response: Paragraph added to CLIN description. See revised Schedule B of the SF1449.

14. Question: CLIN 0008 PMR. Please clarify whether the frequency of cuts is monthly or 2x per month. The total number of acres correspond to 2x cut per month. However, the description indicates monthly.

15. Question: PWS Para 3.7.15. Would the government define and revise verbiage on Para 3.7.15 to include having one monitor per crew in multiple crew situations? Also, recommend allowing “competent persons” (Government to define what would be considered as a “competent person”) as additional safety monitors when in multiple crew situations.

Response: Contractor will make that determination.

17. Question: Can we submit previously completed PPQ as part of this proposal?

Response: Yes, if the reference contract is recent and relevant.

18. Question: Does the Government anticipate awarding all CLINs upon contract award? If not, what’s the strategy?

Response: All CLINs will be included in the basic requirements contract. However, task orders will be issued depending on need and funding availability. The Government projects minimum usage of approximately 80% of the total requirement. Contractor, however, shall be prepared to meet 100% usage, if needed.

19. Question: Would the Government consider changing the submittal requirement to electronic?

Response: No.

20. Question: How does the Government want the sanitized version of the Technical volume delivered?

Response: Please refer to the Addendum to FAR 52.212-1 Instructions to Offerors - Commercial Items.

21. Question: Who is responsible for repairing access to the site if the site is inaccessible due to road washout, landslide or other acts of God?

Response: Government is responsible. Contractor shall notify the COR and Range Control.

22. Question: What is the Government’s expectations around project progress in the event an act of God prevents site access?

Response: Act of God and Government delays will not be faulted against the contractor. Work will be re-scheduled if needed.

23. Question: Are there any known threatened or endangered species around these sites that we need to avoid?

Response: See PWS Para 3.8.9 – 3.8.9.3

24. Question: Are there any known archeological sites that we need to avoid?

Response: See PWS Para 3.8.9 – 3.8.9.3

25. Question: What are the specific requirements in gaining access to cultural sites related to this work?

Response: See PWS Para 3.8.9 – 3.8.9.3

26. Question: What type of herbicides will be required?

Response: See Para 7 – 7.3 of the PWS. Contractor will submit a pest plan with the chemical and target prior to use.

27. Question: What happens when portions of the road are washed out and areas to be cut are inaccessible?

Response: Contractor will notify COR and Range Control, who will advise contractor on how to proceed.

28. Question: Will the government physically delineate the cut boundary?

Response: No.

29. Question: Will UXO support be required? If so, will the expectation be that the contactor supply support or will the Army EOD support?

Response: Contractor will provide UXO support. See revised PWS.

30. Question: Is there a brush overhead height/width limit?

Response: No overhead height, but there will be a vertical height of ten (10) feet.

31. Question: Does the hoary bat pupping season affect work?

Response: No. Hoary bat pupping season only applies to trees that are 15’ feet and above.

32. Question: When working in and around cultural sensitive areas, will cultural support be required and if so, will DPW provide this support?

Response: DPW environmental will oversee work as scheduled.

33. Question: In light of the adverse weather during the site visit and the inability to visit SBMR Fire Break, SRAA, East Range and the inside of PMR, will the Government schedule another site visit to view those areas?

Response: No.

34. Question: Will the acreage per location be confirmed and/or revised?

Response: Yes. See revised TE #4.

35. Question: If/when the revisions are made, will the current names as identified and used at the Range Desk be reflected in the revised maps?

Response: Yes.

36. Question: Will high resolution maps be available?

Response: No, not at this time. High resolution printing capabilities are currently not available.

37. Question: Will a CLIN be established to be utilized for ‘Cut Requests’ for similar services outside of the current CLIN Structure or outside of the quantity, areas as defined under the PWS?

Response: No.

38. Question: Please clarify the minimum qualifications, experience and requirements for the position of “non working employee” that is tasked to provide oversight of safety and health of all employees under PWS Para 3.7.15. Does this individual(s) require any specific training or qualifications?

Response: Contractor will make that determination.

39. Question: Understanding that UXO is present on Range as mentioned in Section 6 Safety requirements, will

EOD escort be required while on Range with each Team?

Response: See revised Para 3.1.3 of the revised PWS.

40. Question: If EOD escort is required, will it be the provided by the Government or Contractor?

Response: See revised Para 3.1.3 of the revised PWS.

41. Question: If EOD escort is a contractor requirement, is there a maximum ratio of EOD Tech to Team member count?

Response: See revised Para 3.1.3 of the revised PWS.

42. Question: If EOD escort is a contractor requirement, what are the required qualifications and experiences?

Response: See revised Para 3.1.3 of the revised PWS.

43. Question: Please identify on the maps which areas are limited from herbicide application.

Response: Currently, there are only two (2) sites with archaeological requirements (PMR & DMR). These are identified on the maps.

ADDENDUM TO FAR 52.212-2

04ADDENDUM TO FAR 52.212-2 EVALUATION – COMMERCIAL ITEMS

A. BASIS OF AWARD

1. This source selection is conducted in accordance with Federal Acquisition Regulation (FAR) Part 12 Acquisition of Commercial Items and FAR Part 15 Contracting By Negotiation, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS). The Government anticipates awarding a Firm Fixed Price (FFP) requirements type contract resulting from the solicitation and reserves the right to not award a contract at all depending on the quality of offers received and availability of funds.

2. Award will be made to a single offeror who is deemed responsible IAW FAR 9.104, whose proposal conforms to the solicitation, meets the Government’s requirements and offers the best value to the Government from a lowest price technically acceptable (LPTA) standpoint. Appropriate consideration shall be given to three (3) evaluation factors: Technical Acceptability, Past Performance and Price.

3. The Government reserves the right to determine which offers show the required capability IAW the evaluation factors. The Government also reserves the right to eliminate from further consideration those offers which are considered unacceptable and not capable of being made acceptable without major rewrite or revision.

4. The Government intends to award without discussions. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. In the event discussions become necessary, the Contracting Officer may determine that the number of offers that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of offers to the greatest number that will permit an efficient competition among the most highly rated offers.

5. Trade-offs between cost/price and non-cost/price factors are not permitted. Unreasonably high, unbalanced, inaccurate or incomplete price offers may be the grounds for eliminating an offer from competition.

B. EVALUATION FACTORS

1. Factor I - Technical Acceptability. Proposals will be rated on an “Acceptable”, or “Unacceptable” basis.

In order to be considered for award, a proposal must have an “Acceptable” rating for each of the technical sub-factors and an overall “Acceptable” technical rating. Any “Unacceptable” rating on any of the sub-factors will result in an overall technical rating of “Unacceptable”.

The following sub-factors shall be used to determine technical acceptability. Non-submission of any of these elements shall render the offer technically unacceptable and shall not be considered for award. All of the sub-factors shall be clearly addressed in the proposal. The two technical sub-factors are as follows:

a. Sub-Factor 1 Technical Capability and Approach

The proposal will be evaluated to determine how well the Offeror’s proposal demonstrates an overall understanding of the requirements as well as the extent to which the proposed approach reflects the capabilities necessary to successfully perform the contract requirements. The proposal will be evaluated to determine if the contractor proposed an adequate number of qualified personnel and equipment to perform the requirement and demonstrate the ability to successfully complete the tasks within the required frequency schedules.

To be determined acceptable, the contractor shall provide a staffing matrix that identifies adequate and qualified personnel to perform the requirement, to include hours assigned, labor categories (including management) and number of personnel in each labor category and total man-hours for each labor category and an equipment list that will be utilized during contract performance. Contractor shall provide a narrative explanation of how the proposed personnel and equipment will successfully complete the requirements in the PWS.

b. Sub-Factor 2 Relevant Work Experience

The proposal will be evaluated to determine if the offeror has relevant work experience performed within the last three (3) years for the same or similar work with regards to scope and magnitude performed. In order to be considered technically acceptable, the contractor shall have at least one year relevant work experience as described above. Contractor shall complete the Work Experience Information per Attachment 1 for each work experience submitted.

2. Factor II – Past Performance. The Past Performance evaluation will assess the relative risks associated with an offeror’s likelihood of success in performing the solicitation’s requirements as indicated by that offeror’s record of past performance. Performance risk is assessed at the factor level after evaluating aspects of the offeror’s recent past performance and focusing on performance that is relevant to the services being procured under this solicitation.

Proposals will be rated on an “Acceptable” or “Unacceptable” basis. In order to be considered for award, the offeror’s past performance must be evaluated as acceptable. The Government will evaluate three (3) relevant past performance information (not older than three years) on same or similar contracts obtained from the government and commercial sources provided by the prospective contractor. There are two aspects to the past performance evaluation.

a. Recency and Relevancy. The first aspect is to evaluate whether the offeror’s present/past performance is relevant or not relevant to the effort to be acquired. To be relevant, the effort must be the same or similar in nature, scope, size, magnitude and complexity to the services being procured under this solicitation and shall have been performed in the last three (3) years. Past performance information that is not recent and relevant will not be evaluated and will be considered “Unacceptable”.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

b. Contractor Performance. The second aspect of the past performance evaluation is to determine how well the contractor performed on the contracts. The past performance evaluation performed in support of a current source selection does not establish, create, or change the existing record and history of the offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the offeror performed those past contracts. Responses to the past performance questionnaire in the following areas will be considered in evaluating past performance information.

(1) Quality of Service: A pattern of successful completion of tasks of good quality conforming to the PWS requirements.

(2) Schedule/Timeliness of Performance: A pattern of submitting deliverables/completing tasks that are timely

(3) Business Relations: A pattern of cooperativeness and teamwork with the Government at all levels (task managers, contracting officers, auditors, etc.)

(4) Management of Personnel: A pattern of effective hiring and retention practices

c. In addition to the Past Performance Questionnaire, the Government may review any other source of information for evaluating past performance. Other sources may include, but are not limited to past performance information retrieved through the Past Performance Information Retrieval System (PPIRS) or Contract Performance Assessment Reporting System (CPARS) using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror’s proposal, inquiries of owner representative(s) and any other known sources not provided by the Offeror.

3. Factor III - Price. Price will not be assigned an adjectival rating. The Government expects competitive proposals to be submitted for this procurement and will use competition to determine price reasonableness.

However, the Government may utilize any or a combination of methods identified in FAR 15.404 to determine price reasonableness.

C. EVALUATION APPROACH

All offers shall be subject to evaluation by a team of Government evaluators. Each factor and sub-factor shall be evaluated using the following assessment approaches:

1. Technical Evaluation Approach. Proposals will be rated on an “Acceptable” or “Unacceptable” basis. All technical sub-factors will receive an “Acceptable” or “Unacceptable” rating.

Rating Description Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

2. Past Performance Evaluation Approach. Offers will be rated on an “Acceptable” or “Unacceptable” basis.

Rating Description

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

Notes: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

An unacceptable rating of past performance will be referred to the Small Business Administration for a responsibility of competency determination prior to contract award.

3. Price Evaluation Approach.

a. Total evaluated price shall be the basis for evaluating price for contract award decision purposes.

Total evaluated price shall be determined by adding the offered prices on the CLINs stated in the solicitation (base and option years). In the event the unit price(s) and extended price(s) are ambiguous, the Government shall use the indicated unit price(s) for evaluation and award purposes. Offerors shall submit prices for all CLINs and for all performance periods. Failure to submit a price for any CLIN/sub-CLIN shall result in the offer being considered unacceptable.

b. Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. As part of the price evaluation, the Government will evaluate the Option to Extend Services under FAR Clause 52.217-8 by adding one-half of the offeror’s final option period price to the offeror’s total price. Thus, the offeror’s total price, for the purpose of evaluation will include the prices for the base period, first option, second option and one-half of the second option. Evaluation of options shall not obligate the Government to exercise the option(s).
