4. INSTRUCTIONS FOR WRITTEN SUBMITTALS

4.1 The Government will award a single contract to the overall best value quote that is determined to be the most beneficial to the Government, using the tradeoff process. Evaluation methodology for this procurement consists of the Entry Gate Criteria, and three (3) factors: Technical, Past Performance, and Price. The business goal of the contract is to purchase maintenance and repair of HVAC services.

The Government intends to evaluate quotes and award a contract without discussions with Offerors. Therefore, the Offeror's initial quote should contain the Offeror's best terms from entry gate criteria, technical, and price standpoints. If a quote “fails” the gateway criteria portion, the quote will not be further evaluated and will be deemed unacceptable. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government reserves the right to consider as acceptable only those proposals submitted in accordance with all requirements set forth or referenced in this solicitation and that demonstrate an understanding of the scope of the requirement. The Government may reject any or all quotes if such action is in the public interest; and waive informalities and minor irregularities in quotes received. The Government reserves the right to permit Offerors to revise their quote if the Government thinks it is in its interest to do so.

4.2 Quote Format and Content: All text shall be single-spaced and 12-point Times New Roman font. This does not include copies of certificates. The Contractor shall number each page in order to eliminate any confusion. In the event that there is an ambiguity in the numbering of pages, the Government may exercise its own discretion in counting pages. Types of acceptable media are Word or PDF document compatible with MS Word 2016 or Adobe Reader 9. This solicitation utilizes streamlined acquisition procedures. Each quote shall contain:

(End of Addendum)

1. BASIS FOR AWARD

a. The Government intends to award a single contract for Heating, Ventilation and Air Conditioning (HVAC), walk-in refrigerators and freezers to the overall best value quote that is determined to be the most beneficial to the Government, price and other factors considered. In order to determine the quote that represents the best value, the Government intends to conduct a comparative analysis of offers IAW FAR 13.106-2(a)(3).

b. The Government will first evaluate the Entry Gate Criteria for acceptability on a pass/fail basis. The evaluation process will use entry gate criteria for Certifications. Only those quotes that pass the entry gate criteria will be further evaluated for award. Next, appropriate consideration will be given to the three (3) evaluation factors:

Technical, Past Performance and Price. Technical and Past Performance, when combined, are more important than price. Offerors are cautioned that the award may not necessarily be made to the lowest price quoted, using tradeoff between Technical, Past Performance, and Price.

c. The Government intends to evaluate quotes and award a contract without discussions. Therefore, each initial offer should contain the offeror’s best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if determined necessary by the Contracting Officer.

d. A written notice of award, before the specified expiration time of the quote, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the quote, shall result in binding prices without further action by either party. The Government may award a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

2. The Government will evaluate:

(i) Entry Gate Criteria - Certifications

(ii) FACTOR I – TECHNICAL - Experience

(iii) FACTOR II – PAST PERFORMANCE

(iv) FACTOR III – PRICE

3. EVALUATION APPROACH

a. All quotes shall be subject to evaluation by a team of Government advisors. Careful, full, and impartial consideration will be given to all quotes received in response to this solicitation. Quotes will be evaluated to determine compliance with all requirements of the solicitation, including any attachments and exhibits. The evaluation criteria will be applied to all quotes in the same manner. The Government will evaluate each quote strictly in accordance with its content and will not assume that performance will include areas not specified in the quote.

b. The Government reserves the right to award to an offeror whose quote is not the lowest price.

c. To be considered for selection a quote must conform to all terms and conditions contained in the solicitation. No quote will be accepted that does not address the total amount of work specified in the solicitation.

d. The Government's primary objective in selecting an awardee is to make a "Best Value" determination by balancing Technical, Past Performance, and Price considerations. Evaluation will be based on the factors and sub-factors listed below. See FAR 52.212-1 “Instruction to Offerors” and its Addendum for detailed instructions on documentation to be submitted with the quote addressing each of the factors.

ENTRY GATE CRITERIA: After initial screening to determine completeness in accordance with the solicitation requirements, the Government will evaluate quotes based on documentation provided. The Government will evaluate the entry gate criteria for certification acceptability on a pass/fail basis.

PASS is defined as the offeror submits documentation for personnel that are qualified with the appropriate certifications.

FAIL is defined as the offeror does not submit documentation for personnel that are qualified with the appropriate certifications.

Certifications: This criteria will be evaluated as PASS when the offeror submits documentation for the following:

iv. The company’s registration from the Chamber of Trade (Handwerkskammer) or the Chamber of Commerce (Industrie und Handwerkskammer (IHK) that is certified as “Kaelte Klima Fachbetrieb”.

v. Certified Master (Meister) or Engineer (Ingenieur) level for refrigerant systems (Kaelteanlagenbau - Meister or Ingenieur).

vi. Certified qualified personnel (“befaehigte Person”) possessing the following qualifications:

(1) VDI 6022 – Hygiene training courses - RLT systems, Category A and B (VDI 6022 – Hygieneschlulung RLT Anlagen Kategorie A und B)

(2) Certified personnel of category I in accordance with:

- Artikel 5 der Verordnung (EG) Nr. 842/2006

- Verordnung (EG) Nr. 303/2008

- Para 5 der ChemKlimaschutzV

- Apprenticeship diploma refrigeration engineering (unaltered German version‘Gesellenbrief

Kaeltetechnik’)

(3) Hoisting platform according to BGR 500 and BGR 945 (Hebebuehnen nach BGR 500 und BGR 945).

Certificates obtained abroad are translated into German and certified by the Bundesministerium fuer Bildung und Forschung (www.anerkennung-in-deutschland.de) in Germany.

If the Offeror does not have personnel qualified to fill these positions at the time the quote is submitted, the qualifications and experience of the person or persons they intend to hire or subcontract shall be submitted.

If a quote “fails” the Entry Gateway Criteria portion, the quote will not be further evaluated and will be deemed unacceptable.

FACTOR I – TECHNICAL EXPERIENCE: The Government will evaluate the minimum of two (2), but no more than five (5), Reference Information Sheets (Attachment 4) for recency and relevancy.

“Recent” is defined as the efforts that are completed or ongoing during the past five (5) years prior to the issue date of the solicitation.

“Relevant” is defined as similarity to work contemplated under this Solicitation with respect to scope, type of work, and value. The value for each reference sheet submitted shall be a minimum of €750,000.00.

The Government is not bound by an offeror's opinion of the relevance of its organizational experience.

FACTOR II - PAST PERFORMANCE: The Government will evaluate the offeror’s record of present and past performance to ascertain the probability of the offeror to successfully perform the required efforts of the PWS, the quality of the offeror’s past performance, and to determine offeror’s responsibility in accordance with FAR 9.1. The information presented in the Past Performance Questionnaires and information obtained from other available sources other than those identified by the offeror (such as past performance information obtained from Federal, State and local Government agencies, better business bureaus, published media, and electronic data bases available to the Government) will be the basis for evaluation of this factor.

Past performance is a measure of the degree to which an offeror has satisfied customers in the past, and complied with Federal, state, and local laws and regulations. Information obtained from the offeror, POCs, or other sources must be from recent and relevant performance, and the quality of service must provide the Government a reasonable expectation that the offeror will successfully perform the required effort. Additionally, references to the Past Performance Questionnaire must have rated the offeror at a minimum “Satisfactory" on all questions.

Offerors are cautioned that in conducting the past performance assessment, the Government will use data provided in the offeror's quote and data obtained from other sources, such as:

(a) The Contracting Officer’s knowledge of and previous experience with the supply or service being acquired;

(b) Customer surveys, and Past Performance Questionnaires;

(c) The Contractor Performance Assessment Reporting System (CPARS) at https://www.cpars.gov; or

(d) Any other reasonable basis.

The Government will determine recency and relevancy by using the data provided in the responses from the questionnaires.

“Recent” is defined as the efforts that are completed or ongoing during the past five (5) years prior to the issue date of the solicitation.

“Relevant” is defined as similarity to work contemplated under this Solicitation with respect to scope, type of work, use if key personnel, and value. The value for each reference sheet submitted shall be a minimum of €750,000.00.

The Government may reject a quote if it is found that any information that has a negative impact on the offeror’s past performance record has been deleted, misrepresented, or withheld.

Offerors shall provide information on problems encountered on the contracts identified in their past performance submissions and the offeror’s corrective actions. The Government shall consider this information, as well as information obtained from any other sources, when evaluating the offeror's past performance.

Note: In the case of an offeror without a record of relevant past performance, or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv). Therefore, the offeror shall be determined to have unknown past performance and will be assigned a rating of “Neutral”.

FACTOR III - PRICE: Among those quotes that first meet the entry gate criteria, the Government will then evaluate each price quote. The total evaluated price (TEP) will be evaluated for reasonableness, completeness (all items are priced), and balance. Offerors are required to price all the Ordering Periods for CLINs 0001, 0002, 0003, 0004, 1001, 1002, 1003, 1004, 2001, 2002, 2003, 2004, 3001, 3002, 3003, 3004, 4001, 4002, 4003, 4004, 7500, 7501, 7502, 7503, & 7504 and all Exhibit Line Items (ELINs) contained in the Price Books. Offerors shall not submit a price for the potential six (6) months extension of services period or the six (6) month extended ordering period.

The successful offeror will be contractually bound to all quoted prices. Offerors must ensure there are no rounding errors to the nearest cent.

Options: The Government will evaluate quotes for award purposes by adding the total price for all ordering periods, to include the option at FAR 52.217-8, to the total price for the basic requirement. The Government will evaluate the Option at FAR 52.217-8 by taking the prices submitted for the last ordering period and prorating them for an additional six (6) months. This amount will be the total evaluated price. The Government may determine that a quote is unacceptable if the ordering period prices are significantly unbalanced.
