CMO Control Number: 2024-071 received. Any information received will be considered to determine if a competitive acquisition should be conducted or to determine potential future requirements.
8. Market Research: ACC-DTA published a market survey/Request for Information (RFI) on SAM.gov from 23 April 2024 to 7 May 2024. No responses were received.
9. Interested Sources: To date, no vendors have responded to the RFI. Cummins has the only known experience required to provide onsite FSR support to diagnose and repair the V903 engine and meet the need as noted in section 5.
10. Other Facts:
a) Procurement History.
1. Contract numbers and dates of last contracts for the same requirements:
i. W56HZV-21-C-0070: In December 2020, ACC-DTA awarded an urgent one-year, sole source FFP LOE, contract for Field Service Representatives, for maximum value of $429,600 for the V903 engine. Period of Performance was for 10 months from December 2020 through September 2021.
ii. W56HZV-21-C-0133: In September 2021, ACC-DTA awarded a one-year, sole source FFP-LOE, contract for Field Service Representatives, for a maximum value of $1,033,259 for the V903 engine. Period of Performance (PoP) was for 12 months from October 2021 through September 2022. Modification P00001 was awarded which increased the FSR support effort by $231,260. The PoP remained the same through September 2022.
iii. W56HZV-22-C-0077: In September 2022, ACC-DTA awarded a one-year sole source FFP-LOE, contract for Field Service Representatives, for a maximum value of $1,972,028 for the V903 engine. Period of Performance (PoP) was for 12 months from October 2022 through September 2023. Modification P00001 was awarded which increased the FSR support effort by $228,628.82. The PoP remained the same through September 2023.
iv. W56HZV-23-C-0086: In September 2023, ACC-DTA awarded a one-year sole source FFP-LOE, contract for Field Service Representatives, for a maximum value of $2,658,518 for the V903 engine. Period of Performance (PoP) was for 12 months from October 2023 through September 2024. Modification P00001 was awarded which increased the FSR support effort by
$358,060. The PoP remained the same through September 2024.
2. Competitive Status: All actions were sole source to Cummins.
3. Authority previously cited if less than full and open competition was used:
i. W56HZV-21-C-0070 cited FAR 6.302-2
ii. W56HZV-21-C-0133, W56HZV-22-C-0077, and W56HZV-23-C-
0086 cited FAR 13.5.
4. Since only Cummins has the knowledge and expertise necessary to satisfy the requirements, no further action was taken to increase competition. While the government will continue to survey the marketplace, this action will be sole source to Cummins. Any additional information received will be considered to determine future potential requirements.
5. No prior contact for this requirement was accomplished using full and open competition.
6. No unusual patterns identified other that the requirement being recurring. A possible multi-year contract could be investigated in the future.
7. The contracting and requirements office made the determination from previous contract history that Cummins is the only source capable of meeting the contract requirements. The locations include, York, PA;
Elgin, OK; Anniston AL (VUOC); ANAD (Anniston, AL); Ft. Cavazos, TX; Ft. Stewart, GA; and Red River Army Deport. The Picatinny, NJ and Letterkenny Army Depot, sites were removed for this new requirement.
b) Other Facts: N/A. There are no additional facts that apply to this justification that were not previously stated.

12. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. The contractor’s proposal will be reviewed by the Government to ensure a fair and reasonable price. Price reasonableness will be based upon a cost and price analysis, an independent Government estimate, and price history. In accordance with FAR 15.403-1(b)(3), certified cost or pricing data will not be required, as these services are commercial. The contractor will be required to submit other than certified cost or price data for negotiations to be conducted.
