(a) Identify the specific subparagraph of the authority cited and include the full text of the FAR for that subparagraph.

5) For Authorized or Required by Statute under authority FAR 6.302-5:

For example, use authority FAR 6.302-5 as follows: As described in FAR 6.302-5(b), this authority may be used when statutes, such as sole source awards under the HUBZone Act of 1997, expressly authorize or require that acquisition be made from a specified source or through another agency. As per FAR 6.302-5(c)(2) indicates that contracts awarded using this authority shall be supported by a written justification and approval.

(b) Alternatives: This requirement can be competed among small business; however, in order to achieve the socio-economic goal for HUBZones, MICC Fort Buchanan is considering a sole source award against a HUBZone certified company. Currently, there is only one HUBZone contractor that can satisfy this requirement.

6. Efforts to Obtain Competition: This requirement will not be competed. None of the exclusions at FAR 5.202 apply to this requirement; therefore, this action will be synopsized. In case any HUBZone capable company able to fulfil this requirement is interested in this requirement, the synopsis/solicitation will be amended from sole-source to full and open competition after exclusion of sources.

a. Effective Competition: Because this is a sole source action, effective competition is not applicable.

b. Subcontracting Competition: A Subcontracting plan is not required since the proposed contractor is a HUBZone small business concern. Pursuant to FAR 19.702(b)(1) a subcontracting plan is not required from small business.

7. Actions to Increase Competition: MICC is actively Small Business Administration local office in identifying contractors that are within the HUBZone areas in Puerto Rico. During mid-2016, more than 80% of the Puerto Rico area was identify as HUBZone. Dozens of contractors were advised of these changes and recommended to apply for the HUBZone program.

8. Market Research: Ambulance services are widely used in the commercial market.

There are two types: government-owned and private companies. Several companies such as Metroaid Ambulance Service Inc., Caribe Medical Supply, Inc., Ponce Medical Ambulance, among many other companies are capable of fulfilling this requirement. The services that the Government is requesting are considered commercial in nature.

– the Government estimate for this requirement is .

(c) The requirement is not currently being performed by an 8(a) participant under the provisions of subpart FAR 19.8 or has been accepted as a requirement by SBA under subpart 19.8 – the incumbent contractor is not an 8(a) contractor nor has this requirement been offered to SBA.

(d) The acquisition is greater than the simplified acquisition threshold - the Government estimate for this requirement is

(e) The HUBZone small business concern has been determined to be a responsible contractor with respect to performance - the incumbent contractor is Caribe Medical Supply, Inc. All these three contracts have been performed by this company. On 16 December 2016, Caribe Medical Supply was approved/certified as a qualified HUBZone small business concern (SBC). The company’s performance for the past 10 years has been outstanding.

(f) Award can be made at a fair and reasonable price - previous contracts, except for W912C3-11-C-0015, were competed and Caribe Medical has been the lower bidder; therefore, there is a great expectation that the proposed price will be fair and reasonable.
