About this file

This is a Justification Review Document for approval of a sole-source contract modification under RFO Part 6 for other than full and open competition. The document authorizes USACE Tulsa District to issue a modification to Contract W912BV25C0008 with Barnard Construction Company, Inc. (CAGE: 0S2U8), located at 1111 West 12th Street, Ogden, UT 84404, for the Prado Dam Modification Project in Riverside County, California. The modification is valued at $1,021,847,536.53 for Option 1-CLIN 0002 and $75,641,129.76 for Option 2-CLIN 0003, with total estimated value of the modification being $1,097,488,666.29 funded through FY24 appropriations under Public Law 119-74. The modification is necessary to incorporate Defense Federal Acquisition Regulation Supplement (DFARS) clause 252.232-7007 and to exercise construction options originally scheduled for April 6, 2027, approximately 12 months earlier than planned.

The modification is statutorily mandated by Public Law 119-74, enacted January 23, 2026, which requires existing IDaC contracts to be modified to incorporate a specific clause by the March 24, 2026 deadline. Barnard Construction Company is the only source capable of performing this work within the mandated timeframe, as it is the incumbent prime contractor with comprehensive knowledge of the project specifications, site conditions, and design intricacies. The underlying Integrated Design and Construction (IDaC) contract was originally awarded on April 14, 2025 through full and open competition. The justification cites Title 10 U.S.C. §3204(a)(5) and RFO 6.103-5(b)(1) as authority for streamlined justification and approval without full competition. The document was prepared by Lindsey Harmon (Contract Specialist), with contracting officer Brian Hutchison, technical lead Bobby Van Cleave II, and project manager Stephen Martinez, and received approvals from all required reviewers as of March 5, 2026.
