ADDITIONAL INFORMATION
ADDITIONAL INFORMATION FOR OFFERORS
USACE intends to award a firm-fixed price contract to the vendor that can fulfill the requirements specified in the Statement of Work (SOW). The award will go to the Lowest Price offeror that can: Provide all the necessary equipment, matrial, labor and skills to perform the work In Accordance With (IAW) the SOW with an acceptable rating in past performance.
Price and Past Performance will be evaluated in accordance with in DFARS 213.106- 2(b)(i)(B)&(C). Past Performance history shall be evaluated for each supplier’s past performance history from their submitted projects and in the Past Performance Information Retrieval System (PPIRS). Award will be made to the supplier whose quote represents the best values to the Government quoting the lowest price and has nothing “unacceptable” through submitted project and/or PPIRS. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror. The Government will contact each signatore for all past performance questionnaires.
It is the Government’s intention to award without discussions. Offerors are encouraged to present their best proposal and prices in their initial proposal submission. However, in accordance with FAR Part 15.306, should discussions become necessary, the Government reserves the right to hold discussions. If this occurs, a competitive range will be determined and offerors notified. The competitive range may be limited for purposes of efficiency in accordance with (IAW) FAR Part 15.306(c)(2).
The Government will evaluate all technical factors concurrently for the three (3) lowest priced proposals. Should one of those three proposals not be found acceptable, the next lowest priced offeror will be reviewed for technical acceptance.
Submissions. Offers are required to submit three (3) projects and a completed bid schedule no later than the date and time specified in the solicitation.
Debriefings. The Contracting Officer will promptly notify offerors of any decision to exclude them from the competitive range, whereupon they may request and receive a debriefing in accordance with FAR 15.505. The Contracting Officer will notify unsuccessful offerors in the competitive range of the source selection decision in accordance with FAR
15.506. Upon such notification, unsuccessful offerors may request and receive a debriefing.
Offerors desiring debriefing must make their request in accordance with the requirements of FAR 15.505 or 15.506, as applicable. All debriefings will be provided officially in writing.
If an offeror believes that the requirements in these instructions contain an error, an ambiguity, omission, or are otherwise unsound, the offeror shall immediately notify the Contracting Officer (KO) in writing with supporting rationale. The offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussion.
ALL OFFERORS are on NOTICE:
"Only a warranted Contracting Officer (either a Procuring Contracting Officer (PCO), or an Administrative Contracting Officer (ACO)), acting within their delegated limits, has the authority to issue modifications or otherwise change the terms and conditions of this contract. If an individual other than the Contracting Officer attempts to make changes to the terms and conditions of this contract you shall not proceed with the change and shall immediately notify the Contracting Officer."
1 General Instructions
The Government intends to make award without discussions. Therefore, each initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions, if deemed necessary.
2 Evaluation Factors
The following evaluation factors will be used to evaluate each proposal. The Government will award a contract from this solicitation to a responsible offeror whose offer conforms to the solicitation and will be most advantageous to the Government; price and other factors cosidered.
Factor 1 Past Performance Factor 2 Price
3 Evaluation Approach
The Government will evaluate all technical factors concurrently for the three (3) lowest priced proposals. Should one of those three proposals not be found “acceptable”, the next lowest priced offeror will be reviewed for acceptability. All proposals shall be subject to evaluation IAW Simplified Acquisition Procedures (SAP). Each offeror’s past performance submittal will be evaluated against the requirements found in the Statement of Work to determine the offeror’s capability of performing the contract. An “unacceptable” rating for this factor will remove the offeror from further consideration.
4 Ratings
The past performance evaluation results in an assessment of the offeror’s probability of meeting the solicitation requirements. The past performance evaluation considers each Offeror’s demonstration of recent and relevant records of performance in supplying products and services that meet Customer requirements.
The Government will consider past performance information as submitted in accordance with Instruction to Offerors in this solicitation, and may also consider recent and relevant past performance information outside of the information provided in the Offeror’s Past Performance proposal and information obtained from other sources available to to Government, to include, but not limited to, Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPPIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Progress Managers, Contracting Officers and commercial sources.
Past performance will be rated on an “acceptable” or “unacceptable” basis using the ratings in Table A-1.
Ratings
Table 2. Past Performance Evaluation
Rating Description
Acceptable Based on the Offerors’ performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable Based on the offeoror’s performance record, the Government does not have a reasonable expectation that the offeror will successfully perform the required effort.
5. Factors
1.7 Factor 1: Past Performance
This factor is met when the Offeror provides past performance information for three (3) completed projects that demonstrate a record of recent and relevant performance in supplying services similar to the requirements of this RFP in accordance with the solicitation. An “unacceptable” rating in past performance will remove the offeror from further consideration.
1.8 Factor 2: Cost/Price
To meet this factor provide a complete Section B- Bid Schedule. Offeror must submit a proposal indicating their proposed price, together with a breakdown of estimated costs used to arrive at your price.
In accordance with FAR 15.404-1(b), the Government intends to perform a price analysis of offerors proposed price, inclusive of all CLINs/Sub CLINS, to verify that the proposed CLINs/Sub CLINs and overall FFP offered is fair and reasonable. The Government may use various methods in its price analysis of Offeros’ price proposals including, costs amongst all competitive offerors, analysis of certified cost or pricing data or other than certified cost or pricing data provided by the offeror.
The initial price analysis will evaluate oferror’s bottom line price on a CLINs/Sub CLINs basis. The total bottom line price consists of all of the Offeror’s proposed sub-CLINs, regardless of year in which they may be exercised. A variance analysis may be performed utilizing the IGE and average of proposed pricing of all offerors with the same performance objectives for any given CLIN/sub CLIN. Where the variance anlaysis or comparison to the IGE and average of all offerors indicate a discrepancy, a price realism analysis may be performed. Should a price realism analysis be warranted a careful assessment of individual cost element backup and pricing assumptions will be performed to determine 1) whether the price indicates that the offeror does not understand the work and 2) whether the price poses a risk of poor performance. A price is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business and the offeror’s proposed costs are 1) consistent for the work to be performed under the contract; 2) reflect a clear understanding of contract requirements and; 3) are tailored to the various elements of the offeror's specific proposed performance objectives and/or technical approach.
Following the price analysis, the Government will examine offeror’s proposals for unbalanced pricing. Per FAR 15.404-1(g), unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more CLINS is significantly over or understated as indicated by the price analysis. If a proposal is unbalanced, the proposal may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the government.
Price will not be adjectivally rated and will be deemed as either “Reasonable” or Unreasonable”, based upon the Government’s price analysis. The Government may reject as “Unreasonable” any proposal evaluated to be unrealistic in terms of program commitments, including contract terms and conditions, unbalanced pricing, or unreasonably high or low proposed prices, based on the price analysis, such that the proposal is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and risks of the program.
1 Discussions
If, during the evaluation period, it is determined to be in the best interest of the Government to hold technical or cost discussions, a Competitive Range will be established and responses to Evaluation Notices (ENs) and the Final Proposal Revision (FPR) will be considered in making the source selection decision.
If discussions are conducted, the Contracting Officer will schedule the discussion sessions, and each offeror will be notified. The Contracting Officer will provide additional instructions with the notification. The discussion sessions will take place at a facility or in a manner of the Government’s choosing.
2 Solicitation Requirements, Terms and Conditions.
Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as factors. Failure to comply with the terms and conditions of the solicitation may result in the Offeror being ineligible for award.

In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.

The
Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.
(f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.
(g) If the Contractor does not have representations and certifications in SAM, or does not have a representation in SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:
