PART 2 PRODUCTS

SECTION 02270 PAGE 11

2.1 MATERIALS

2.1.1 Riprap and Bedding, General

Materials shall be durable stone as approved by the Contracting Officer.

Gypsum, anhydrite, chert, shale, and soft or weathered rock will not be approved. The sources from which the Contractor proposes to obtain material shall be selected well in advance of the time when the material shall be required in the work. Material sources shall be approved based on the ability of the material to meet the quality standards listed below.

Approval of a source of material is not to be construed as approval of all material from that source. The right is reserved to reject materials from certain localized areas, zones, or strata when such materials are unsuitable as determined by the Contracting Officer.

2.1.2 Quality

Stone shall be durable and of a suitable quality to ensure permanence in the structure and in the climate in which it is to be used. It shall be free from cracks, seams, and other defects that would tend to unduly increase its deterioration from natural causes. Inclusion of objectionable quantities of dirt, clay, and rock fines shall not be permitted. Suitable tests and service records shall be used to determine the acceptability of stone protection materials. Tests and service records must be less than five years old and pertain to the quarry faces from which materials for this project will be produced. Tests for aggregate usage other than riprap (i.e. aggregate base, asphalt concrete, Portland cement concrete, etc.)

will not be acceptable as documentation of freeze-thaw resistance for this contract unless the testing was performed in accordance with the requirements of CRD-C 144. In the event that suitable test reports and a service record that are satisfactory to the Contracting Officer are not available, as in the case of newly operated sources, the material shall be subjected to such tests as are necessary to determine its acceptability for use in the work. Tests to which the materials may be subjected include petrographic analysis, specific gravity, abrasion, absorption, wetting and drying, freezing and thawing, and such other tests as may be considered necessary to demonstrate to the satisfaction of the Contracting Officer that the materials are acceptable for use in the work. Tests and test values listed below are for job controls of riprap and shall be used to determine the acceptability of riprap being produced.

2.1.2.1 Weight and Absorption

The minimum weight per solid cubic foot calculated from the bulk specific gravity (saturated surface-dry) of the sample determined in accordance with the procedure in ASTM C 127, shall be 155 pounds. The maximum absorption shall be 7 percent. Test samples shall be 1-1/2 inches to 2-1/2 inches in size.

2.1.2.2 Soundness (Freezing and Thawing Test)

SECTION 02270 PAGE 12

The loss of weight of stone after 20 cycles of freezing and thawing with a test specimen immersed in water shall be less than 15 percent. Each cycle shall consist of 16 hours freezing at temperature of 5 degrees F, and 8 hours thawing at temperature of 100 degrees F. The test specimens shall be prepared and tested in accordance with the requirements of CRD-C 144.

2.1.2.3 Soundness (Magnesium Sulfate Test)

The loss of weight of stone after testing with 5 cycles of magnesium sulfate shall not exceed 18 percent. The tests shall be in accordance with the procedures designated in ASTM C 88. The tests shall be performed on 1-1/2 to 2-1/2 inch size aggregate.

2.1.2.4 Resistance to Degradation

Stone shall be subjected to the Los Angeles Abrasion Test (ASTM C 131) and shall show a loss in weight of not more than 45 percent after 500 revolutions.

2.1.3 Bedding Material

Bedding material shall meet the quality requirements for riprap. Material shall consist of sand, gravel, or crushed stone, well graded between the prescribed limits as specified in the paragraph "Bedding Material,” below.

The material shall be composed of tough, durable particles, shall be reasonably free from thin, flat, and elongated pieces, and shall contain no organic matter nor soft, friable particles in quantities more than 5 percent of the total sample. If bedding material comes from the same source and location as riprap, quality tests for riprap shall be accepted for bedding material. If bedding material comes from a source other than that used for riprap, separate quality testing shall be required.

2.1.4 Riprap

Stone for riprap shall be free from cracks, seams, and other defects that would tend to increase unduly its deterioration from natural causes.

2.1.4.1 Riprap Sources

The following sources are currently approved as producing materials meeting the requirements of this specification, subject to the requirements stated in paragraph 2.1.2. Should the Contractor propose another source, suitable test data shall be provided to the Contracting Officer for review and approval, and no material shall be delivered prior to approval of that source.

Hartford Quarry, JD Shears/APAC, Hartford, KS Elk City Quarry, Midwest Minerals, Independence, KS Greenhill Quarry, Sherwood Construction, Owasso, OK

SECTION 02270 PAGE 13

VJ Stone Quarry, Carnegie, OK Dolese Richards Spur Quarry, Lawton, OK Dolese Cooperton Quarry, Cooperton, OK

2.1.5 Coarse Concrete Aggregate and Sand

Coarse concrete aggregate shall meet the quality requirements specified in ASTM C 33, Class designation 5S. Sand shall meet the quality requirements of ASTM C 33 for fine aggregates, including limits on deleterious materials. Materials shall be provided from sources currently approved by the respective state Department of Transportation.

2.1.6 Testing

After award of the contract, the Contractor shall designate in writing only one source from which he proposes to furnish stone protection materials.

Suitable test samples for each aggregate material shall be obtained by the Contractor under the direct supervision of the Contracting Officer.

Samples are not required if from a source for which Government approved tests and service records are available. Costs of shipping or delivery of the first set of test samples and quality testing shall be at the Contractor’s expense. Test samples shall be submitted within three weeks after award of the contract. Stone protection material shall not be delivered to the site of the work prior to approval of the test samples.

The total overall weight of the sample of material proposed for riprap shall be approximately 1,000 pounds and representative pieces shall weigh not more than 100 pounds. The total overall weight of each sample of material proposed for bedding shall be approximately 100 pounds and representative pieces shall weigh not more than 25 pounds. Samples for coarse concrete aggregate shall be approximately 100 lbs, and for sand shall be approximately 25 pounds.

2.1.7 Geotextiles

Geotextile shall be a non-woven material meeting the requirements of AASHTO

M 288, Class 1 for the permanent erosion control application, 15-50% in situ soil passing 0.075 mm sieve.

PART 3 EXECUTION

3.1 DELIVERY REQUIREMENTS

Delivery of aggregate materials shall begin not more than 30 days after award of the contract, and once delivery has commenced shall be on a continuous basis until all materials have been delivered. Aggregate materials shall be placed in separate stockpiles in the designated stockpile area as directed. Materials shall be stockpiled in a manner to prevent segregation and at a height not to exceed 10 feet. Individual loads shall be dumped as close together as is practical in order to

52.204-7 CENTRAL CONTRACTOR REGISTRATION (APR 2008)

(a) Definitions. As used in this clause--

Central Contractor Registration (CCR) database means the primary Government repository for Contractor information required for the conduct of business with the Government.

Data Universal Numbering System (DUNS) number means the 9-digit number assigned by Dun and Bradstreet, Inc. (D&B) to identify unique business entities.

Data Universal Numbering System +4 (DUNS+4) number means the DUNS number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-character suffix.) This 4-character suffix may be assigned at the discretion of the business concern to establish additional CCR records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at Subpart 32.11) for the same parent concern.

Registered in the CCR database means that--

(1) The Contractor has entered all mandatory information, including the DUNS number or the DUNS+4 number, into the CCR database; and

(2) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS), and has marked the record ``Active''. The Contractor will be required to provide consent for TIN validation to the Government as a part of the CCR registration process.

(b)(1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

(2) The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS +4” followed by the DUNS or DUNS +4 number that identifies the offeror's name and address exactly as stated in the offer. The DUNS number will be used by the Contracting Officer to verify that the offeror is registered in the CCR database.

(c) If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one.

(1) An offeror may obtain a DUNS number--

(i) Via the Internet at http://fedgov.dnb.com/webform or if the offeror does not have internet access, it may call Dun and Bradstreet at 1-866-705-5711 if located within the United States; or

(ii) If located outside the United States, by contacting the local Dun and Bradstreet office. The offeror should indicate that it is an offeror for a U.S. Government contract when contacting the local Dun and Bradstreet office.

(2) The offeror should be prepared to provide the following information:

(i) Company legal business.

(ii) Tradestyle, doing business, or other name by which your entity is commonly recognized.

(iii) Company Physical Street Address, City, State, and Zip Code.

(iv) Company Mailing Address, City, State and Zip Code (if separate from physical).

(v) Company Telephone Number.

(vi) Date the company was started.

(vii) Number of employees at your location.

(viii) Chief executive officer/key manager.

(ix) Line of business (industry).

(x) Company Headquarters name and address (reporting relationship within your entity).

(d) If the Offeror does not become registered in the CCR database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror.

(e) Processing time, which normally takes 48 hours, should be taken into consideration when registering. Offerors who are not registered should consider applying for registration immediately upon receipt of this solicitation.

(f) The Contractor is responsible for the accuracy and completeness of the data within the CCR database, and for any liability resulting from the Government's reliance on inaccurate or incomplete data. To remain registered in the CCR database after the initial registration, the Contractor is required to review and update on an annual basis from the date of initial registration or subsequent updates its information in the CCR database to ensure it is current, accurate and complete. Updating information in the CCR does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.

(g)(1)(i) If a Contractor has legally changed its business name, “doing business as” name, or division name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in Subpart 42.12, the Contractor shall provide the responsible Contracting Officer a minimum of one business day's written notification of its intention to (A) change the name in the CCR database; (B) comply with the requirements of Subpart 42.12 of the FAR; and (C) agree in writing to the timeline and procedures specified by the responsible Contracting Officer. The Contractor must provide with the notification sufficient documentation to support the legally changed name.

(ii) If the Contractor fails to comply with the requirements of paragraph (g)(1)(i) of this clause, or fails to perform the agreement at paragraph (g)(1)(i)(C) of this clause, and, in the absence of a properly executed novation or change-of-name agreement, the CCR information that shows the Contractor to be other than the Contractor indicated in the contract will be considered to be incorrect information within the meaning of the “Suspension of Payment” paragraph of the electronic funds transfer (EFT) clause of this contract.

(2) The Contractor shall not change the name or address for EFT payments or manual payments, as appropriate, in the CCR record to reflect an assignee for the purpose of assignment of claims (see FAR Subpart 32.8, Assignment of Claims). Assignees shall be separately registered in the CCR database.

Information provided to the Contractor's CCR record that indicates payments, including those made by EFT, to an ultimate recipient other than that Contractor will be considered to be incorrect information within the meaning of the “Suspension of payment” paragraph of the EFT clause of this contract.

(h) Offerors and Contractors may obtain information on registration and annual confirmation requirements via the internet at http://www.ccr.gov or by calling 1-888-227-2423, or 269-961-5757.

If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations.

Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified.
