About this file

This is Amendment 0003 to solicitation W912BU25B0016 for Chesapeake and Delaware Canal Maintenance Dredging, issued by the US Army Corps of Engineers Philadelphia District on December 5, 2024. The amendment provides answers to remaining RFI questions without changing the bid closing date.

Key details from the Q&A include: contractors may use two unloaders working concurrently at the Pearce Creek Disposal Area; pipeline laying is permitted on the bay bottom outside federal navigation channels; ship traffic may cause temporary work suspensions; the Notice to Proceed will be issued after contract award and receipt of performance bond; the period of performance is 120 days with work to be completed by June 30 and dredging only permitted between October 1 and March 31; minor debris removal should be included in dredging rates while excessive debris would be considered a differing site condition. The amendment specifies that acceptance sections were previously provided in Amendment 0001 and any changes to the environmental window timing will be addressed post-award.

SUMMARY OF CHANGES

SECTION 00 10 00 - SOLICITATION

The following have been added by full text:

RFI QUESTIONS/ANSWERS PART II

RFI Questions/Answers Part II

• Q4: Will the Corps allow the Contractor to utilize (2) unloaders working concurrently at the Pearce Creek Disposal Area?

A4: The use of 2 unloaders is permissible.

• Q5: Is the contractor permitted to lay the pipeline on the bay bottom between the unloader(s) and the disposal site?

A5: Contractor is permitted to lay the pipeline on the bay bottom outside of the federal navigation channel.

• Q6: To what extent if any does ship traffic cause temporary suspensions to the dredging operation?

A6: Per the specifications section 01 30 00 D/F in the solicitation-Traffic in the work area consists of ocean going and coastwise vessels, tugs and barges, and pleasure craft.

Passing vessels may interfere with dredging operations. The Contractor is required to conduct the work in such a manner as to obstruct navigation as little as possible, and in case the Contractor's plant so obstructs the channel as to make difficult or endanger the passage of vessels, said plant shall be promptly moved on the approach of any vessel to such an extent as may be necessary to afford a practicable passage.

• Q7: When does the Corps plan to issue the NTP?

A7: The NTP will be issued after the contract is awarded and performance bond is received.

• Q8: Could the government provide more information on the "covered area" and specific details on the number of Acceptance Sections, stationing of each section, channel side (red / green) for each section and approximate quantities of material in each section?

A8: Acceptance sections were provided in Amendment 0001.

• Q9: Per the specifications, “All work must be completed within 120 days. All work under this contract must be completed no later than 30 June. Dredging shall only be performed between 1 October through 31 March.” Assuming the NTP is issued mid- December, at the earliest, only 107 days of dredging will be available before the

W912BU25B0016

moratorium. Will this 120-day period of performance pause outside of the environmental window, allowing the contractor to return and utilize the remaining ~13 days if needed?

Will any extensions to the environmental window be pursued by the government, or granted by relevant agencies?

A9: The period of performance is 120 days as stated in the solicitation and Amendment 0001. Any changes will be addressed once the contract is awarded.

• Q10: Shall the Contractor include the cost to remove and dispose of debris encountered within the dredge prism in the dredging unit rate or will this be billed at a post award negotiated rate or handled by a third party USACE subcontractor?

A10: Minor debris is expected in dredging. If excessive debris is encountered, this would be considered a differing site condition. This has historically not been an issue on the project.
