Section 35 31 00 Page 3

1.4 SITE CONDITIONS

1.4.1 General

There are numerous obstructions in the project areas; including but not limited to: existing bulkheads, dunes, groins,(which are visible and hidden), and piles in the project areas which may effect placement of the beachfill. Bidders are expected to examine the site of the work in accordance with Contract Clause: SITE INVESTIGATION AND CONDITIONS AFFECTING THE WORK to determine the conditions affecting their operations. The entire work site is designated as a hard hat area in accordance with EM 385-1-1 . Maintain close coordination with the U.S.

Coast Guard throughout dredging operations.

1.4.2 Access and Limits of Work

Access to the beachfill sites is available at the locations shown on the drawings. Note the limits of work shown on the contract drawings.

Existing underground utilities and structures are located immediately outside these limits of work in particular areas. Restrict contract work and equipment to within these limits of work. The staging areas are located as shown on the contract drawings and shall be used for storing material and temporary construction facilities.

1.5 LOCATION AND CHARACTER OF BORROW MATERIAL

1.5.1 Location of Borrow Areas

The location of the approved borrow areas (KE1 and KE3) and the limits to which removal of material is permitted are shown on the drawings. The borrow areas are to be used for all beachfill work performed under this contract, and are located as shown on the drawings. The borrow areas are located in the vicinity of known World War II era firing ranges. See Section 01 35 30 MUNITIONS AND EXPLOSIVES OF CONCERN (MEC) CONSTRUCTION SUPPORT for requirements related to potentially encountering MEC in the borrow areas.

1.5.2 Restrictions on Borrow Areas KE1 and KE3

Adhere to the following restrictions:

a. Dredging in the KE1 and KE3 borrow areas should be performed in a way that prevents impacts and maintains shoal structure within the KE2 area (which is not available for this contract), so that post-dredging conditions in the KE2 area resemble pre-dredging conditions. Dredge uniformly over as wide an area as possible and limit dredge cuts to similar depths over the borrow areas.

b. In addition to the maximum depth shown on the drawings, dredge cuts shall not exceed 12 feet below existing grade. Do not dredge any pits or holes.

1.5.3 Character of Borrow Material

The character of the material in the offshore borrow areas is believed to be as indicated by the results of Government-conducted sampling and analyses. Vibracore logs, and sieve curves are presented in Appendices B-41 and B-42 respectively. The locations of vibrational cores and surface grab samples, from which samples were extracted, are shown on the

Section 35 31 00 Page 4 drawings. These locations are in or near the limits established by the drawings for the specified borrow areas.

The information depicted on the vibrational core logs represents the results of subsurface explorations made on the dates indicated and can only be considered indicative of the conditions existing at that time and at the specific location where retrieved. Due to complex geologic conditions within the coastal environment, boulders, cobbles, gravel, silt and clay seams may be encountered as well as sand. The beachfill must be composed predominately of sand as defined by ASTM D2487-06. Boulders, cobbles and coarse gravel defined by the same designation are prohibited from being part of the beachfill. Fine gravel will be limited to less than 10 percent of the beachfill. Manmade materials are also prohibited from being part of the beachfill. No additional compensation will be provided for routine moves of the dredge(s) within the limits of the borrow areas shown. Moves required to ensure compliance with these specification for beachfill content and/or to optimize production are routine. Borrow Area K has been utilized for beachfill dredging on multiple occasions and as such, may have areas where larger material (greater than 1.25 inches) may have been back-flushed from MEC avoidance screens.

Munitions and explosives of concern (MEC) may also be encountered in the borrow areas. See Section 01 35 30 MUNITIONS AND EXPLOSIVES OF CONCERN (MEC) CONSTRUCTION SUPPORT for all requirements related to potentially encountering MEC in the borrow areas.

1.5.4 Maximum Allowable Depth for Removal

The maximum allowable depths for removal of material from the borrow areas are as indicated on the drawings. To cover the inaccuracies of the dredging process the Contractor may remove material in these borrow areas to a depth of not more than 1-foot below the maximum allowable depth.

Unless specifically directed by the Contracting Officer, no payment will be made for material removed from below the maximum allowable depth plus 1-foot overdepth, or from outside the borrow area limits, as indicated on the drawings..

If during the progress of the work it is determined that the borrow areas do not contain a sufficient quantity of material for completion of the project, the Contracting Officer may adjust the maximum allowable depth of the borrow areas. If this adjustment results in the pumping of undesirable material quality, the Contractor shall move to another location within the specified borrow areas. The maximum depth of dredging activities for each of the borrow areas, is as shown on the drawings.

1.5.5 Nature of Borrow Areas

The surveys of the borrow areas shown on the drawings are the most recent surveys available. The conditions in the borrow areas are dynamic in nature. Therefore, the soundings and material descriptions shown on the drawings and in the specifications may not be an accurate representation of the depths and conditions existing at the commencement of dredging operations in this contract.

1.5.6 Before- and After-Dredging Surveys

Conduct before- and after- dredging surveys as specified in Section 01 71 23 SURVEY REQUIREMENTS and Contract Clause: QUANTITY SURVEYS.

Section 35 31 00 Page 5

1.5.7 Commercial Fishing Equipment

There is a potential for commercial fishing equipment (ie. conch pots, black seabass pots, and commercial gill nets), marked by buoys, that could be deployed within the borrow areas at the time of dredging. Exercise caution to avoid this gear to the maximum extent practicable. If the gear cannot be avoided, the Contractor may proceed at risk to his own equipment. The Corps of Engineers or the sponsor or both will attempt to notify the commercial fishermen of the dredging operations and have them remove their fishing equipment prior to dredging.

1.6 DIFFERENTIAL GLOBAL POSITIONING SYSTEM (DGPS)

Provide real time positioning of the dredge, as well as positioning and elevation of the draghead or cutterhead, recorded as specified in Section 01 71 23 SURVEY REQUIREMENTS. See paragraph SUBMITTALS above for submittal requirements.

1.7 RESTRICTIONS ON BEACHFILL OPERATIONS

1.7.1 Order Of Work And Restrictions On Work

Do not conduct beachfill operations in Area 2 until after September 3, 2019.

1.7.2 Beach Closings

a. Close the beach in the active construction area, utilizing temporary fencing, barricades, and signage, in maximum 1,000-foot sections to allow placement of beachfill. Do not advance the closed section of beach until acceptance of a section by the Contracting Officer. All other sections of the beach, except storage areas, are to remain open to the general public.

All beach closings shall be coordinated with the Beach Patrol, local Police and Fire Department to ensure access by emergency vehicles.

b. In addition to the beach closure requirements specified here within, close all public beach access locations, utilizing temporary fencing, barricades, and signage in accordance to the City of Cape May and/or COR requirements. Removal of beach closure restrictions shall be sequenced with completion of contract sections upon approval of the Contracting Officer.

1.7.3 Pipe Ramps

Provide ramps over the pipeline at all street ends and pedestrian, vehicle and handicap accessible crossover access points to allow safe public access to the ocean. The ramps shall be 6 feet wide (measured along the pipeline), with 3:1 slopes and one foot minimum of cover over the pipeline. Ensure that any movement of pipeline or equipment is conducted with recognition to the public presence, in accordance with the approved Accident Prevention Plan.

1.8 DEDICATED PUBLIC SAFETY PERSONNEL

Provide a minimum of one public safety person to patrol the perimeter of each closed beach area and direct the public to not enter the construction area. A dedicated public safety person shall be provided at all times during active construction operations and have no other responsibilities.

Section 35 31 00 Page 6

1.9 OUTFALL MAINTENANCE

Once beachfill operations come within 1,000 feet of an outfall, the Contractor shall establish, if necessary, and maintain drainage at that outfall until final demobilization of all dredging- and beachfill-related personnel and equipment is complete.

1.10 DEBRIS PREVENTION

Propose, and submit for approval, a method to ensure that debris (either dredged from the borrow areas or deposited by the Contractor's personnel) is not deposited upon the beach and buried by beachfill material. A proposed monitoring program shall be included, using the Contractor's personnel, to monitor the proposed debris-prevention method's results.

Debris includes, but is not limited to, cobbles, clay balls, shells, and man-made trash and materials.

1.11 FUEL OIL HANDLING

Ensure that all fuel oil transfer operations to or from his plant comply with all applicable Federal, State, and municipal laws, codes, and regulations. Incorporate in the accident prevention plan, required under Paragraph "Accident Prevention Plan", sufficient information to demonstrate compliance with 33 CFR 156 and all other applicable laws, codes, and regulations.

PART 2 PRODUCTS (Not Used)

PART 3 EXECUTION

3.1 EXISTING DEBRIS AND ITEMS REMOVAL

Prior to commencing beachfill work from Sta. 68+24 to Sta. 85+03, remove all debris and miscellaneous items, including, but not limited to, existing sand fence, posts, wood, wood ramps, stairs, and retaining walls from the existing beach prior to commencing work and dispose of them offsite. Do not bury existing debris or miscellaneous items of any kind with the new beachfill.

3.2 SURVEY REQUIREMENTS

See Section 01 71 23 SURVEY REQUIREMENTS for all qualification, equipment, performance and submittal requirements associated with project surveys, including, but not limited to, the establishment of baselines, staking and flagging, pre- and post-placement condition surveys, before- and after-dredging surveys of the borrow areas, and before- and after-beachfill surveys.

3.3 PLACEMENT OF BEACHFILL

3.3.1 General

Place and shape beachfill material to the beachfill template lines, grades, slopes, and elevations shown on the contract drawings. There shall be no pronounced ridges or wash holes in the final grades and slopes unless otherwise indicated. Beachfill lines and grades shall extend linearly between payment sections with no scallops in planform contours.

Conduct work operations so that no areas landward of the work limits shown

Section 35 31 00 Page 7 on the Contract Drawings are disturbed. Land-based equipment shall be used for grading the beachfill material, except, as specified below. If the beachfill material is stockpiled and subsequently moved to the final position using land-based equipment, wait 24 hours after placement of beachfill before conducting after-beachfill surveys of an area.

3.3.2 Removal of Debris

When MEC or MEC-like items are detected on the beach, implement the procedures specified in Paragraph "DETECTION OF MEC" in Section 01 35 30

MUNITIONS AND EXPLOSIVES OF CONCERN (MEC) CONSTRUCTION SUPPORT.

During the operation of placing beachfill material, remove and dispose of all debris resulting from construction operations from the work site, at no additional cost to the Government. Such disposal shall comply with all applicable Federal, state and local laws.

3.3.3 Placement of Beachfill Beneath Existing Structures and Outfalls

Place and grade beachfill material by hand beneath existing beach structures and outfalls. Protect the existing beach structures from damage. Leave 2 feet of clearance between the top of the beachfill template and the bottom of the existing structural members supporting the decking. Place beachfill material beneath structures in a manner that minimizes the ponding of water. If ponded areas are created due to the Contractor's operations, pump these areas dry, at no additional cost to the Government. Repair or replace structures that are damaged due to Contractor operations, in a manner as determined and directed by the Contracting Officer, at no additional cost of the Government. All existing structures located on the beach, including but not limited to, pipes, piles, debris, walls, utilities, etc, are to remain and be covered by fill where applicable. Take necessary precautions to safely perform backfilling operations in the vicinity of existing structures being filled.

3.3.4 Placement of Beachfill Above Groins

Place a minimum of 5 feet of beachfill cover over groins, piles, and revetments prior to the use of equipment across these structures. Repair damage to these structures as a result of work operations, at no additional cost to the Government.

3.3.5 Hydraulic and Hopper Dredges

Keep pipelines used with hydraulic dredging in good condition at all times, and promptly repair leaks or breaks. Load material excavated by hopper dredging into bins or hoppers and pump directly to the beachfill area by a means which prevents the loss of any material into the ocean.

Take special care to ensure that hoppers do not leak during any phase of the contract work.

3.3.6 Marking of Pipeline

Provide barricades, warning signs and lights, subject to the approval of the Contracting Officer, as part of the accident prevention plan, for the protection and safety of the public using the adjacent beach areas.

Clearly mark the beachfill dredge pipe with buoy signs or other signage approved by the Contracting Officer, at a distance of 200 feet seaward of the low water line, at all locations that the dredge pipe is landed. This signage shall warn the public of the location and danger of the submerged

Section 35 31 00 Page 8 pipe. Install barricades, warning signs, and lights prior to the start of work. Notify the Coast Guard for issuance of a "Notice to Mariners" in accordance with Section 01 30 00 ADMINISTRATIVE REQUIREMENTS.

3.3.7 Removal of Stakes and Markers

Remove stakes, markers, temporary fencing, burlap, piping, or other items used in the construction of the beach within 24 hours after completion and before approval of an acceptance section, in accordance with the approved grade stake recovery plan, or as otherwise directed by the Contracting Officer. Remove stakes, markers, temporary fencing, burlap, piping, or other items used in the construction that become uncovered after approval of the acceptance section, within 24 hours of their detection. Report grade stake removals and lost stakes weekly to the COR.

3.3.8 Template Quantity

The required template placement quantity of sand between survey lines will be determined by the average-end-area method using the difference in cross-sectional area between (1) the cross-section surveys obtained by the Contractor before the beachfill operations in accordance with Section 01 71 23 SURVEY REQUIREMENTS and (2) the template lines shown on the drawings.

3.3.9 Placement Tolerances

a. A vertical tolerance of plus 0.5 feet and minus 0 will be permitted on the berm portion of the beach.

b. Adjusted Construction Template Request: Submit documentation describing why the specified foreshore slope cannot be achieved in an area, and requesting permission to adjust the construction template, as specified herein. Include in the documentation the location, by project site and range of survey baseline stations, for which the request is being made.

c. Adjusted Construction Template: Place beachfill to the minimum seaward edge of berm and to the foreshore slope indicated on the drawings, however, with Contracting Officer approval, the Contractor may adjust the construction template by advancing the edge of berm seaward (at the same elevation) and modifying the foreshore slope to achieve the required placement quantity within the footprint of the beachfill template shown on the drawings. An example of an adjusted construction template is attached to this section.

d. In the event that the berm elevation, the minimum seaward edge of berm or the required placement quantities are not met, recommence beachfill operations until the requirements are met. The Contractor will not be required to recommence beachfill operations in the event of erosion and/or storm damage in areas where beachfill has been completed and the survey data demonstrates compliance with the contract requirements.

3.3.10 Payment Tolerance

For payment, there will be no vertical tolerance permitted on the berm or dune portion of the beach. Payment will be made for placement, only to the lines and grades shown on the contract drawings (see Measurement and Payment paragraph below). In the event the Contractor adjusts the construction template as specified herein, payment will be made for measured quantity, not exceeding the required placement quantity. Payment

Section 35 31 00 Page 9 will not be made for material placed above the required dune or berm elevation, or placed seaward of the toe of slope. The toe of slope shall be defined as the point of intersection of the template as shown on the drawings with the before-placement survey profile.

3.4 CONTRACTOR QUALITY CONTROL

3.4.1 Contractor Reports

Prepare and maintain Daily Report of Operations forms, and submit signed copies thereof with the daily Quality Control Records required in Section 01 45 00 QUALITY CONTROL. Complete Daily Report of Operations forms in the RMS system and submit daily to the COR. Copies of the Daily Report of Operations forms to be used are included at the end of this Section.

Indicate on the daily forms, the location and depth of dredging in the borrow areas. Include a map showing the location of the borrow areas.

Submittals for the Daily Report of Operations are available to the public.

3.4.2 Samples and Testing

Obtain samples of beachfill material from the finished beach at 500 foot intervals not more than two days following placement and final grading of beachfill and have them tested for grain size distribution in accordance with ASTM D422. Perform testing by a Corps of Engineers approved laboratory as specified in Section 01 45 00 QUALITY CONTROL. Obtain samples at approximately elevation +5.00 NAVD 88 on the foreshore slope.

Record test results on ENG Form 2087, a copy of which is included in Appendix F90. Also record on ENG Form 2087 the location of the dredge within the borrow area and the depth of dredging at the time of placement of the sand sampled.

3.4.3 Form Preparation

Instructions regarding the preparation of all required forms will be provided at the Contractor Quality Control Coordination Meeting.

3.5 MEASUREMENT AND PAYMENT

3.5.1 Mobilization and Demobilization

All costs connected with the mobilization and demobilization of the Contractor's plant and equipment for dredging and beachfill operations will be paid for at the contract lump sum price for the Base Bid Item, "Mobilization and Demobilization". Sixty percent of the lump sum price will be paid to the Contractor upon completion of his mobilization at the work site. The remaining forty percent will be included in the final payment for work under this contract. Mobilization and demobilization costs for other work under this contract (ex. crossover, outfalls, etc.)

shall be included in the costs of the bid items to which the mobilization and demobilization is incidental.

a. Mobilization shall include all costs for operations accomplished prior to commencement of actual beachfill placement; that is transfer of all plant and equipment to the work site, initial installation of pipelines, and all other incidentals in advance of beachfill placement operations.

b. Demobilization shall include general preparation for transfer of the plant and equipment to the Contractor's home or standby base, Section 35 31 00 Page 10 removal of pipelines, cleanup, and the transfer of plant and equipment to the home or standby base.

All costs in connection with any additional mobilization and demobilization of the Contractor's plant and equipment in connection with the Option Bid Items, shall be included in the contract unit price for the respective Bid Items.

3.5.1.1 Contractor Furnished Cost Data

In the event the Contracting Officer considers that the amount in this item (sixty percent) which represents mobilization, does not bear a reasonable relation to the cost of the work in this contract, the Contracting Officer may require the Contractor to furnish cost data to justify this portion of the bid price. Failure to justify such price to the satisfaction of the Contracting Officer will result in the payment of actual mobilization costs, as determined by the Contracting Officer, at the completion of mobilization, and the payment of the remainder of this item will be included in the final payment under the contract. The determination of the Contracting Officer in these circumstances is not subject to appeal.

3.5.2 Placement of Beachfill

Beachfill material placed in the designated areas, and placed to the lines and grades shown on the contract drawings and within the payment tolerances specified herein, will be measured for payment by the cubic yard in place on the beach. Payment will be made at the contract unit prices for the Base Bid and Option Bid Items titled "Beachfill." Payment for the Bid Items shall also include, but not be limited to, full compensation to the Contractor for removing all existing debris, including posts, wood and any other miscellaneous items, (except sand fence demolition), performing all project surveys, providing public safety personnel, and performing all material testing required. If the Contractor fails to remove boulders, cobbles, clay balls, or other debris from the beach, that completed fill section will not be accepted for payment.

a. The total number of cubic yards placed will be computed by the average-end-area method from the before- and after-beachfill profile surveys obtained by the Contractor as specified in Section 01 71 23 SURVEY REQUIREMENTS and as required by Contract Clause QUANTITY SURVEYS. The volume so computed, up to a quantity not to exceed the bid quantity, will be the pay quantity for the contract. A deduction of one cubic yard will be made from the pay quantity for every cubic yard of material removed from below the maximum allowable elevation indicated for the borrow areas (i.e., the maximum allowable depth plus 1 foot overdepth), or from outside the borrow area limits shown, or in excess of the maximum allowable quantity from the borrow areas. Any deductions will be based on before-dredging surveys conducted prior to dredging the borrow areas and after-dredging surveys conducted following dredging of the borrow areas as specified in Section 01 71 23

SURVEY REQUIREMENTS.
