CONTROL NO. 16-006

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

For Brand Name, ALCO parts

1. CONTRACTING AGENCY:

The contracting activity is the US Army Corps of Engineers (USACE), Philadelphia District, Contracting Division, Supplies and Services Branch (CENAP-CT-S). The requiring activity is the USACE Operations Division.

2. DESCRIPTION OF ACTION:

Approval is respectfully requested to enter into a new fi rm-fixed-price contract for the services needed to rebuild and overhaul engine cylinder heads in ALCO brand engines on the Dredge McFARLAND. The Contractor will be directed to purchase and use only ALCO brand parts. This justification and approval only covers the portion of the acquisition directing the contractor to use ALCO brand parts. The Independent Government Estimate (IGE) is in the amount of $224,000.00. Only a portion of this $224,000.00 will be used to purchase the necessary ALCO brand parts. Revolving funds have been committed under PR&C No. W25PHS-5162-0539.

3. DESCRIPTION OF SUPPLIES/SERVICES OR NATURE OF CONSTRUCTION:

It is the Government’s intent to acquire the services needed to rebuild and overhaul a total of fifty-six (56) ALCO model 251-C marine engine cylinder heads. The contractor will be required to provide all labor, parts, materials, equipment and services required to rebuild and overhaul the engine cylinder heads in accordance with ALCO specifications MI-11020G, DRP-12200N, and DRP-12400H. The solicitation shall specify that the contractor must purchase and use only ALCO brand parts. As noted above, the Independent Government Estimate (IGE) is in the amount of $224,000.00. Only a portion of this $224,000.00 will be used to purchase the ALCO brand parts needed to rebuild the cylinder heads.

4. AUTHORITY CITED:

10 U.S.C §2304(c)(1) as implemented by FAR 6.302-1(a) and (c). This justification and approval only covers the portion of the acquisition specifying that the contractor must purchase and use only ALCO brand parts.

5. REASON FOR AUTHORITY CITED:

Fairbanks Morse Engine (FME) is the sole manufacturer of the ALCO 251 series engines currently in use onboard the Dredge McFARLAND. They design and manufacture all of the factory OEM (Original Equipment Manufacturer) parts for these engines. Their knowledge and experience is paramount to maintaining safe and efficient operation of these engines. The District does not have access to all the (proprietary) drawings necessary to have these parts made. All parts for past engine rebuilds and basic maintenance needs have been obtained using factory part numbers from either the factory or distributors. Reverse-engineering of these parts would be cost-prohibitive and would present an unacceptable safety risk, akin to the use of non-OEM/aftermarket parts. The use of such parts have led to problems in the past, including a crankcase explosion that caused an injury, as well as premature wear of engine parts necessitating emergency repairs. FME maintains strict quality control over the parts they make for these engines. They are the only source that designs and manufacturers these parts to work together as a system.

6. EFFORTS TO OBTAIN COMPETITION:

These engine cylinder heads can be rebuilt and overhauled by any number of firms that specialize in such work. A combined synopsis/solicitation of the intended procurement will be published as required by FAR 5.203(c). This procurement will be placed on the Government Point of Entry (GPE) as a full and open solicitation.

ACTIONS TO INCREASE COMPETITION:

Competition for the actual work is readily available in the open market place. As noted above, a combined synopsis/solicitation of the intended procurement will be published as required by FAR 5.203(c). This procurement will be placed on the Government Point of Entry (GPE) as a full and open solicitation

8. MARKET RESEARCH:

Based on historical procurement data for this type of work, there are several vendors (some examples are set forth below) that can perform the work required. It will be the responsibility of the selected contractor to acquire the ALCO brand parts from ALCO or another authorized source.

9. INTERESTED SOURCES:

Coltec Industries: CAGE Code: 82796 Engine Systems Inc.: CAGE Code: 6Y051 American Turbocharger: CAGE Code: 1SGT6 Marine Systems: CAGE Code: 0W9L4

10. OTHER FACTS:

Justifications and approvals are required by FAR 13.501(a)(2) for a portion of an acquisition requiring a brand-name product as is the case in this procurement. Because this procurement falls under FAR 13.501(a)(2)(i), the approval rests with the contracting officer; “for a proposed contract exceeding $150,000, but not exceeding $700,000, the contracting officer’s certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief will serve as approval, unless a higher approval level is established in accordance with agency procedures.”

Fair and Reasonable Cost Determination:

I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable. In accordance with (IAW) FAR 15.403-1(c)(1)(ii) there is a reasonable expectation, based on market research, that two or more responsible offerors, competing independently, will submit priced offers in response to the solicitation’s expressed requirement. In accordance with FAR 15.404-1(b), Price Analysis will be conducted from received offers (competition, FAR 15.403-1(c)(1)(i)) and then compared to the IGE (FAR 15.404-1(b)(2)(v) in order to determine if the price is fair and reasonable. Certified cost or pricing data is not required for this procurement in accordance with FAR 15.403-1(b)(3) “When a commercial item is being acquired.”
