52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1. TECHNICAL CAPABILITIES:
a. Sub-factor: Experience Elements:
Facility: Experience, at the designated facility, building at least two aluminum catamarans, 50 feet or longer, in the last five years
Design: Experience designing two foil assisted catamarans, 50 feet or longer, in the last five years.
b. Sub-factor: Product Elements:

2. PAST PERFORMANCE
i. Review of past performance on contracts identified in the offer. Review of questionnaire
ii. Information obtained from references provided in the offer, and other appropriate sources.
iii. Review of offeror provided information relevant to problems encountered on the contracts identified in the offer.
3. PRICE:
i. Lowest Price Technically Acceptable.
Proposals will be rated as acceptable/ unacceptable. The definition of acceptability/unacceptability is as follows:
Rating Description:
Acceptable: Quote clearly meets the minimum requirements of the solicitation.
Unacceptable: Quote does not clearly meet the minimum requirements of the solicitation.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
(End of Summary of Changes)
The Government has received several questions concerning the solicitation and provides the following answers to these questions (Questions that may be of general interest of all offerors/Government and that are not readily answered by the proceeding changes will appear below.
These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or clarify and simplify the question(s). Questions and answers are issued to the Offerors for information only.
1. The best quality marine high load slide systems use hardcote anodized 6061 T6 alloy. This is a tested off the shelf solution. Would this be acceptable?
Answer: Hardcote anodized 6061 T6 alloy is not acceptable.
2. Item 6, can you confirm that all aluminum plate and stiffeners in the hull is to be 5083 H116 for maximum strength and not 5052?
No specific metal requirement is laid out in the spec other than the fact that all plate in the hull shall be 5000 series aluminum.
3. Item 10, can you confirm that all forward facing windows require the linear wipers and be electrically heated, or is it meant to be the windshields by way of the pilot station?
All forward facing windows on the same level as the pilot station shall have linear wipers and be electrically heated. There is no such requirement for forward facing windows on a different level.
4. Item 10, can you confirm that all cabin windows, including rear bulkhead and sides are to have tinted mylar shades?
Confirmed
5. Item 16-a,IN solicitation ending NO 0050 you require light weight single piece foam anti fatigue matting for flooring. By single piece do you mean a rolled type flooring that might have 1 or 2 seams in it? The widest flooring we know of is 12’ wide. Please advise.
Seams are acceptable and expected, though they should be minimized. The intent of the spec is to prevent "tiled" anti fatigue matting.
6. Item 16-a, In solicitation ending No 0051, you require a poured epoxy type floor. You also specify Corian counter tops whereas 0050 are to be laminate tops. Can you please confirm these tow boats are to be built differently with different outfit items? One would think that standardized fitout would be an advantage to the USACE for maintenance and repair.
Confirmed. These boats are for separate customers in different areas of the country and are two totally independent packages.
7. Item 18, you state that the lower tier of rubrails is to ‘run around the hull’ the full length of the hull. Would a partial length of the hull from the transom be acceptable? We are concerned that the low height of the fendering will cause undue spray in the forward sections.
This is acceptable.
8. Item 22, you do not state that fuel tanks are to be removable, can you confirm if this is required?
Fuel tanks shall not be removable.
9. Item 40, This item states that the survey desks are to be mounted facing fore and aft with outboard ends against the house sides. This conflicts with your sketch. Can you reconfirm the survey desk arrangement. Also in Item 11 it states desks are to be L shaped or angled.
Please note that the requirements are different for each boat. For 0050, there is a conflict between the spec and the sketch. The spec shall govern.
10. Item 41, we do not see that an A-frame winch is specified, can you please confirm.
No A frame winch is required.
11. Item 41&45, Can you confirm if the builder is to include the supply and installation of this survey equipment or will this be supplied and installed by the USACE and/or require an expert to install the survey equipment at the shipyard? Can you also confirm if this is all the survey equipment required for these vessels?
No survey equipment is to be supplied nor installed under this solicitation, however all provisions for such installations shall be made.
12. Item 34C and 15C, You specify a requirement for outside experts for the silencer design and control system. We have not had a response from either of these sources and Mr. Sullivan’s email bounces back. Can you please provide an alternate email for Mr. Sullivan and one for Mr.
Ockerman?
The government has verified that the specified phone number for Dr. Sullivan is correct however, the correct e-mail address is scs.joe1@comcast.net.
The government has verified that the provided phone number is correct for Ockerman Automation.
13. Item 3, The minimum requirements for freeboard in the tunnel are specified at 5.5 feet at the bow and 1.8 feet at the transom, do these dimensions mean from the wave striker under the tunnel or to the mean height of the tunnel?
A11 - The freeboard is from the waterline to the deck edge at both bow and stern.
14. Delivery, will you consider a later delivery for one of these solicitations, as to build two vessels of this complexity in 480 days for small businesses may be difficult for a small business.
The two solicitations are independent and the performance periods are not related therefore they remain at 480 days.
15. Section L 4.0.1, requires that the bidder provide details on ‘at least two aluminum vessels 50 feet or longer’ built during past five years. Our company has built approximately 12-15 vessels of similar or greater complexity over the past five years. However under minimum requirements P 63 paragraph 3 you state at the facility in the past five years. Our company has moved to a new facility in the past two years. Does facility really mean the company, can we amend the wording to state the company.
For the purpose of the minimum requirements under section 4.0.1 and the requirement “built at the facility in the past five years”, the relocation of organizational assets within the same geographic area satisfies the requirement.
16. Evaluation, We would like to clarify that 52.212-2, (a) 1-a conflicts with Section L, 4.0.
Clause 52.212-2 (a) 1-a has been amended to meet the same requirement stated in Section L 4.0.
