RFI# Request for Information Response

Can the Government please provide the contract drawing’s bathymetric survey data of the dredging areas, in AutoCAD or XYZ format? This data will be available to anybody who requests it.

Additionally, please provide the current condition of the Government-furnished upland disposal area – Fort Mifflin Disposal Area C, in AutoCAD or XYZ format.

The information that is shown on the drawings is the latest that is available. Bid as shown.

Section 01 11 00, Paragraph 1.5.1, states that, “The ship in the Reserve Basin will be moved by others in groups and/or individually to allow the Contractor to dredge the basin.” With the unforeseen or uncertainty of the “others” activity, the potential risk for the dredge to be placed on standby is conceivably high. We, therefore, request that the Corps add an hourly standby bid item to the bidding schedule to account for any delays caused by the group responsible for moving the ships.

No additional bid item will be added. This risk should be factored into the cost of all the bid items. Bid as shown.

Encountering MEC during dredging is likely. We request that the Corps add an hourly standby bid item to the bidding schedule to account for major delays caused by MEC inspection, identification or removal. This question and #3 above could be one bid item.

No additional bid item will be added. This risk should be factored into the cost of all the bid items. Bid as shown.

Section 01 11 00 Paragraph 1.3 states, “The contractor shall commence dredging in Acceptance Section 1 and proceed towards the Schuylkill River to Acceptance Section 5.” However, the Contract Drawing Page C-102 shows only AS1 to AS4. Please clarify.

There is only 4 acceptance sections. See Amendment No.

The specifications state that the disposal location is Ft. Mifflin Area C. There is another solicitation out for the Dredging & Rock Removal (Solicitation W912BU- 15-B-0009) that will also utilize the same disposal site. If there are two concurrent contracts using the same disposal site,

a. Which contractor is responsible for preparing the site to accept material?

b. Which contractor has priority to use the existing sluices?

c. Will both contractors be utilizing the same sluices?

d. Which contractor is responsible for maintaining effluent water quality standards?

e. Which contractor is responsible for maintaining the dikes and sluices?

Solicitation W912BU-15-B-0009 will be amended to change the location of the disposal area. Only this contract will be utilizing Area C.

Section 01 11 00, page 3, paragraph 1.11 states; “The Contractor shall be required, when directed by the COR, to coordinate the shutting down of those intakes prior to dredging that particular section of the basin.”

a. Please explain or describe what this coordination involves on the part of the contractor. Is there any scope relating to this or is the contractor solely expected to stand by while this is accomplished?

b. How many shutdowns are anticipated?

c. Can the Corps provide an estimated duration for each shutdown?

The only anticipated coordination involved, is that the Contractor will need to notify the tenants who operate the intakes, that they will be dredging in that area of the basin where an intake exists. The Contractor will not be required to actually "shut down" the intake. That will be done by the tenant who owns the intake.

Amendment 0001, Section 01 35 30, page 7, paragraph 3.7 states; “Submit a Explosive Safety Submission (ESS), which has a 60-day approval process, per EM 385-1-97. The ESS shall be submitted prior to any dredging activities.”

a. Does this apply to debris removal activities, as well as dredging activities?

b. Can dredging and debris removal activities begin once the ESS is submitted or do the activities need to wait until the ESS is accepted (60 days)?

c. If the activities can’t begin until acceptance of the ESS, does preparing the submittals satisfy the requirement to commence work within 10 days of NTP?

Yes, this applies to all dredging/debris removal activities.

Dredging/debris removal activities cannot begin until the ESS has been approved. Preparing the submittals does satisfy the requiment of commencing work. Immediately after award, the Contractor should work and coordinate with the OESS to prepare the ESS, which should eliminate any delays in the approval process.

In an effort to help reduce the number of lift bridge openings, we request that dredge personnel be able to park their vehicles along the bulkhead on Constitution Ave or at another location on the Reserve Basin designated by the Navy.

Two possible parking areas near the Reserve Basin have been made available for dredge personnel to park their vehicles. The final parking area will be determined by the COR and Navy, after award. See Amendment No. 0002.

It is acknowledged by the GOVT that MEC is present inside the basin and was encountered on previous projects. However, the type and quantity is unknown and previous delays are not provided in the specs. Therefore, it is impossible for the contractor to estimate the number of MEC shutdowns, lost time, and associated risks. In an effort to avoid a “Change of Conditions” Claim, please add a line item to the bidding schedule for MEC Standby with an hourly unit.

No additional bid item will be added. This risk should be factored into the cost of all the bid items. Bid as shown.

REQUESTS FOR INFORMATION with RESPONSES Solicitation No. W912BU-15-B-0013

RFI# Request for Information Response

It is anticipated that our dredging and unloading operations will take place 24/7.

Is the lift bridge operated 24/7? If not, what is the schedule for manned operations?

With proper coordination, the lift bridge will be operational 24/7.

Adjacent to both sides of the “No Dredging” area, there is approximately 10’ of bank with no payable slope material. This results in the contractor dredging a significant amount of non-pay material. Please consider adding a slope or 25’ payable extension for these areas.

No slope or extension will be added. Bid as shown.

Can the contractor expect the ability to use (with Navy coordination) some dock space inside the basin to temporarily secure barges?

Yes, dock space will be available for the Contractor to use to secure his barges. The dock space will be limited to the Acceptance Section that the Contractor is working in, shall be within the limits of dredging, and must be approved by the COR and the Navy. No dock space will be available within the "no dredging" area, as shown on the drawings.

The Dredging Restriction dates in different sections of the Specs contradict each other… Please clarify which set of dates are correct and remove or revise the erroneous dates.

See Amendment No. 0002

During the site visit of 08/31/2015, there were various large pumps in place on the bulkhead near the SW corner of AS 3. Do any part of the pumps (including suction hoses) encroach into the AS 3 project limits? If so, what measures will be taken by the government to ensure that these pumps are not damaged?

The pumps are outside the dredging limits.

Section 00 73 15 Page 22

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Section 00 73 15 Page 23

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

Section 00 73 15 Page 24

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.
