SCOPE OF WORK

1. The following information is furnished for preparation of a service contract solicitation for the partial removal of a dilapidated timber jetty located within Cedar Creek at the confluence of the Mispillion River in Slaughter Beach, DE.

2. Work Covered by Contract: The contract shall cover all costs of investigation, via diving, removal, and disposal of the remains of the old south jetty, which is a timber structure, in strict accordance with these specifications. The Contractor shall perform a dive inspection with report of the structure prior to removal to determine the extent of the structure that needs to be removed, and post removal dive inspection and side scan survey final river bottom conditions presented in a report. This wooden structure must be removed to the mud line. Since this structure is in shallow water, the limit of removal will vary. Final acceptance of work is subject to the approval of the Contracting Officer Representative. The contractor shall furnish a Work Plan and a Health and Safety Plan ten (10) days prior to start of work.

3. Location and Description: The former Mispillion Inlet South Jetty is located at the confluence of Cedar Creek and the Mispillion Rivers near the old Mispillion Light in Delaware. The 80-plus year old structure is approximately 1100 feet in length. The wooden structure consists of timber piles and timber cross members. Some of the timber piles are only visible at low water. During higher tide stages, the structure is not visible resulting in a serious safety hazard to boating traffic.

4. Method of Removal.

a. Prior to commencement of the work, the contractor shall submit to the Contracting Officer complete information and details of his proposed method and schedule for performing the removal operation. The contractor shall provide the dive report information to the Contracting Officer prior to the commencement of removal operations.

The contractor shall remove the old timber structure by cutting it at the mud line (via certified commercial diving engineer and chain saw) and removing. This is the preferred method for removal because it minimizes environmental impacts. The contractor must also provide the location of the disposal site and his plan to prevent the escape of debris from the work area. If any parts of the structure are deposited elsewhere than in places approved by the contracting officer, the contractor will be required to remove same and deposit them where directed without additional cost to the government.

b. Upon the completion of the removal operation, the contractor shall perform a final survey of the work site and provide a written report with mapping showing evidence satisfactory to the contracting officer that the entire structure has been removed to the mud line.

5. Contract Time: The contractor shall complete all work under this task order within 30 days of the Notice to Proceed. This schedule is subject to adjustment by the Contracting Officer in writing for conditions beyond the control of the parties hereto.

6. General Diving Requirements: All diving performed under this contract shall be in strict accordance with the rules and regulations prescribed by the U.S. Navy Diving Manual: 0910-LP-708-8000; 29 CFR Part 0910, Subpart T; 29 CFR Part 1915; the EM 385-1-1, Section 30; and ER 385-1-86, except as modified by updated publications to be provided by the District. A Contracting Officer’s Representative, will be designated by the Contracting Officer at the Post Award Conference, to act for the Contracting Officer for all submissions, directions and/or acceptance

(s) required under the specifications. There will also be an individual designated as the District Dive Coordinator.

The contractor will be required to provide a dive plan to the District Dive Coordinator for review and approval prior to any divers entering the water for work purposes under this contract.

7. POC for questions regarding this project should be directed to Mr. Charles Myers, Mispillion River Project Manager at 215-656-6736 or Mr. Eric Charlier, Mispillion River Navigation Hazard Removal Project Manager at 215-656-6668.

8. Liquidated Damages: If the contractor fails to complete the work within the time specified in the contract, the contractor shall pay liquidated damages to the Government in the amount of $1350.00 for each calendar day of delay until the work is completed or accepted.

9. The following contract drawings and reports, all of which are available in the Office of the Chief, U. S. Army Engineer District, Philadelphia District, Operations Division, 6th floor, are provided for the contractor’s information.

Each quote shall include description of the following: Relevant experience of marine salvage operations, Past Performance on similar operations, with reference contacts and verification of a successful operation.

11. Survey control data, such as channel stationing coordinates, vertical control, and tide/datum information will be provided by the Philadelphia District Survey Branch.

12. Obstruction of Channel: The Government will not undertake to keep the channel free from vessels or other obstructions, except to the extent of such regulations if any, as may be prescribed by the Secretary of the Army, in accordance with the provisions of Section 7 of the River and Harbor act approved 8 August 1917. The Contractor will be required to conduct the work in such a manner as to obstruct navigation as little as possible, and in case the contractor’s work plant so obstructs the channel as to make difficult or endanger the passage of vessels, said plant shall be promptly moved on the approach of any vessel to such extent as may be necessary to afford a practicable passage. The contractor shall request the U.S. Coast Guard to issue a Notice to Mariners advising navigation interests that the contractors plant and diving operations will be situated in the lower reach of the Cedar Creek and Mispillion River channels. The contractor shall submit a request to the U.S. Coast Guard, MSO/Group Philadelphia, 1 Washington Avenue, Philadelphia, Pa. 19147-4395.

(h) Certification Regarding Responsibility Matters (Executive Order 12689). The offeror certifies, to the best of its knowledge and belief, that --

(1) The offeror and/or any of its principals ( ) are, ( ) are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency,

(2) ( ) Have, ( ) have not, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a Federal, state or local government contract or subcontract; violation of Federal or state antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property; and

(3) ( ) are, ( ) are not presently indicted for, or otherwise criminally or civilly charged by a Government entity with, commission of any of these offenses enumerated in paragraph (h)(2) of this clause; and

(4) ( ) Have, ( ) have not, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,000 for which the liability remains unsatisfied.

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).

(i) Certification Regarding Knowledge of Child Labor for Listed End Products (Executive Order 13126). (The Contracting Officer must list in paragraph (i)(1) any end products being acquired under this solicitation that are included in the List of Products Requiring Contractor Certification as to Forced or Indentured Child Labor, unless excluded at 22.1503(b).)

(The contracting officer is to check a box to indicate if paragraph (k)(1) or (k)(2) applies.)

( ) (1) Maintenance, calibration, or repair of certain equipment as described in FAR 22.1003-4(c)(1). The offeror ( ) does ( ) does not certify that--

(i) If the offeror does not certify to the conditions in paragraph (k)(1) or (k)(2) and the Contracting Officer did not attach a Service Contract Act wage determination to the solicitation, the offeror shall notify the Contracting Officer as soon as possible; and

(ii) The Contracting Officer may not make an award to the offeror if the offeror fails to execute the certification in paragraph (k)(1) or (k)(2) of this clause or to contact the Contracting Officer as required in paragraph (k)(3)(i) of this clause.

(l) Taxpayer Identification Number (TIN) (26 U.S.C. 6109, 31 U.S.C. 7701). (Not applicable if the offeror is required to provide this information to a central contractor registration database to be eligible for award.)
