WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor
Section 00815 Page 3
200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.

Section 01 33 00 Page 13 large to permit a free flow of concrete. The concrete shall be deposited so that it enters the mass of the previously placed concrete from within, displacing water with a minimum disturbance to the surface of the concrete. The discharge end of the pump line or tremie shaft shall be kept continuously submerged in the concrete. The underwater seal at start of placing shall not produce undue turbulence in the water. The tremie shaft shall be kept full of concrete to a point well above the water surface.
Placement shall proceed without interruption until the concrete has been brought to the required height. The tremie shall not be moved horizontally during a placing operation, and a sufficient number of tremies shall be provided so that the maximum horizontal flow of concrete will be limited to 15 feet. Concrete shall not be deposited in running water or in water with a temperature below 35 degrees F.
3.6 JOINTS
Joints shall be located and constructed as approved. [DELETION.] All reinforcement shall be continued across joints. [DELETION.]
3.6.1 Construction Joints
[DELETION.] Fresh concrete shall not be placed against adjacent hardened concrete until it is at least 24 hours old. Construction joints shall be located as indicated or approved. Where concrete work is interrupted by weather, end of work shift or other similar type of delay, location and type of construction joint shall be subject to approval of the Contracting Officer. Reinforcing steel shall extend through construction joints.
3.7 CURING AND PROTECTION
No curing is necessary for the concrete covered by the vinyl sheet pile.
The horizontal surface of the concrete shall be cured by an approved method for 7 days. All references to curing are strictly with regards to the horizontal surface.
3.7.1 General
Immediately after placement, concrete shall be protected from premature drying, extremes in temperatures, rapid temperature change, mechanical injury and damage from rain and flowing water for the duration of the curing period. Air and forms in contact with concrete shall be maintained at a temperature above 50 degrees F for the first 3 days and at a temperature above 32 degrees F for the remainder of the specified curing period. Exhaust fumes from combustion heating units shall be vented to the outside of the enclosure, and heaters and ducts shall be placed and directed so as not to cause areas of overheating and drying of concrete surfaces or to create fire hazards. Materials and equipment needed for adequate curing and protection shall be available and at the site prior to placing concrete. No fire or excessive heat, including welding, shall be permitted near or in direct contact with the concrete at any time. Except as otherwise permitted by paragraph Membrane Forming Curing Compounds, moist curing shall be provided for any areas to receive floor hardener, any paint or other applied coating, or to which other concrete is to be
Section 03 31 00 Page 15
3.7.2 Moist Curing
Concrete to be moist-cured shall be maintained continuously wet for the entire curing period, commencing immediately after finishing. If water or curing materials used stain or discolor concrete surfaces which are to be permanently exposed, the concrete surfaces shall be cleaned as approved.
When wooden forms are left in place during curing, they shall be kept wet at all times. If steel forms are used in hot weather, nonsupporting vertical forms shall be broken loose from the concrete soon after the concrete hardens and curing water continually applied in this void. If the forms are removed before the end of the curing period, curing shall be carried out as on unformed surfaces, using suitable materials. Surfaces shall be cured by ponding, by continuous sprinkling, by continuously saturated burlap or cotton mats, or by continuously saturated plastic coated burlap. Burlap and mats shall be clean and free from any contamination and shall be completely saturated before being placed on the concrete. The Contractor shall have an approved work system to ensure that moist curing is continuous 24 hours per day.
3.7.3 Membrane Forming Curing Compounds
Concrete may be cured with a pigmented curing compound in lieu of moist curing. Membrane curing shall not be used on surfaces that are to receive any subsequent treatment depending on adhesion or bonding to the concrete, including surfaces to which a smooth finish is to be applied or other concrete to be bonded. Membrane curing compound shall not be used on surfaces that are maintained at curing temperatures with free steam.
Curing compound shall be applied to formed surfaces immediately after the forms are removed and prior to any patching or other surface treatment except the cleaning of loose sand, mortar, and debris from the surface.
All surfaces shall be thoroughly moistened with water. The curing compound shall be applied in a two-coat continuous operation by approved motorized power-spraying equipment operating at a minimum pressure of 75 psi, at a uniform coverage of not more than 400 square feet per gallon for each coat, and the second coat shall be applied perpendicular to the first coat.
Concrete surfaces which have been subjected to rainfall within 3 hours after curing compound has been applied shall be resprayed by the method and at the coverage specified. Surfaces on which clear compound is used shall be shaded from direct rays of the sun for the first 3 days. Surfaces coated with curing compound shall be kept free of foot traffic, and from other sources of abrasion and contamination during the curing period.
3.7.4 Impervious Sheeting
Except for plastic coated burlap, impervious sheeting alone shall not be used for curing. Surfaces shall be thoroughly wetted and be completely covered with the sheeting. Sheeting shall be at least 18 inches wider than the concrete surface to be covered. Covering shall be laid with light-colored side up. Covering shall be lapped not less than 12 inches and securely weighted down or shall be lapped not less than 4 inches and taped to form a continuous cover with completely closed joints. The sheet shall be weighted to prevent displacement so that it remains in contact with the concrete during the specified length of curing. Sheets shall be immediately repaired or replaced if tears or holes appear during the curing
Section 03 31 00 Page 16 bonded. Concrete containing silica fume shall be initially cured by fog misting during finishing, followed immediately by continuous moist curing.
Except for plastic coated burlap, impervious sheeting alone shall not be used for curing.
CONTRACT CLAUSES. Satisfactory material removed below the depths indicated, without specific direction of the Contracting Officer, shall be replaced, at no additional cost to the Government, with satisfactory materials to the indicated excavation grade. Satisfactory material shall be placed and compacted as specified in paragraph FILLING AND BACKFILLING.
Determination of elevations and measurements of approved overdepth excavation of unsatisfactory material below grades indicated shall be done under the direction of the Contracting Officer.
3.3.1 Excavation of existing riprap and associated layers
Existing riprap, the existing underlying layer of bedding stone and the existing backfill layer shall be removed as necessary to install the new vinyl sheetpiles, new concrete seals and the new underlying bedding stone layer. The riprap and bedding stone shall be stockpiled for re-installation to the existing lines after the installation of the concrete seals. The backfill may be re-used, if it satisfies the criteria for satisfactory material.
3.3.2 Monitoring of Movement of Existing Bulkhead
The depths of the existing sheet piles are undetermined. The Contractor shall monitor the existing steel bulkhead for excessive movement or kick-out during excavation. If any such movement is detected, the Contractor shall notify the Contracting Officer immediately.
3.4 SHORING
Shoring, including sheet piling, shall be furnished and installed as necessary to protect workmen, banks, adjacent paving, structures, and utilities. Shoring, bracing, and sheeting shall be removed as excavations are backfilled, in a manner to prevent caving.
3.5 CLASSIFICATION OF EXCAVATION
Excavation will be unclassified regardless of the nature of material encountered.
3.6 BLASTING
Blasting will not be permitted.
3.7 EXCAVATED MATERIALS
Satisfactory excavated material required for fill or backfill shall be placed in the proper section of the permanent work required under this section or shall be separately stockpiled if it cannot be readily placed.
Satisfactory material in excess of that required for the permanent work and all unsatisfactory material shall be disposed of outside the limits of Government-controlled property at the Contractor's responsibility.
3.8 SUBGRADE PREPARATION
Unsatisfactory material in surfaces to receive bedding stone or in the area to be cleared and grubbed shall be removed and replaced with satisfactory materials as directed by the Contracting Officer. The surface shall be scarified to a depth of 6 inches before the fill is started. When subgrades are less than the specified density, the ground surface shall be broken up to a minimum depth of 6 inches, pulverized, and compacted to the
Section 31 23 00 Page 3 specified density. When the subgrade is part fill and part excavation or natural ground, the excavated or natural ground portion shall be scarified to a depth of 12 inches and compacted as specified for the adjacent fill.
Material shall not be placed on surfaces that are muddy, frozen, or contain frost. Compaction shall be accomplished by hand-operated compactors.
Material shall be moistened or aerated as necessary to provide the moisture content that will readily facilitate obtaining the specified compaction with the equipment used. Minimum subgrade density shall be as specified in paragraph FILLING AND BACKFILLING.
3.9 FILLING AND BACKFILLING
Satisfactory materials shall be used in bringing fills and backfills to the lines and grades indicated and for replacing unsatisfactory materials.
Only hand-operated compactors may be used. Satisfactory materials shall be placed in horizontal layers not exceeding 12 inches in loose thickness.
After placing, each layer shall be plowed, disked, or otherwise broken up, moistened or aerated as necessary, thoroughly mixed and compacted as specified. Backfill shall be brought to indicated finish grade. Backfill shall not be placed in wet or frozen areas. Backfill shall be compacted in layers not more than 9 inches in compacted thickness with power-driven hand tampers suitable for the material being compacted. Each layer of fill and backfill shall be compacted to a percentage of maximum density not less than 95%:
Approved compacted subgrades that are disturbed by the Contractor's operations or adverse weather shall be scarified and compacted as specified herein before to the required density prior to further construction thereon.
3.10 PLACEMENT OF BEDDING STONE
[DELETION.] Only after it is determined that all unsatisfactory material has been removed and replaced and any other necessary corrective actions have been taken, then bedding stone shall be placed to the lines and dimensions as shown on the drawings. All surfaces shall be protected from erosion resulting from ponding or flow of water.
3.11 REPLACEMENT OF STOCKPILED RIPRAP AND BEDDING STONE
No less than seven days after the concrete seals have been installed, the stockpiled bedding layer and the stockpiled riprap shall be replaced to the lines and grades indicated on the drawings.
3.12 TESTING
Testing shall be the responsibility of the Contractor and shall be performed at no additional cost to the Government. Testing shall be performed by an approved commercial testing laboratory or may be performed by the Contractor subject to approval. Field in-place density shall be determined in accordance with ASTM D 2922. The calibration curves shall be checked and adjusted if necessary by the procedure described in ASTM D 2922, paragraph ADJUSTING CALIBRATION CURVE. ASTM D 2922 results in a wet unit weight of soil and when using this method ASTM D 3017 shall be used to determine the moisture content of the soil. The calibration curves furnished with the moisture gauges shall also be checked along with density calibration checks as described in ASTM D 3017. The calibration checks of both the density and moisture gauges shall be made at the beginning of a job on each different type of material encountered and at intervals as
Section 31 23 00 Page 4 directed by the Contracting Officer. The following number of tests, if performed at the appropriate time, shall be the minimum acceptable for each type operation.
3.12.1 In-Place Densities
In-place density and moisture content test results shall be included with the Contractor's daily construction quality control reports.
3.12.1.1 In-Place Density of Subgrades
One test per 500 square foot or fraction thereof.
3.12.1.2 In-Place Density of Fills and Backfills
The density for each lift of fill or backfill materials for areas less than 20 feet in width, which are compacted with hand or hand-operated machines shall be tested as follows: One test per each length of 50 feet along the area in which the concrete seal is to be placed along the exterior side of the steel sheet pile and one test for the area to be cleared, grubbed and filled. In-place densities shall be checked by ASTM D 1556 as follows:
One check per lift for each 100 linear feet of long narrow fills, and a minimum of 2 checks per lift for other fill and backfill areas.
3.12.2 Moisture Content
In the stockpile or excavation areas, a minimum of two tests per day is required during stable weather conditions. During unstable weather, tests shall be made as dictated by local conditions and approved moisture content shall be tested in accordance with ASTM D 2216.
3.12.3 Optimum Moisture and Laboratory Maximum Density
Tests shall be made for each type material or source of material, including borrow material to determine the optimum moisture and laboratory maximum density values. One representative test per 50 cubic yards of fill and backfill, or when any change in material occurs which may affect the optimum moisture content or laboratory maximum density will be made.
3.13 SPREADING TOPSOIL
Any areas from which topsoil has been removed shall be topsoiled. The surface shall be free of materials that would hinder planting or maintenance operations. The subgrade shall be pulverized to a depth of 2 inches by disking or plowing for the bonding of topsoil with the subsoil.
Topsoil shall then be uniformly spread, graded, and compacted to the thickness, elevations, slopes shown, and left free of surface irregularities. Topsoil shall be compacted by one pass of a cultipacker, roller, or other approved equipment weighing 100 to 160 pounds per linear foot of roller. Topsoil shall not be placed when the subgrade is frozen, excessively wet, extremely dry, or in a condition otherwise detrimental to seeding, planting, or proper grading.
3.14 PROTECTION
Settlement or washing that occurs in topsoiled, or backfilled areas prior to acceptance of the work, shall be repaired and grades reestablished to the required elevations and slopes.

(5) Uplift and vertical tolerances after driving.
(6) Location and elevation of any obstruction encountered and action directed by Contracting Officer.
(7) Pulled piles and redriving.
(8) Aluminum capping.
(9) Stockpiling and storage.
(10) Removal and disposal of damaged piles.
1.5.2 Reporting
The original and two copies of these records, as well as the records of corrective action taken, shall be furnished the Government daily. Format of the report shall be as prescribed in Section 01 45 04, "CONTRACTOR
QUALITY CONTROL".
1.6 DELIVERY, STORAGE AND HANDLING
Materials delivered to the site shall be new and undamaged and shall be accompanied by materials test certificates. Sheet piling shall be stored and handled in the manner recommended by the manufacturer to prevent permanent deflection, distortion or damage to the interlocks. Storage of sheet piling should also facilitate required inspection activities.
PART 2 PRODUCTS
2.1 MATERIALS
2.1.1 Poly (Vinyl Chloride) Sheet Pile
The sheet piling shall be manufactured by CMI (ShoreGuard). The sheets shall be 21 feet in length, Series 950, (.650" thickness, 59 Section Modulus, 2,667 Design Strength) or an approved equal.
Certified Virgin Materials as defined by this specification. Recycled or reprocessed materials of any kind cannot be used in any amount in the outer surfaces or cap-stock of a co-extruded sheet piling. The sheeting shall be homogeneous throughout and free from visible cracks, flaws, foreign inclusions or other injurious defects. The sheeting and capping plates shall be uniform in physical properties and the color "Grey" and "Black", respectively. All sheet pile shall be provided in full length with no splices.

PART 3 EXECUTION
3.1 INSTALLATION
3.1.1 Placing and Driving
3.1.1.1 Placing
Pilings shall be carefully located as shown on the drawings. Pilings shall be placed as true to line as possible. Suitable temporary wales, templates, or guide structures shall be provided to insure that the piles are placed and driven to the correct alignment. Pilings properly placed and driven shall be interlocked throughout their length with adjacent pilings to form a continuous diaphragm throughout the length or run of piling wall.
3.1.1.2 Driving
As shown on the contract drawings in the section depicting existing conditions, the Contractor is advised that below the existing riprap layer, a layer of aggregate bedding will be encountered. The Contractor is also advised that buried stumps, roots and similar debris might be encountered periodically on the sheet pile wall alignment. The Contractor shall determine and use the proper size/model of equipment to counteract difficult driving and the above obstructions. All piles shall be driven to the depths shown on the drawings and shall extend to the top of wall elevation indicated. A tolerance of 1-1/2 inches above or below the indicated cut-off elevation will be permitted. The driving hammer shall be maintained in proper alignment during driving operations by use of leads or guides attached to the hammer. A protecting cap shall be employed if an impacted hammer is used for driving, to absorb impact shock and prevent damage to the tops of pilings. Pilings damaged during driving or driven out of interlock shall be removed and replaced at the Contractor's expense. Driving with the aid a water jet will be permitted. If a "mandrel" is used to install vinyl, the "water gallery" lubrication to reduce friction and separate the vinyl sheet from the mandrel is acceptable. Adequate precautions shall be taken to insure that piles are driven/installed vertically and horizontally plumb.
3.1.1.3 Obstructions
In case of an obstruction, piling/s will be allowed to remain above final grade until the obstruction is identified by the Contracting Officer and a remedy is provided to the Contractor. If it is determined by the Contracting Officer that an obstruction restricts driving operations and that the obstruction cannot be removed, the Contractor will be directed by the Contracting Officer to either cut the piling/s to design grade or provide the Contractor an alignment change that by-passes the obstruction.
Payment for the additional labor and materials necessitated by such changes will be made in conformance with the CHANGES clause of the CONTRACT CLAUSES.
3.1.2 Emergency Locking System on Pile Driving Head
All pile driving equipment shall be equipped so as to prevent piles from falling when a single or multiple power failure occurs after the pile driving head is attached to the pile.
Section 31 41 16 Page 4
3.1.3 Inspection of Driven Piling
The Contractor shall inspect the interlocked joints of driven pilings extending above ground. Pilings found to be damaged during driving or driven out of interlock shall be removed and replaced.
3.1.4 Pulling and Redriving
The Contractor may be required to pull selected piles after driving, for test and inspection, to determine the condition of the piles. Any pile so pulled and found to be damaged to the extent that its usefulness in the structure is impaired shall be removed from the work and the Contractor shall furnish and drive a new pile to replace the damaged pile, at the expense of the Contractor. Piles pulled and found to be in satisfactory condition shall be redriven, also at the expense of the Contractor. For bidding purposes it is estimated that three (3) previously driven sheet piles be pulled, inspected and redriven (replacing with new as required).
3.1.5 Qualifications
The Contractor shall have prior experience with driving vinyl sheeting and shall provide a list or previous job(s) that demonstrate a satisfactory installation method. In addition, the Contractor shall coordinate with the vinyl sheet pile manufacturer (e.g. CMI, Inc. phone 1-800-256-8857) their recommendations concerning the proper vibratory plates or hammer / equipment and tools.
