PERFORMANCE WORK STATEMENT (PWS)
OAHE SURGE TANK ALIMAK ELEVATOR TROUBLESHOOTING & REPAIR
PART 1
GENERAL INFORMATION
1. GENERAL: This is a non-personal services agreement to provide services to troubleshoot and repair the Surge Tank Alimak Elevator at the Oahe Project in the Powerhouse. The elevator is a Linden Alimak Mini-Scando 4/9 rack and pinion passenger elevator rated at 900 pounds. The Government shall not exercise any supervision or control over the agreement service providers performing the services herein.
Such service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.
1.1 Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform troubleshooting and repair as defined in this Performance Work Statement except for those items specified as government furnished property and services. The contractor shall perform to the standards in this agreement.
1.2 Background: Inspection and services will be performed on the Alimak elevator located in the Surge Tank Structure of the Oahe Powerhouse. The Contractor must ensure they can perform to USACE specifications by providing references and/or samples of work upon request.
1.3 Objectives:
Linden Alimak Mini-Scando Elevator
• Perform troubleshooting to diagnose inoperability.
• Make repairs so that elevator can be used safely and reliably.
• Perform all test required to certify the elevator, insuring it meets all applicable standards and is safe to use.
1.4 Scope: The elevator will be troubleshot, repaired and certified for use, in accordance with applicable safety codes (e.g. ASME A17.1), federal and state regulations and per manufacturer’s recommendations.
The elevator will be safety tested per manufacturer’s recommendations and industry standards. If repairs will exceed the contract amount, the Contractor will notify the COR immediately and provide costs to perform repairs. The contractor shall provide an invoice within 30 days of the completion of work.
The Contractor will be responsible for delivery of the parts to the site. The Contractor is responsible for all travel and per diem to and from the site.
1.4.1. Estimate Quantity of Work: The U.S. Army Corps of Engineers, Omaha District, Oahe Project estimates one site visit to troubleshoot and possibly a return site visit with parts to repair if needed.
1.4.2. Starting Date: Work is to begin within 15 days of written notice by the USACE that the Contractor has been awarded each call order.
1.5 Period of Performance: The period of performance shall be for one hundred nineteen (120) days.
1.6 General Information
1.6.1 Quality Control: The contractor shall develop and maintain an effective quality control program (QCP) to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the agreement.
1.6.2 Quality Assurance: The Government shall evaluate the contractor’s performance under this agreement in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards.
1.6.3 Recognized Holidays: The Contractor is not required to work on the following recognized Federal holidays:

1.6.4 Hours of Operation: The contractor is responsible to perform the work, between the hours of 8:00 a.m. to 5:00 p.m. CST Monday thru Thursday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.
1.6.5 Place of Performance: The work to be performed under this agreement will be performed at the Oahe Project Powerhouse, Pierre, South Dakota.
1.6.6 Type of Agreement: The government will award a firm fixed priced Contract.
1.6.7 Security Requirements: All Contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The Contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in Contractor security matters or processes. Directions for background check are in paragraph 1.6.7.3
1.6.7.1 Submit a complete, updated and signed, list of all Contractor and subcontractor personnel, including their titles and intended working hours, who will be working on site prior to start of work. This listing shall be revised and resubmitted when personnel changes occur.
1.6.7.2 Personnel Risk Assessment
A minimum of seven days prior to engaging in work submit, to the Contracting Officer or Project POC, a Personnel Risk Assessment (PRA) for each employee requiring authorized unescorted access to the Jobsite.
The Contractor employee will only be allowed authorized unescorted physical access after the PRA is shown to and approved by the Government.
1.6.7.3 Authorized Unescorted Access Requirements
Perform a PRA on all Contractor personnel that require authorized unescorted access to the Jobsite. Costs associated with the execution of the PRA shall be at the expense of the Contractor. The content of the PRA is defined by the requirements as follows:
a. Criminal Check - Obtain a criminal background check, completed within the last seven years, on all Contractor personnel that require authorized unescorted access to the Jobsite. A minimum of a 7-year criminal background check with the state patrol office shall be performed from all states of residence and employment, for the past seven years. The COR through the Contacting Officer will approve, disapprove, or revoke authorized unescorted access to the Jobsite as a result of the seven-year background check in accordance with Army Directive 2014-05 Enclosure 2.
b. Identity Verification - Contractor employees shall provide positive verification of individual identity prior to authorized unescorted access to the Jobsite. Acceptable forms of identity verification are documents issued by a federal Government agency that include: the individual's photograph, name, and date of birth, such as a passport or military identification (ID) card.
Additionally, a state issued driver's license or ID card is acceptable for identity verification.
c. The Criminal Check and Identity Verification shall be updated at least every seven years for each employee requiring authorized unescorted access to the Jobsite.
d. Escort Requirements - Contractor personnel not cleared for authorized access to the Jobsite may be escorted by Government or Contractor personnel that have authorized unescorted access to the Jobsite. All costs related to the escorting of non-cleared personnel shall be at the expense of the Contractor. Additional burden shall not be placed upon the Government to provide these escorts.
Prior to access, coordination with the Project Security Officer is required, including but not limited to:
(1) Verification of identity with photo identification
(2) Name of escorting individual and verification of unescorted status
(3) Time of entry into the Jobsite
(4) Time exiting the Jobsite.
1.6.8 Special Qualifications:
1.6.8.1 All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas. There are NO classified materials at this project location.
1.6.8.2 The Contractor must pre-screen Candidates using the E-verify Program (http://www.dhs.gov/E- Verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award.
1.6.9 Post Award Conference/Periodic Progress Meetings: Not applicable.
1.6.10 Contracting Officer Representative (COR): Not applicable.
1.6.11 Key Personnel: The following personnel are considered key personnel by the government: Ms. Kris Cleveland, Chief Technical Support. The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate, who shall act for the contractor when the manager is absent, shall be designated in writing to the contracting officer. The contract manager or alternate shall have full authority to act for the contractor on all matters relating to daily operation of this agreement. The government representative or alternate shall be available between 8:00 a.m. to 5:00 p.m. CST Monday thru Friday except Federal holidays or when the government facility is closed for administrative reasons.

1.6.16 Organizational Conflict of Interest: Contractor and subcontractor personnel performing work under this agreement may receive, have access to, or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may effect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.
1.6.17 Governmental Safety:
All work shall be done in accordance with the requirements of USACE EM 385-1-1. The Government considers the Prime Contractor to be the "controlling authority" for all work site safety and health of the subcontractors.
PART 2
DEFINITIONS & ACRONYMS
2. DEFINITIONS AND ACRONYMS:
2.1. DEFINITIONS:
2.1.1. CONTRACTOR: A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.
2.1.2. CONTRACTING OFFICER: A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the Government. Note: The only individual who can legally bind the Government.
2.1.3. CONTRACTING OFFICER'S REPRESENTATIVE (COR): An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the agreement, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the agreement.
2.1.4. DEFECTIVE SERVICE: A service output that does not meet the standard of performance associated with the Performance Work Statement.
2.1.5. DELIVERABLE: Anything that can be physically or electronically delivered, but may include non-manufactured things such as meeting minutes or reports.
2.1.6. KEY PERSONNEL: Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a agreement by the Key Personnel listed in the PWS.
When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
2.1.7. PHYSICAL SECURITY: Actions that prevent the loss or damage of Government property.
2.1.8. QUALITY ASSURANCE: The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
2.1.9. QUALITY ASSURANCE SURVEILLANCE PLAN (QASP): An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
2.1.10. QUALITY CONTROL: All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet agreement requirements.
2.1.11. SUBCONTRACTOR: One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.
2.1.12. WORK DAY: The number of hours per day the Contractor provides services in accordance with the agreement.
2.1.12. WORK WEEK: Monday through Thursday, unless specified otherwise.

4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:
4.1 General: The Contractor shall furnish all supplies, equipment, labor and services required to perform work under this agreement that are not listed under Section 3 of this PWS.
4.2 Facility Clearance: The Contractor shall coordinate with the Project for any individual and joint clearances required for performance of this contract.
4.3. Materials: The Contractor shall furnish material and supplies necessary to meet the requirements under this PWS to include weights for testing.
4.4. Equipment: The Contractor shall furnish all equipment necessary to meet the requirements under this
PWS.

5.1. Basic Services: The contractor shall provide services to troubleshoot, repair, and certify elevator for use.

Performance Requirements Summary The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.
