Statement of Work Geotechnical Laboratory Testing
May 2023
Contract Description This commercial services indefinite delivery/indefinite quantity (IDIQ) contract is to provide geotechnical laboratory testing services for the U.S. Army Corps of Engineers (USACE), Omaha District, Engineering Division, Geotechnical Engineering and Sciences Branch. The period of performance for this contract includes a five-year base period.
Background This acquisition will support USACE Omaha District’s Geotechnical Engineering and Sciences Branch and Dam Safety Production Center by providing geotechnical laboratory services. These organizations coordinate geotechnical lab services for samples collected by USACE drill crews for customers within the contiguous United States. The laboratory selected for this contract (Contract Laboratory) will perform testing of soil, rock, and aggregate materials for USACE projects across all mission areas.
Description of Services The Contract Laboratory shall provide technically valid and legally defensible testing data that will meet the requirements of Engineering Manual (EM) 1110-2-1906, Engineering and Design Laboratory Soils Testing (latest version dated 20 August 1986) as well as current specified American Standard Testing Method (ASTM) standards. All testing shall be performed by qualified personnel in a laboratory accredited with current USACE Materials Testing Center (MTC) validation through the Engineering Research and Development Center (ERDC).
No special safety requirements above those necessary for a testing laboratory are required. No security clearances are required to perform this work.
Contract Laboratory Responsibilities and Qualifications The Contract Laboratory will perform and/or manage the testing for this contract. The Contract Laboratory shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal commercial services necessary to perform the laboratory testing services described in this statement of work.
MTC Validation: The Contract Laboratory and all subcontracted or alternate laboratories must be inspected and validated by the Materials Testing Center (MTC) of the USACE Engineer Research and Development Center (ERDC). The prospective Contract Laboratory shall possess and include with their proposal a current memorandum of validation from MTC for their approved testing services. The prospective bidders are advised that the validation process is a cost that will not be reimbursed as a separate charge. The Contract Laboratory is required to maintain a current MTC validation throughout the term of the contract. If the prospective Contract Laboratory will subcontract or reassign testing to another laboratory, the same MTC validation requirements shall also apply to the subcontracted/alternate laboratories. The prospective Contract Laboratory shall provide with their proposal a current MTC validation memorandum for each subcontracted/alternate laboratory they intend to use.

Quality Management: Contract Laboratory management shall be responsible for actively supporting the implementation of the laboratory’s Quality Management Plan within the laboratory, maintaining accurate standard operating procedures and enforcing their use in the laboratory, maintaining a work environment that emphasizes the importance of data quality, and providing appropriate management support. Laboratory management shall also designate the primary contact for the receipt of delivery orders for this contract.
The Contract Laboratory must have an organization with well-defined responsibilities for each individual in the management system to ensure that sufficient resources are available for this contract and to maintain a successful operation. The MTC requires laboratories to have a minimum of two technicians on staff that have current American Concrete Institute (ACI) certifications for all tests with associated ACI certifications that will be performed as part of this contract, which includes ASTM D4318, D2216, D698, and D1557.. Copies of current ACI certifications for at least two technicians performing work under this contract must be kept with the COR. The Government will periodically verify that the Contract Laboratory has current certifications for at least two technicians.
Facility: The Contract Laboratory shall have a primary laboratory facility located within a 50-mile radius of USACE Omaha District Headquarters, 1616 Capitol Avenue, Omaha, Nebraska 68102.
The Contract Laboratory shall provide reasonable accommodations at their primary laboratory facility for USACE personnel to visit and view samples.
Testing: The Contract Laboratory shall perform the primary tests listed in Table 1 of this SOW at their primary laboratory facility. The Contract Laboratory shall either perform the secondary tests listed in Table 2 at their primary laboratory facility, an alternate facility within the same organization, or subcontract these tests to another laboratory. Exceptions may be granted with written authorization from the COR to allow primary testing to be subcontracted to another laboratory in the event secondary testing will be performed on the same sample.
If the Contract Laboratory plans to use an alternate facility or subcontract testing, they shall submit with their proposal a list of MTC validated laboratories they will use. Subcontracted/alternate laboratories must be approved by the Government. The Contract Laboratory may only subcontract or reassign testing to the approved laboratories provided with their proposal. The Contract Laboratory shall not subcontract or reassign more than 50% of the contract capacity from the primary facility. Shipping and handling costs associated with using another laboratory shall be factored into the unit price of the secondary tests listed in Table 2.

In the event a test requires modification from the prescribed ASTM methodology and will result in additional cost to the Contract Laboratory, a new unit price for the test shall be negotiated before task order award. Modifications to tests and price negotiations will be on a task order basis.
The scope for each project will be defined in the individual task order. Sample quantities and testing requirements may change due to numerous factors, including field conditions, retrieved sample quantities, sample disturbance, project scope adjustments, etc. The Government will estimate the type and quantity of tests for individual task orders and reserves the right to adjust the task order scope after sample delivery. Adjustments to individual task orders shall not exceed the task order award amount unless modified by the Contracting Officer. The Government may assign a testing program for individual task orders that is less than the task order award amount.
Storage: The Contract Laboratory shall retain USACE Omaha District owned project samples for a period of 6 months after completion of testing. Samples may be discarded after this period. The Contract Laboratory shall appropriately label, seal, and store all Omaha District owned samples in a manner that limits degradation of the samples. The Contract Laboratory shall contact the project technical lead and COR at least 7 days prior to discarding samples. The USACE technical lead or COR will arrange for retrieval of samples if they must be kept for a period longer than 6 months.
Submittals: For each task order, a final, signed report of testing results is required to be delivered to the COR by the date listed on the task order. The Contract Laboratory will be given 30 days from the execution of the task order to complete testing and submit a Final Testing Report.
Variations to the task order duration may be negotiated on an individual task order basis if the Contract Laboratory is unable to meet the schedule.
The Final Testing Report shall be submitted electronically in pdf format to the USACE technical lead. At least 90% of testing reports shall contain no errors. The Final Testing Report shall contain, at a minimum, the following:
a. Submittal letter with Contract Laboratory supervisor/manager signature.
b. Summary tables of individual test results and testing methods used.
c. Summary graphical representation of index soil testing.
d. Graphical representation of all strength, consolidation, swell, expansion, CBR, and laboratory compaction tests.
e. Presentations required by individual testing methods designated and as presented in their respective ASTM standards.
The final submittal shall also include an Excel file with a summary table of individual test results.
Government Organization and Responsibilities
Contracting Officer (KO): The KO will be responsible for the overall contract. This individual or their designee will provide selected review of all activities and procedures and provide senior technical oversight throughout the duration of this contract.
Engineering Division Contracting Officer’s Representative (COR): The COR will be the main contact for the Contract Laboratory. This individual, or their designee, will be responsible for the daily management and execution of this contract. The COR will be responsible for quality assurance auditing and monitoring. This individual will have access to all work and will identify potential quality problems; initiate, investigate, recommend, or provide solutions to quality problems through designated channels; verify implementation of solutions; and ensure that further processing or action is controlled until proper disposition of unsatisfactory conditions has occurred.
Quality Assurance: The Government shall evaluate the Laboratory Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the Laboratory Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rates.
The Government will conduct frequent reviews of test reports and random inspections of the laboratory facility, personnel, and equipment. As part of quality assurance, split samples may be obtained on a random basis and tested by another laboratory.
Sample Delivery: Samples shall be delivered to the Contract Laboratory’s primary laboratory facility by a USACE employee or authorized contract drilling agency. USACE will deliver samples when the Contract Laboratory has received a fully executed task order. The Contract Laboratory shall begin testing after receipt of a task order from the KO.

ORDERING INSTRUCTIONS
ORDERING PROCEDURES
I. . GENERAL:
DELIVERY OR PERFORMANCE REQUIREMENTS: Performance Requirements will be established in each Task Order scope of work.
II. ORDERING PROCEDURES:
1) ORDERING: To clarify the contract clause 252.216-7006 "Ordering" the following shall apply:
a. When the Government requires work under the contract, a Request for Task Order Proposal (RFTOP) will be issued. RFTOP will normally be issued electronically by email but may be placed via mail, telephone, facsimile, or other electronic means.
b. The Government will not be obligated to reimburse the contractor for work performed, items delivered, or any costs incurred, nor shall the contractor be obligated to perform, deliver, or otherwise incur costs, except as authorized by duly executed Task Orders.
c. The Government request for proposal will delineate the: number and type of tests based on the pre-priced schedule.
d. Task orders will be evaluated for technical acceptability. The contractor shall confirm acceptance of number and types of tests on the RFTOP and submit his/her acceptance in writing to the individual and within the time specified in each request for proposal.
e. Time periods within which required work must be accomplished will be defined in each task order placed against the basic contract. Each task order will contain the agreed to scope of work, project to be performed, specific deliverable items, and the final fixed price for performing the work.
e. Upon award the awardee will be notified via a signed task order.
2) Proceeding with Work: The contractor shall commence work upon receipt of a properly executed Task Order or modification to a task order. The contractor shall complete the work within the time specified in each task order or modification to each task order.
3) Period of Performance: Period of Performance for spraying operations will be determined by individual Task Order. Task Orders may be issued against this contract for a period of 5 years from date of award or when the maximum contract ceiling value is reached, whichever occurs first.
4) Contract Type: This is an Indefinite Delivery/Indefinite Quantity (IDIQ) firm fixed service contract. A requirements contract provides for filling all actual purchase requirements of designated Government activities for supplies or services during a specified contract period (from contract holder(s)), with deliveries or performance to be scheduled by placing orders with the contractor.
5) Contract/Task Order Limitation: The dollar threshold for all task orders to be placed against this contract over the five-year period of performance shall not exceed $750,000.00. IAW FAR Clause 52.219-14, Limitation of Subcontracting, the Offeror agrees that in performance of the contract at least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern.
6) Service Contract Act: Applicable Service Contract Act determination will be identified within each Task Order proposal request.
7) Minimum Guarantee: The minimum Guarantee amount is $2,500 and is held until the first task order is issued.
Once the first task order is issued this amount will be de-obligated. If no order is issued against this SATOC, the Minimum Guarantee amount of $2500 will be issued to the contractor at the end of 5 year performance period if no orders are placed.
8) UNAUTHORIZED INSTRUCTIONS FROM GOVERNMENT OR OTHER PERSONNEL: Only a warranted Contracting Officer (either a Procuring Contracting Officer (PCO), or an Administrative Contracting Officer (ACO)), acting within their delegated limits, has the authority to issue modifications or otherwise change the terms and conditions of the Task Order of the base contract. If an individual other than the Contracting Officer attempts to make changes to the terms and conditions of this contract you shall not proceed with the change and shall immediately notify the Contracting Officer.
9) OBLIGATION BY THE GOVERNMENT: The Government is not obligated to fund the maximum cumulative dollar amount of this contract.
10) DESIGNATION OF CONTRACTING OFFICER'S REPRESENTATIVE(S) (COR): Designation will be made upon award of each Task Order and a copy of the designation letters will be furnished to the contractor. Limits of authority are described in each designation letter.
11) AUTHORIZED REPRESENTATIVE OF THE CONTRACTOR: The contractor shall designate a member or employee who will act as project manager for the base contract or during the performance of a Task Order. This official shall be the liaison between the contractor’s work forces and the Government.
12) AVAILABILITY OF FUNDS (REFERENCE FAR 52.232-18): The Government may request proposals for Task Orders for which funding is not currently available for the award. If funds fail to become available for the award of the project, the event shall not constitute a basis for equitable adjustment under this contract. If after the Government receives a contractor's proposal and funds are not available, the Government may request an extension of the contractor's proposal acceptance period without further competition for the project or may re-solicit the project at its option. If the proposal acceptance period is not extended by the contractor the project may be re-solicited.

Complete geotechnical testing of soil and aggregate samples according to the Scope of Services. All testing shall be performed by qualified personnel in accordance with ASTM or other prescribed standards, and shall be performed by a laboratory with current ERDC accreditation for all testing performed.
